Zhirinovsky notes that the person who wrote a racist slogan may be responsible for this article. “Although no one could read the slogan, and he did not belong to a certain face, and no one was excited by hatred or hostility,” the deputy explains.
In his opinion, the intention of acts is necessary for the application of punishment under this article, but it is impossible to take this principle in article 282, since then it will be necessary to connect such concepts as “criminal”, “criminal behavior” - on the one hand and “nationality”, “ethnicity”, “religious affiliation” - on the other. ”
Zhirinovsky insists on the exclusion of this norm from the Criminal Code, since "the crime must be qualified according to the result of the act, and not by the goal," he said. In his opinion, similar changes in the exclusion of Article 282 should also be made to the Code of Criminal Procedure.
