The general director of the Basmann market was accused of the death of 68 people

The Investigative Committee at the prosecutor’s office of the Russian Federation charged Mark Mishiev, the general director of the Basmann market, as a result of the collapse of which 68 people were killed in February 2006, Interfax reports.

The market manager is charged with the articles of the Criminal Code of the Russian Federation "Causing death by negligence" and "Causing grievous bodily harm by negligence."

"It was established that Mishiev from 2002 to 2006, due to improper performance of his professional duties, did not take measures to organize the proper operation of the Basmann market building. He did not organize the development, maintenance and compliance of the documentation necessary for the safe operation of the market, and also did not monitor the state of the building," said the official representative of the SCP of the Russian Federation Vladimir Markin.

In addition, as the investigation believes, the market general director “did not take measures to properly repair and eliminate unauthorized buildings, allowed the uneven and uncontrolled overload of the floor floor, which led to the collapse of the market building on February 23, 2006, as a result of which 68 people were killed, 9 people were injured in various severity.”

During the investigation, more than 10 inspections of the scene were carried out with the involvement of specialists of the Department of Urban Planning, Development and Reconstruction of the Moscow Government, Inspectorate of State Architectural Supervision, Moskomarchitecture, Mosgosexpertiza and others, Markin explained. According to him, in the course of the necessary examinations, special equipment was used.

"At present, a preventive measure in the form of a non -departure subscription has been chosen in relation to Mishiev. Investigative actions are carried out aimed at completing the investigation of the criminal case," the representative of the SCP emphasized.

Chronicle of the collapse of the basman market

Recall that the disaster in the Basmann market occurred early in the morning of February 23, 2006. The roof of the building in the form of a huge coupol concave inside, supported by a system of cables, suddenly collapsed without any external influence. Several dozen people were buried under the debris. According to official figures, 68 of them were killed - mainly citizens of Azerbaijan, Georgia, Tajikistan, Uzbekistan and three Russians - 39 more were crippled.

The possibility of a terrorist attack, representatives of the special services who worked at the site of the emergency rejected almost immediately, since experts did not find traces of explosives. As a result, the versions of errors in the design of the building, violations during its construction and subsequent operation were put forward as the main ones, because of which the roof could not withstand the mass of accumulated snow.

One of the main alleged perpetrators of the tragedy was named Mark Mishiev. Two days after the emergency, the Moscow prosecutor’s office charged him of causing death by negligence, and Zamoskvoretsky District Court granted the application of the investigation, issuing a sanction to his arrest. Mishiev’s lawyer Alexander Alitovskaya immediately called such claims of the prosecutor's office unlawful, since, in her opinion, the reason for the destruction of the building should be sought in another. As a result, the first court decision on the arrest of Mishiev was canceled by the Moscow City Court.

The case was aimed at a new consideration, and on March 7, 2006 by the decision of another judge, the accused was released on a recognizance not to leave. In June 2008, the UPC stopped the criminal prosecution of the only accused in the case of the collapse of the building.
