The fight between fiscal officials and “gray” salaries seems to be entering a decisive stage, and the matter will not be limited to talking about calling defaulters to the inspector, as was the practice until recently. Particular attention will henceforth be paid to the mechanisms of “missing” taxes on the way from the tax agent (that is, the employer) to the employee. The Federal Tax Service (FTS) announced the completion of work on the creation of a federal information database on the income of individuals for 2006 and the development of software to identify employers who violate tax laws. Fiscal officials also warn employers about criminal liability for failure to transfer income taxes to the budget.
About 101 million pieces of information have already been loaded into the federal income database. According to a press release issued by the Federal Tax Service on Thursday, software has undergone trial operation to allow analysis of information about the income of individuals submitted by the employer to the tax office. The new program, as fiscal officials assure, is easy to use. It allows you to identify incomplete provision by employers of information about the income of their employees, including the presence of “gray” salaries at the enterprise.
A trial launch of a system that automatically analyzes information about citizens’ income received from employers showed that 156 thousand tax agents have “possible violations” of tax legislation. 10 thousand tax agents are included in the plan of on-site tax audits, almost half of them have already been audited. As a result of the inspections, an additional 2.4 billion rubles were accrued. taxes, penalties and fines. According to expert estimates, possible additional income tax charges could exceed 6 billion rubles.
Carrying out regular monitoring of tax agents, as the Federal Tax Service believes, will make it possible not only to identify non-payment of income tax to the budget, but also to carry out individual work with tax agents. And also, as stated in the press release distributed yesterday, “to select enterprises in a high-quality manner to formulate plans for on-site tax audits.”
Tax officials remind that failure to fulfill the duties of a tax agent, in particular for failure to transfer income tax to the budget, is subject to not only tax liability, but also criminal liability. As formulated in the press release, “tax authorities plan to more widely practice transferring cases to internal affairs bodies to apply Articles 199, 158 and 160 of the Criminal Code to negligent employer managers.”
In total, this year, 2 million 108 thousand employers were involved in providing information on employee income, which is 85 thousand more than last year. Tax agents who did not provide the specified information, as well as those who provided information on the income of individuals after the established deadline, were charged with fines of almost 35 million rubles.
