The antimonopoly service opened a case against Governor Tuleyev. He demands to conduct a court in his field

The Federal Antimonopoly Service of Russia opened a case against the administration of Novokuznetsk, the governor of the Kemerovo region Aman Tuleyev, the administration of the Kemerovo region, the regional departments of Rospotrebnadzor and Rostekhnadzor, as well as the Russian Ministry of Emergencies in the Kemerovo region, ITAR-TASS reports with reference to the message of the antimonopoly department.

The case was initiated on the grounds of violation of Part 1 of Art. 15, paragraph 4 of Art. 16 of the Law "On Protection of Competition" at the request of LLC "Production Company" Kuznetsk Cement Plant "(controlled by the Kazakhstan group" Caspian Resources ").

According to the FAS, signs of violations are seen in the coordinated actions of the regional authorities to eliminate the Kuznetsk Cement Plant from the market. In particular, the activities of the enterprise were suspended administratively by the territorial bodies of a number of departments after the statement of Tuleyev on July 18 on the need to close the plant.

The FAS also established, on the results of a joint audit with the Department of Economic Security of the Ministry of Internal Affairs of Russia, signs of violations of antimonopoly legislation in the actions of the administration of Novokuznetsk, the governor and the administration of the Kemerovo region, the departments of the Rospotrebnadzor and Rostekhnadzor, the Russian Ministry of Emergencies for the Kemerovo Region in the person of the department of the Novokuznetsk State Fire Supervision.

In early October, the head of the Federal Antimonopoly Service of the Russian Federation Igor Artemyev said that his department was investigating the reasons for the closure of the plant in Kuzbass. Artemyev said then that he considers insolvent the official reason for the suspension of production - environmental disorders.

The regional authorities say that the Kuznetsk Cemeted, located in the center of the largest city of the region - Novokuznetsk, has never been reconstructed over 65 years of work, and residents of nearby areas have repeatedly complained about "bad ecology" and serious exacerbations of respiratory tract diseases.

Kuzbass governor Aman Tuleyev stated that he intends to “fight to the end” for the closure of the plant, since the health of the Kuzbassers is more important than the enterprise, albeit a profitable, but working according to outdated technology.

According to the governor, scientists have established an environmental -dependent relationship between enterprise emissions and an increase in the incidence of the respiratory system. According to Rospotrebnadzor, over the past two years in Novokuznetsk, an increase in respiratory diseases has been noted from 90 to 103 cases per 10 thousand people.

“If the FAS is able to bring the case to the court to open a camzavod, I will insist that it does not pass in Moscow, 4 thousand km from Kuzbass, but in Novokuznetsk, openly, with the involvement of environmentalists, doctors, residents of the central district of the city, who are trying to refuse in constitutional law for a favorable environment for the sake of someone’s production interests,” Amanus emphasized Aman Tuleyev.

At the end of July 2008, the governor raised the question of closing the plant, and demanded materials about the identified violations to law enforcement agencies.

The Council of People's Deputies of the city of Novokuznetsk, at the initiative of the governor, considered this issue at the Extraordinary Session and appealed to the regional prosecutor with a statement on holding the leaders and owners of the Kuznetsk Cemes for violation of the environmental legislation of the Russian Federation.

In August, Rosprirodnadzor decided to fined the Kuznetsk Chemical plant for identified violations of sanitary legislation and industrial safety.

Since the end of July, the court has several times suspended the activities of the Kuznetsk Cemes of the Kuznetska due to gross violations of environmental requirements for the appeals of various departments. Now the work of the plant is also suspended by court decision (until October 24).

At the same time, the regional authorities have repeatedly proposed to the owner of the factory - the Kazakhstan company "Caspian resources" to re -profile the enterprise, transfer the plant or build a new place, outside the sanitary protection zone, in the "binding" to the new field of limestone.

In 2007, the volume of production at the Kuznetsk Tsmzavod amounted to 530 thousand tons, which is 1.5 times more than the 2006 indicator. In 2008, the plant planned to increase the release of cement to 900 thousand tons (1.7 times more than 2007), in 2009 - to overcome a millionth line.

The company "Caspian Resources" is also one of the main shareholders of the Novotroitsky cement plant in the Orenburg region, which earned about 700 thousand tons of cement in 1954 and producing per year. Novotroitsky Plant is the largest cement manufacturer in the Orenburg region and the main exporter of cement to Kazakhstan.
