The Director of the Perm School accused of piracy filed a second cassation appeal

The director of the Sypich rural school of the Vereshchaginsky district of the Perm Territory, Alexander Ponosov, sentenced to a fine for the use of Windows unlicensed programs on school computers, filed a repeated cassation appeal. He requires recognition of his innocence and complete justification, ITAR-TASS reports. This was reported to the agency by Ponosov himself.

According to him, he intends to "fully defend his innocence and achieve an acquittal." The school principal considers the prosecution arguments regarding his violation of the intellectual property rights of Microsoft to be unfounded.

In turn, Ponosov’s lawyer Vladimir Bobrovsky considers it natural to seek his client to seek a revision of the case, since in his actions "there is no corpus delicti, and the defense line will be built on this." At the same time, the lawyer does not exclude that the prosecution that the decision made on May granted on May 7 can write an objection to the cassation appeal of his client.

Recall that on May 7, Vereshchaginsky District Court found Ponosov to be guilty and sentenced to pay a fine of five thousand rubles. The court determined the damage caused by Microsoft in the amount of more than 22 thousand rubles.

The criminal case under Article 146 of part 3 p. "In" the Criminal Code of the Russian Federation (violation of copyright and related rights on an especially large scale) against Alexander Ponosov was instituted in May 2006 after the prosecutor’s audit found that the Windows unlicensed programs were installed on school computers at the Sypych School. According to the results of the examination, the damage from the use of unlicensed programs amounted to more than 250 thousand rubles.

On February 15, Vereshchaginsky District Court ruled "for insignificance and lack of danger to the company"to close the criminal case of Ponosov. The verdict was appealed by both parties. The parties filed oncoming lawsuits to the upper court, and on March 27, the Komi-Permyak branch of the regional court abolished the verdict, returning the case for re-consideration to Vereshchaginsky District Court in a different composition of judges.

The prosecutor's office of the Perm Territory was informed that Alexander Ponosov is not the only teacher in the region who is accused of using the unlicensed discs. According to the department for the supervision of the investigation of crimes, "last year, several cases of using pirate computer programs by rural schools were recorded in Prikamye." So, during inspections in the Karagaysky, Sivinsky and Suksunsky districts, computer science teachers were subjected to the use of unlicensed programs. They were sentenced to cash fines, but not one of them appealed the court decision.

As the agency notes, the case of "pirate copies" began to bring a certain benefit to sellers of computers. According to the estimates of Perm computer companies, during the trial in Perm, sales of licensed software increased half. Many companies and enterprises turned to the help of professionals to purchase licensed software products.
