PACE called on the political forces of Ukraine to comply with democratic norms and agree with the decision of the KS

In Strasbourg on urgent debates in Ukraine in PACA, the speaker of the Assembly monitoring committee on the situation in Ukraine Renata Volvent proposed on behalf of PACE as a way out of the crisis by the observance of democratic norms and negotiations. In addition, on behalf of the Assembly, she called on political forces within Ukraine to agree with the decision of the Constitutional Court of this country, RIA Novosti reports. Recall that President Yushchenko and Prime Minister Viktor Yanukovych said they were ready to recognize the decision of the Constitutional Court.

“The Constitutional Court is the highest institution, an independent body,” said Volvent. The speaker added that at the moment in Ukraine it was not possible to create independent institutions of power, avoid corruption, grant the genuine rights of the opposition and expressed concern about the fact that "the Constitutional Court does not actually work." Volvent also drew attention to the fact that a low political and moral culture is observed in the country.

According to Volvent, early elections will not settle the political crisis. At the same time, she noted that the current composition of the parliament does not reflect the will of the people. She spoke out for the balance of power through constitutional reform. “Everything says for the continuation of the constitutional reform. And everything must be done in the name of the Ukrainian people,” she said.

Most of the speakers on the debate talk about the need to solve the situation by fulfilling the decision of the Constitutional Court and continuing the constitutional reform and amending the electoral legislation, Interfax reports.

A socialist deputy from Latvia noted that the goal of the audience not to decide “who is good, who is bad” but to unite Europe, given that Ukraine ”has the potential to be one of the leaders of Europe.” He also noted that the problems of Ukrainian legislation are not new and exist "not only in this country." In conclusion, he called on Ukrainian politicians to respect the obligations taken to his voters.

A similar position was expressed by a deputy from the Netherlands. “We should not decide who is right and who is wrong. The responsibility of politicians is to find a compromise, the responsibility of politicians is the interests of people in Ukraine, men and women, children. They must respect the obligations given to people,” he said.

PACE RENE, Van Der Linden, who met on Thursday in Strasbourg with the speaker of the Verkhovna Rada of Ukraine Alexander Moroz, who arrived as a guest to hear the Ukrainian question in PACA, also stated that "the Assembly will not occupy one or another position."

In the speeches, deputies often noted that when the Constitutional Court would make a decision, "it should not only respect it, but also fulfill it." "We must call on all parties to negotiations and respect the decision of the Constitutional Court," the speakers said.

And only the representative of Russia, Konstantin Kosachev, said that the Decree of President Yushchenko contradicts the constitution, "violating it and unlawfully cancels the will of citizens." "If the Constitution is imperfect and allows the possibility of a double interpretation, the president had to preliminarily hold all the necessary consultations, including with the Constitutional Court, and only after that to sign the decree. The fact that he did not do this is a confirmation that this is the desire to change the political situation for his own political tasks and goals," he said.

The Ukrainian parliament adopted on Thursday an appeal to PACE regarding Yushchenko’s pressure on the Constitutional Court of Ukraine. For this appeal, 252 people's deputy out of 258, registered in the hall, voted, UNIAN reports.

The appeal is about the fact that "contrary to the Constitution, neglecting the constitutional status, the guarantor of compliance with the Constitution publicly holds meetings with the judges" KS, "imposing their vision of the situation".

The appeal states that the president "reached the threats of judges", speaking of the early termination of their powers, "which, obviously, is the same legal self -will as the early termination of the powers of the parliament."

The document says that "the object of blackmail by the President of the special services was the judge-speaker in the case of verifying the constitutionality of the Decree of the President." The authors of the appeal also claim that the opposition, "shamelessly neglecting morality and law, tried to block the work of the Constitutional Court."

The appeal expresses the hope that Pase, making a decision, will be guided by the fact that "the balanced and legal perfection will become the core of its decision regarding the settlement of the political crisis in Ukraine, which, we hope, will make the further pressure of individual political forces on the Constitutional Court."

For her part, the Verkhovna Rada confirmed in appeal a willingness to agree with any decision of the Constitutional Court regarding the constitutionality of the Decree of the President Viktor Yushchenko on the dissolution of parliament and the holding of early elections.

Recall that the Constitutional Court of Ukraine, which includes 18 judges, continues the consideration of the legality of the Decree of the President Viktor Yushchenko on April 2 on the dissolution of the parliament and the appointment of early elections on Tuesday. The reason for signing the decree was the transition of 11 deputies of the Verkhovna Rada from the opposition to the government coalition. The coalition deputies considered the decree unconstitutional and did not obey the president, and 53 parliamentarians sent a submission to the Constitutional Court of the decree to the Basic Law of Ukraine.

On Thursday , the third meeting began on this issue. The meeting, as planned, opened at 9:30 local time. The meeting contains all 18 judges of the Constitutional Court, including the Judan Judgment in the case of Suzanne Stanik, whom the Security Service of Ukraine accused of corruption .

About five thousand supporters of the coalition and 10 thousand supporters of the dissolution of parliament gathered near the court building.

The day before, the meeting began late for an hour after the fighters of the special forces of the Berkut Ministry of Internal Affairs unlocked the entrance to the building. Representatives of the Our Ukraine party said that a number of deputies were beaten at the direction of representatives of the coalition. In turn, the Prosecutor General’s Office on Thursday opened a criminal case in connection with the incident, as well as in connection with the accusations of the SBU against the judge of the KS Suzanna Stanik, regarding this as pressure on the court.

Recall also that on the eve of the leader of the Ukrainian opposition, Yulia Tymoshenko called on the people of Ukraine to gather on Friday at 18:00 on European square in Kiev and stay on it until the early elections of the Verkhovna Rada. According to her, it is time to stop "a demonstration of artificially purchased Maidans by the Party of Regions and collect the Maidan that has already put things in order in Ukraine more than once."
