
The mayor of Tver Oleg Lebedev was sentenced to 1.5 years in the colony, he was found guilty under Part 3 of Art. 294 of the Criminal Code of the Russian Federation "Obviating the production of a preliminary investigation committed by a person using an official position," ITAR-TASS reports. The representative of the state prosecution, speaking in court, asked the official to appoint a punishment of imprisonment for a period of 2 years and 3 months.
At the same time, it was noted that Lebedev deserves condescension. When making a sentence, the court took into account the positive characteristics and various awards received by the mayor, as well as the fact that he has two minor children. The defense of Oleg Lebedev intends to appeal today's decision to the Supreme Court of the Russian Federation.
Recall that the criminal case against the head of Tver Lebedev was instituted in 2005 on the fact of preventing the production of a preliminary investigation, committed using an official position (part 3 of Article 294 of the Criminal Code of the Russian Federation).
Last week it was reported that at the exit meeting of the Tver Regional Court in the city of Kashin, the jurors issued a verdict in the criminal case against Oleg Lebedev. He was acquitted on charges of striking the investigator, but was found guilty that on July 25, 2005 in the building of the city administration he prevented the investigation - the seizure of documents.
“This led to a breakdown of this investigative action,” the court representative emphasized, adding that “on the same day, during the search, Lebedev gave instructions to his subordinates not to sign the protocol of investigative actions.”
According to the investigation, Lebedev prevented the conduct of investigative actions in the criminal case against his first deputy Oleg Kudryashov. In June 2005, a criminal case was opened against Kudryashov to exceed powers when resolving issues to provide a number of construction organizations of land for rent and issue various permits.
In July 2008, the court, having examined the documents submitted by the prosecutor, changed the measure of restraint previously chosen by Lebedev from the subscription about the non -residence of the detention.
In December 2005, Lebedev was removed from office for the investigation period. In March 2006, the prosecutor's office of Tver criminal case against Lebedev was terminated. However, after 2 years it was reanimated by the Deputy Prosecutor General of the Russian Federation Vladimir Malinovsky, who canceled the decision on the termination of the case.
