
On Thursday, the Savelovsky Court of Moscow found the guilty of the entrepreneur Boris Berezovsky in the embezzlement of about 215 million rubles of Aeroflot Airlines and sentenced him to six years in a general regime colony.
The term of punishment Berezovsky will be calculated from the date of his actual detention. Now the Russian Prosecutor General’s Office of Russia will re -ask Berezovsky’s extradition from the UK based on the sentenced.
Berezovsky himself "does not recognize" the conviction to him. As he stated on the air of the Echo of Moscow radio station, a criminal case instituted against him - "this is a political farce, and the result of this case - it would be 6, 9, 20 years old, or for lifelong - accepted in the Kremlin."
The court qualified the actions of Berezovsky under paragraph “b” of part 3 of Article 159 of the Criminal Code of the Russian Federation (theft in the form of fraud), but excluded Article 174 of the Criminal Code of the Russian Federation (legalization or laundering of illegally received funds), since he found that Berezovsky’s actions to separate the abducted revenue “Aeroflot” completely fall under the qualifying feature of Article 159.
The court decided to recover from Berezovsky the damage in the amount of 214 million 988 thousand 879 rubles 70 kopecks caused by Aeroflot.
This is the first case against Berezovsky, considered in court, although several criminal cases have been instituted against him in Russia, a total of 11 charges were brought in a total of $ 13 million, SBS-Agro Bank, and six sanctions were issued in absentia, Interfax reports.
The trial , which began in September, took place in absentia due to the fact that Berezovsky, put on the international wanted list, is located in the UK, where he received the status of a political refugee. The Russian authorities repeatedly sent a request for his extradition, but the issuance was refused.
The prosecutor's office asked to appoint a sustainable oligarch for nine years . And the articles of the Criminal Code of the Russian Federation, which are accused of Berezovsky, provide for the maximum punishment of imprisonment for up to 10 years.
The lawyers of Berezovsky Semyon Aria and Andrei Borovkov were present only at a preliminary hearing in this case, after which the entrepreneur forbade them to participate in the process. In this regard, Berezovsky was granted a lawyer for their intended purpose.
Free lawyer Alexander Dudkin earlier admitted that he was “absolutely like a figure” on which he was asked to “sit”. However, fulfilling his professional duties, he asked Berezovsky during the debate: "I ask the court to stop this case and make an acquittal of the complete absence of evidence of Berezovsky’s guilt." The lawyer substantiated this by the fact that in 1996, Berezovsky left the board of directors of Andava, through which, according to investigators, Aeroflot funds were carried out.
The Aeroflot case is connected with operations with the airline foreign exchange earnings through Swiss companies "Forus" and "Andava". Earlier, the Savelovsky court sentenced the three other persons in this case - the former deputy leader of Aeroflot, Nikolai Glushkov, the former chief accountant of the company Lidia Kryzhevskaya and the head of the financial united corporation (FOC), Roman Sheininak - by 2 years in prison, conventionally everyone and collected 214 million 988 thousand rubles from them in favor of Aeroflot.
