Chita court allowed the ex-head of Menatep Platon Lebedev to have an alibi

The Ingodinsky District Court of Chita on Friday satisfied the complaint of the ex-head of the MFI MELITEP Platon Lebedev about the actions of the head of the investigative group of the Prosecutor General of Salavat Karimov, who refused to check his Alibi on new accusations, said RIA Novosti Lebedeva Igor Sapozhkov.

As Sapozhkov explained to Interfax, the investigator refused to demand from the competent authorities information about the crossing of the Lebedev border of Russia, which can serve as evidence of his alibi.

The new accusations of Lebedev and ex-heads of Yukos Mikhail Khodorkovsky are associated with the theft of shares belonging to the state, as well as with the appropriation of oil and the legalization (laundering) of funds acquired by criminal means on an especially large scale. According to the Prosecutor General’s Office, the total Khodorkovsky, Lebedev and members of the organized group in 1998-2004 legalized 487 billion rubles and $ 7 billion.

“My absence in Russia at the time when I am charged with a crime is an alibi. Hiding Alibi is an official crime,” the defender of Lebedev’s word in court quoted.

"The court issued a private decision against the Prosecutor General’s Office addressed to the Deputy Prosecutor General Green on the inadmissibility of violations of the Code of Criminal Procedure in relation to Lebedev committed by Karimov," said Sapozhnikov. The court ordered the Prosecutor General to eliminate the violations.

Earlier, the court had already considered Lebedev’s complaint similar in essence, which was satisfied. In February 2007, the district court satisfied Lebedev’s first complaint against the actions of investigators of the Prosecutor General’s Office, who refused to provide him with documents for their protection during the preliminary investigation in a new criminal case.

Recall that Lebedev and Khodorkovsky were transferred to Chita in mid -December 2006 for investigative actions. Prior to that, they served an eight -year term of imprisonment in the colonies.

Meanwhile, on March 20, the Basmanny Court of Moscow recognized the preliminary investigation in the new case in relation to Khodorkovsky and Lebedev in Chita illegal . However, the Prosecutor General's Office appealed this decision. It should be noted that the court decision took place after the lawyers of the ex-head of the Yukos turned "to all people of goodwill" with a request to help to achieve their client from Chita to Moscow and hold a new trial there.
