
Amendments to the Law on Compulsory Auto Insurance, which are designed to simplify the procedure for receiving insurance payments, approved by the Government, are sent to the State Duma.
The main innovation introduces a system of direct settlement of losses, according to the procedure of the “European protocol”. That is, in the event of an accident, a motorist will be able to apply for an insurance payment directly to the company with which he has concluded an OSAGO agreement, and not in the company of the culprit of the accident, as is being done now. This will really simplify the life of the victims of an accident, which often, due to small amounts, refused to run around other people's companies than they actively used. At the same time, a penalty will be introduced for tightening time for the payment of insurance - 1/75 from the refinancing rate of the Central Bank for each day of delay.
In addition, it is proposed to increase the limit of insurance payments for causing harm to life and health to 160 thousand rubles for each victim and remove the current limit level of compensation now - 240 thousand rubles for all victims. As the Deputy Minister of Finance Sergey Shatalov explained, this will avoid cases when, for example, this amount was divided into 40 affected bus passengers.
The bill establishes a number of cases in which it will be possible to execute insurance payments for accidents without the participation of traffic police officers. This will allow drivers to save time and not create traffic jams, waiting for police officers. True, it will be possible to do without a police in the event of a small accident: if no more than two cars have suffered, and the amount of damage does not exceed 25 thousand rubles (with the consent of both victims).
Also, innovations cancel the norm in accordance with which insurance cases of OSAGO did not apply to the so -called “internal territories of the organization” (parking, refueling, etc.). According to Shatalov, this norm "allows many insurance companies to refuse payments for accidents that occurred in yards, parking lots, gas stations."
If the State Duma and the President support the amendments, they will come into force in 2008. Meanwhile, the insurers have already expressed fear that after the entry into force of amendments that allow accidents without the participation of the police, cases of fraudulent conspiracies will be fought.
