The State Duma will be proposed another bill in support of defrauded co-investors

Another recipe for helping victims of construction pyramids was announced yesterday by the movement “Committee for Assistance to Victim Shareholders: Housing. Earth. People" (ZhZL). This organization, which united shareholders from several Russian regions last year, presented its bill “On state guarantees for the protection of investments of citizens - co-investors in construction.” This is the second normative act proposed to the State Duma, designed to correct the situation with the chronic unfinished residential buildings that have already been paid for at the foundation pit stage. Last fall, an alternative document was presented by a working group at the Public Chamber led by Anatoly Kucherena. However, today it is clear that the two bills, like their authors, are competing with each other for the right to be considered the main option for solving the problems of shareholders.

In any case, the chairman of the ZhZL movement, Anton Belyakov, assured yesterday that it was his bill that “offers real, not abstract, options for resolving the issue.” The document, in particular, provides for the allocation of additional, preferably adjacent, territories to companies that undertake to complete the construction of abandoned construction sites - the so-called “compensation” sites. According to the authors of the document (and, according to Mr. Belyakov, it was developed by the shareholders themselves with the invitation of experts), this will serve as sufficient motivation for investors.

Another innovation of the document: it introduces into legal practice the concepts of “victim co-investor”, “participant in shared construction”, and also takes into account the interests of victims of direct fraud, which the authorities are now disowning. “After a powerful wave of protest in a number of regions, negotiations began, which resulted in constructive agreements,” said Mr. Belyakov. - True, now in the vast majority of regions these agreements are not being implemented. But where the problem moves forward, everything develops precisely according to the technology that we offer: mayors come to an agreement with the heads of construction organizations, and for this they allocate a couple of additional sites out of competition. But now they are doing this outside the legal framework, and after the adoption of the law, the allocation of such sites will become legal.” The leader of the ZhZL movement hopes to submit his bill to the Duma before the autumn parliamentary elections.

The chairman of the Public Chamber commission on public control over the activities of law enforcement agencies, security forces and reform of the judicial and legal system, Anatoly Kucherena, refused to comment on the initiative of the “Committee for Assistance to Injured Shareholders.” As for a similar bill, in the development of which he himself took part, the document, according to Mr. Kucherena, is still being approved by the Ministry of Regional Development. It has not yet been submitted to the State Duma. However, as Mr. Kucherena told a Vremya Novostei correspondent, “whether this law is adopted or amendments to another one are adopted, it doesn’t matter, the main thing is to give people apartments, and this can only be achieved through joint work with the authorities.”

Meanwhile, bailiffs also joined in solving the problems of defrauded shareholders, offering their own mechanisms for solving the problem. Actually, they had no choice after the service accumulated over 4.5 thousand enforcement documents from the courts in favor of defrauded shareholders, more than half of them were in the capital. This was announced yesterday by the acting Chief Bailiff of Moscow Yuri Sibilev. According to Mr. Sibilev, bailiffs are already ready to transfer unfinished houses to the authorities of the constituent entities of the federation if they “give written guarantees that they will comply with the court decision and complete the construction of these objects.”
