The head of the Constitutional Court of Ukraine Dombrovsky was dismissed of his own free

Ivan Dombrovsky was fired from the post of head of the Constitutional Court of Ukraine of his own free will. Such a decision was made at a COP meeting on Thursday. "The duties of the chairman of the Constitutional Court are assigned to the deputy head of the Constitutional Court Valery Pshenichniki," the press service of the court told Interfax.

Dombrovsky was appointed judge of the Constitutional Court to the Congress of Judges of Ukraine. He was already trying to leave the post of chairman of the Constitutional Court on April 4, citing the fact that he was pressure. However, then the Constitutional Court did not satisfy his resignation.

Pshenichny already said on Thursday in an interview with the Khreshchatyk newspaper that the Constitutional Court will begin consideration of the case on the proposal of deputies on the constitutionality of the Presidential Decree of April 26 on the dissolution of parliament. "I am legitimately fulfill the duties of the chairman of the Constitutional Court from 17:30 today," Pshenichichny noted.

Valery Pshenichniki was appointed judge of the Constitutional Court in January 2003 by a decree of the then President of Ukraine Leonid Kuchma. On April 30, the current President Viktor Yushchenko dismissed Pshenichny from the post of judge of the Constitutional Court "For violation of the oath". On May 1, the Ukrainian president, with the same wording, dismissed the judge of the KS Suzann Stanik . In their place, the president appointed Vasily Kostitsky and Stepan Gavrish on May 3 and 4.

In addition, on May 10, Yushchenko fired the judge of the Constitutional Court Vladimir Ivashchenko - and again in connection with a violation of the oath. It is noteworthy that in all three decrees it does not disclose what exactly the violations committed by judges were. All three judges were appointed to the Constitutional Court of the President’s quota, whose post at the time of their appointment was occupied by Leonid Kuchma.

Wheat and Stanik challenged this decision of the president in the courts. On May 15, the court in Donetsk suspended the decrees of President Viktor Yushchenko on the dismissal of judges of the KS Suzanne Stanik and Valery Pshenichniki.

The next day, May 16, the representative of the Secretariat of the President of Ukraine, Igor Pukshin, said that "the KS decisions will be illegal if the dismissed judges will participate in their adoption." The Constitutional Court must decide on compliance with the main law of the country of the President of Ukraine on the early dissolution of the Verkhovna Rada and the appointment of extraordinary parliamentary elections. The COP includes 18 judges (six judges are appointed by the president, parliament and the congress of judges). For a quorum at the meeting, the presence of 12 judges of the Constitutional Court is necessary. To make an effective decision, at least 10 votes are needed. The head of the Constitutional Court is elected by the judges of the Constitutional Court.

The press service of the KS confirmed on Thursday that Maria Markush was appointed judge by the Constitutionality of the Second Decree of the President (dated April 26 on the early termination of the powers of the parliament. The acting head of the KS press service, Ivan Avramov, noted that he has no information that the president’s ideas on the dissolution of the parliament were combined into one production.
