Viktor Yushchenko will turn to the Constitutional Court over the law on the Cabinet of Ministers of Ukraine

President Viktor Yushchenko today confirmed the intention to appeal to the Constitutional Court regarding the Law on the Cabinet of Ministers of Ukraine adopted by the Parliament. He stated this at a press conference in Mukachevo.

“The most effective way to overcome the imbalance between the authorities is the consideration in the Constitutional Court on the proposal of the President of those provisions of the Law on the Cabinet of Ministers that do not comply with the current Constitution,” his press service quoted Yushchenko.

According to the president, "overcoming the presidential veto on the law on Cabinet put the last point in the possibility of holding a certain balance in relations between the president, government and parliament." Yushchenko called such a decision of the Verkhovna Rada "non -constructive", adding that it "flowed, unfortunately, on the initiative of only one side - the government, and in fact, the prime minister."

The President emphasized that this position of the parliament causes pessimism about the possibility of the implementation of the "universal of national unity", at least in that part of it, which concerns the law on the Cabinet.

The head of state also confirmed that "he advocates amendments and additions to the current Constitution, which would allow to find a balance in relations between the key authorities."

The Cabinet Law adopted by the Parliament, as believe in the secretariat of the head of state, violates more than 10 provisions of the Constitution. According to the Basic Law, the president introduces the candidacy of the Prime Minister proposed by the coalition for the approval of the Verkhovna Rada.

If he does not do this within 15 days, then the Cabinet Law gives such a right to the parliamentary majority. A similar procedure is provided for in the appointment of ministers of defense and foreign affairs. In the Constitution, this right is assigned to the head of state.
