| The Moscow City Court sentenced Leonid Nevzlin's lifelong sentence On Friday, the Moscow City Court sentenced Leonid Nevzlin to the lifelong conclusion of the former largest shareholder of Yukos. Everyone expected such a sentence. The fact that the guilt of Mr. Nevzlin will be recognized as fully proved and will not be manifested to it will not be evidenced by the course of his own process and all other trials in the Yukos case .
This sentence, handed out in absentia, since Mr. Nevzlin himself lives in his new homeland-in Israel, can be considered a kind of milestone in the entire "epic of Yukos"-now all former leaders and owners of the company are officially recognized as criminals. Her former head Mikhail Khodorkovsky and ex-head of MF MELETEP Platon Lebedev has been in prison, sentenced to eight years for fraud, tax evasion and failure to fulfill court decisions. Mr. Khodorkovsky, however, asked him to release him conventionally, but even if the court agrees to this, the disgraced oligarch would not come out of the prison. Together with Mr. Lebedev, he expects a second court-on charges of embezzlement of almost all of the country's oil, which was available in 1998-2004, for an amount exceeding the state budget, 450 billion rubles. And $ 7.5 billion, which they, together with the already household "unidentified persons" allegedly washed and put in their pocket.
The criminals became dozens of top managers of Yukos-someone received a long time for imprisonment, someone escaped with conditional punishment, someone fled abroad and was put on the wanted list (by the way, they managed to get political asylum in the USA and Great Britain), someone is still under investigation.
The lifelong conclusion on the two sentences of the Moscow City Court is now serving a former subordinate Mr. Nevzlin, the head of one of the internal security departments of Yukos Alexei Pichugin. He was recognized in committing a series of murders and attempts on people who paid for life and health due to the fact that in one way or another they prevented the activities of the oil company. These crimes Mr. Pichugin, as both of his sentences say and, as confirmed by the verdict of Nevzlin, made on Friday, made his boss at the direct instructions. And not only him, as it turned out. The verdict says that “other leaders of the Yukos” are probably involved in the committing of murders. This, of course, opens up new horizons for the investigation.
The political nature of the Yukos case is denied only by state power, constantly noting in official statements that the persecution of the accused is the prerogative of exclusively law enforcement agencies, and there was no and no intervention from above. Judge Novikov in the verdict Nevzlin emphasized that all allegations of the political order are unfounded: "The case was instituted and considered in the manner prescribed by the Code of Criminal Procedure." The judge regarded the decisions taken by his foreign colleagues as “unacceptable evidence”.
These, in particular, include the decision of the Federal Court of Switzerland, which refused to provide legal assistance to Russia, announcing the “political and discriminatory” persecution of former owners of Yukos. The “unacceptable evidence” was also the decision of the Supreme Court of Justice of Israel, which recognized the laws challenged by some of its citizens to the lawying of this country, and also considered the evidence base of his guilt not enough for extradition to our Prosecutor General. By the way, when Mr. Nevzlin was put on the wanted list in January 2004, it was not about murders at all, but about the theft of state property in the amount of 3 billion rubles, as well as about tax evasion in the amount of 26.7 million rubles. In the period from 1999 to 2000. In this regard, one cannot exclude the possibilities of another correspondence court over the oligarch.
When Leonid's lifelong sentence enters into legal force (and that the results of his appeal in the Supreme Court will not have to doubt it), the Prosecutor General’s Office will repeat the attempt with a request for the extradition of the convict. At least on Friday, the state prosecutor Alexander Kubnikov made a statement that "the existing agreement with Israel allows us to send a sentence to the competent authorities to this country and ask either the extradition of non -Zealin or the execution of sentence in Israel." To this, lawyer Alex Schmermling objected that the prosecutor’s office was too frivolously interpreted this agreement and it does not provide for the execution of sentences issued in other countries on the territory of Israel.
According to the state prosecutor, Currently, Mr. Nevzlin is in the United States and asked for a residence permit in this country. But to get the oligarch from there will be even less likely than from Israel. Once (it was at the end of 2006), the Prosecutor General’s Office had already addressed the US authorities with this request when Mr. Nevzlin visited the New World. But in the State Department they then diplomatically replied that there was no agreement between our states on the mutual issuance of criminals, and therefore Nevzlin can calmly come to them at any time, as he did before, without fear of being captured and sent to his former homeland.
At the same time, Leonid Nevzlin himself did not remain indifferent to the life sentence issued to him in Moscow. “The accusations are fabricated, there is no evidence base, the sentence is approved even before the start of the trial,” the statement said in the statement widespread by the press service of Mr. Nevzlin. “As in Stalin's times, the Kremlin’s goal is to destroy their opponents, condemning them on fabricated accusations for crimes that they have never committed.”
The crimes in question, according to the prosecution, were committed in 1998-2002. In particular, we are talking about the murder of the owner of the Tea store on Valentina Korneeva, the murder of the mayor of Nefteyugansk Vladimir Petukhov, the attempt on the head of Rosprom CJSC Sergey Kolesov, two assassination attempts at the manager of East Petroleum Handelskhez, Evgeny Rybin, the attempt on the former employee of Menatep Olga Kostin, the murder Tambov entrepreneur Sergei Gorin and his wife. All these bloody cases, according to the prosecution and already confirmed the Mosgorsud in the verdict, were the ideas of Nevznin, who entrusted their embodiment to Pichugin, and he - his Tambov colleague Sergei Gorin (later he himself replenished the list of victims) and six bandits of the Volgograd criminal group. As mentioned above, Alexei Pichugin, by the totality of two sentences of the Moscow City Court, was convicted of his life imprisonment. And direct performers - bandits are sentenced to terms of 7.5 to 19 years in prison.
All of them were questioned during the trial of Nevzlin. And if Pichugin still insisted both on his full innocence and the unfoundation of accusations against his former chef, then members of the Volgograd organized crime group all testified against Nevzlin, calling him the customer of murders and attempts that they carried out. In total, about 100 witnesses were interrogated in the case, and the state prosecutor was quite satisfied with their testimonies, since they, in his opinion, fully confirmed the guilt of the defendant that absent in the hall.
Lawyer Dmitry Kharitonov considered that the words of the prosecutor are just a word, they do not contain any facts and evidence of involvement in his perfect client. “Everything that the state prosecutor said does not contain evidence confirming the fault of non -Zaporin. All witnesses make assumptions or refer to the words of third parties who have now died. The fault of Nevzlin was never proved during the process, ”he said.
The court agreed with the prosecutor’s office on all points of the charge. “Given the number of victims, the court considers Nevznin dangerous to society and says to life imprisonment,” said Judge Novikov, announcing the verdict. The victims - relatives of the dead and those who were lucky enough to survive, according to the court decision, are due to solid compensation for non -pecuniary damage and material damage - a total of 5.5 million rubles, from 500 thousand to 1 million for each. It should be noted that the Moscow courts give such a high assessment to suffered suffering, as a rule, human life is estimated at 100 thousand rubles. But the matter is not at all in politics, everything is in the framework of the law. So, at least, those who are authorized to conduct criminal prosecution on behalf of this law claim.
