
Russia lost in the European Court of Human Rights (ECHR) in Strasbourg the next three claims filed by the inhabitants of Chechnya. They accuse the Russian authorities of the disappearance and murder of their relatives. Now Russia must pay the plaintiffs tens of thousands of euros as compensation for moral damage, RIA Novosti reports with reference to the court decisions.
The victims turned to the Russian justice bodies, however, according to them, local authorities could not properly investigate the circumstances of the disappearance of their relatives.
So, 11 relatives Lychi Basayev and Lemma Dikaev said that on July 6, 2002, armed people in camouflage were taken away. According to the court decision, Russia must pay each of the plaintiffs from 900 to 35 thousand euros for moral damage, as well as 12 thousand euros for compensation for legal costs, the decree said.
The victims in the second case - the spouse and son of a resident of the Chechen Republic of Khava Magomadova - said that the woman went missing on December 16, 2002 on the way to work. The court decided to pay each of the relatives of a woman 5 thousand euros for moral damage, as well as 4.5 thousand euros for compensation for legal costs.
The complaint in the third case was filed by 10 relatives of Muslim Nenkaev, who disappeared in Chechnya, who disappeared after he had led a group of armed people in camouflage on June 8, 2002. Each of them, according to the court decision, should be paid from 750 to 20 thousand euros for moral damage, as well as 6.65 thousand euros for compensation for legal costs.
The court studied the circumstances of the three cases and ruled that Russia violated a number of articles of the European Convention on the Protection of Human Rights and Fundamental Freedoms.
In particular, Article 2 (the right to life and an effective investigation of the circumstances of the death), Article 3 (prohibition of torture, inhuman and humiliating appeal), Article 5 (right to freedom and personal integrity) and article 13 (the right to an effective means of legal protection) were violated.
The decision of the Chamber of the Court will enter into force if the parties do not apply for three months with a request to transfer the case to the Great Chamber of the Court, which, in turn, can reject the appeal.
