The court recovered from the "daughter" "Arbat Prestige" 39 million rubles

The decision of the Moscow Arbitration Court to recover from Arbat and Ko LLC (subsidiary of Arbat Prestige OJSC) in the amount of 38 million 977 thousand 144.96 rubles in favor of concern OJSC Kalina entered into legal force, Interfax reports with reference to the Kalina press service.

On September 11, 2008, the ninth arbitration court, having checked the legality and validity of the decision of the Moscow Court, decided to leave it unchanged, and the appeal of Arbat and Ko Ko LLC is disinhibited.

In the near future, the bailiff service will be instituted enforcement proceedings for the forced collection of debt from LLC Arbat and Ko.

Earlier it was reported that the Moscow Arbitration Court on June 18 granted the concern’s claim to recover from Arbat Prestige in the amount of almost 39 million rubles under an agreement for the supply of goods to the network of perfumes and cosmetics stores. Kalina filed a lawsuit in January 2008.

The Kalina concern is one of the largest Russian manufacturers of cosmetic products and personal hygiene products. The concern includes the head enterprise in Yekaterinburg, the subsidiaries of Pallada-Ukraine, LLC Glavskazy Internet, Kalina Overseas Holding BV (Netherlands), Kalina International SA (Switzerland). The concern also owns a control package of shares of the German Cosmetics manufacturer Dr.Scheller Cosmetics AG.

The Arbat Prestige company was created as a distributor of cosmetics and perfumes. The first store opened in 1998 in Moscow, after which the company was completely concentrated on retail trade. The network turnover in 2007 increased by 36.2% to $ 471.483 million.

At the end of January 2008, the owner of the Arbat Prestige network Vladimir Nekrasov was arrested . On January 30, the investigation officially incorporated Nekrasov’s charges under Article 199 of the Criminal Code of the Russian Federation - evasion of taxes or fees from organizations.

According to the investigation, "in the period from January 2005 to December 2006, by introducing knowingly false information to the tax return, Nekrasov dodged the organization’s taxes in the amount of 49 million 511 thousand rubles." The people themselves categorically do not admit their guilt.
