The Dimitrovgrad city court received a complete cassation appeal against the court decision on the parole, Colonel Yuri Budanov. The cassation was sent by the lawyer of the victims Stanislav Markelov four days before his murder. According to Kommersant on Friday, the assistant to the chairman of the Dmitrovgrad court Polina Nikitina said that the cassation received is almost duplicated the complaint that lawyer Stanislav Markelov sent on a fax on January 15.
The first complaint was immediately registered, and her judge Alexander Dubov, who made a decision on Udo Yuri Budanov, returned the lawyer without accepting her to consider. "I am returning to you a cassation appeal against the decision of our court, since by the current legislation the appeal of a court decision made by the victim or its representative, made by the results of the consideration of the application for UDO, is not provided," the accompanying note said.
Nikitina explained that the entire legal procedure was followed by the cassation appeal adopted by fax on January 15, therefore, according to the original, the full cassation appeal received by mail on January 22, there would be no new decision. “The question is simply being resolved now in whose name to return the complaint, since the lawyer sent her lawyer was killed on January 19,” she said. “Either she was returned without consideration to the institute of the rule of law, which was led by Mr. Markelov, or simply hesitate to the UDO.”
Meanwhile, it is known that Stanislav Markelov sent another complaint - about the actions of the judge of Dubov, which he considers illegal. He spoke about this on January 15, and also reported at a press conference on the day of his death. However, in the Dimitrovgrad city court, and in the Ulyanovsk Regional Court they said that they did not receive complaints. Konstantin Dolinin, head of the federal postal service department, said that according to the standards of the Russian Post, the maximum time for delivery of correspondence from Moscow to Ulyanovsk is five days. He could not be explained why the cassation appeal was going on and why a complaint against the judge of Dubov has not been received, he could not.
The Ulyanovsk Regional Court refused to inform how legitimate the actions of Dubov, who did not accept the cassation appeal and who would consider the lawyer’s complaint against the judge. To the previous request, Deputy Chairman of the Regional Court, Alexei Shamov, said that "there was no Cassation Company from the lawyer Markelov to the judicial board of criminal cases of a cassation appeal," as "there was no complaint about the actions of the Dubov judge." The regional court spokeswoman Lydia Burch explained that "this is all that the deputy chairman of the court considered it necessary to answer the request, and there will be nothing more."
