He was brought to justice in a corruption case at the Moscow City Internal Affairs Directorate

Yesterday it became known that the Simonovsky District Court of Moscow gave permission to prosecute the lawyer of the Moscow Regional Bar Association Denis Tumarkin. The court recognized that Mr. Tumarkin’s actions contained signs of fraud and attempts to legalize illegally obtained funds. The lawyer has become another defendant in a criminal case of corruption in the Moscow Main Internal Affairs Directorate, in which charges have already been brought against a number of current and former law enforcement officers.

The meeting at which judge Olga Nedelina considered the presentation of the investigative committee at the Prosecutor's Office of the Russian Federation was held behind closed doors. It is known that she considered the evidence voiced during the meeting by representatives of the investigation to be sufficient and made a decision to “recognize the signs of a crime in the actions of lawyer Tumarkin.” Mr. Tumarkin and his two lawyers promised to appeal the court decision in the Moscow City Court.

As Kommersant learned, based on the court decision, the investigation plans to bring charges against lawyer Tumarkin under Art. 159 (“Fraud on an especially large scale”) and Art. 174 (“Legalization of funds acquired by criminal means”). Given the severity of the suspicions, the investigation does not rule out the possibility of filing a petition in court to arrest the lawyer. Moreover, in 2003 he was already sentenced by the Nikulinsky District Court of Moscow for fraud.

This time, lawyer Tumarkin, according to the investigation, was involved in a criminal case of corruption in the Moscow Main Internal Affairs Directorate (Kommersant spoke in detail about this case on March 4). In this case, we would like to remind you that one of the leading employees of the Tax Crimes Department (TCD) of the capital's Main Internal Affairs Directorate, Andrei Seryapin, and the general director of the private security company "Vympel-AT", a former FSB officer, Alexander Pechalov-Morozov, were charged and then arrested. Another person involved in the case, detective officer of the Internal Affairs Directorate of the Central District of Moscow Vitaly Lazarchuk, is under recognizance not to leave the place. According to the investigation, taking advantage of a criminal case against a small construction company, UNP officers in November last year conducted a search in the office of the companies FKG Delta and MFA, owned by entrepreneur Dmitry Danilov, and then extorted money from him, promising to stop the alleged criminal prosecution. One of the participants in the fraud, according to the victim’s representative Olga Tregub, was lawyer Tumarkin. Negotiations between the parties were held in his office, located in the elite residential complex “Golden Keys” on Minskaya Street. During which, according to the investigation, lawyer Tumarkin, having allegedly contacted by telephone one of the heads of the main investigative department of the Moscow Main Internal Affairs Directorate, told Dmitry Danilov that for 40 million rubles. the criminal case will be closed, and the documents seized during the searches will be returned. “My client understood that if his company did not start working in the near future, he would be ruined. Therefore, he was forced to agree to these conditions,” noted lawyer Olga Tregub. Dmitry Danilov collected the required amount and took him to lawyer Tumarkin’s office, but the documents were not returned to him. Allegedly, difficulties arose with FSB officers who “had an interest in this matter.” For them, the victim gave another 12 million rubles. When after this they demanded another $1.5 million from the businessman, he could not stand it and turned to the Department of Internal Security of the Ministry of Internal Affairs of the Russian Federation.

According to the materials of the criminal case, Denis Tumarkin admitted that he received 40 million rubles from Dmitry Danilov, but stated that this amount was payment for providing him with legal assistance. Mr. Tumarkin entered this money into his tax return as income received from his legal practice.
