
On the website of the Ministry of Justice, a draft amendments to the law “On the Constitutional Court” was published. The bill proposes to increase the threefold (from three to nine months) the maximum term for the execution of decisions of the Constitutional Court (CS), writes Vedomosti. From a month to two, it is proposed to increase the time of the government agencies to the KS requests for the provision of documents, the give of explanations or the attraction of experts. The draft amendments was developed by the Ministry of Justice on behalf of the government of the country.
The representative of the government in the Constitutional Court Mikhail Barschevsky said that the amendments will establish a situation that actually already exists. According to him, the KS decisions often require a systematic change in legislation, and therefore it takes 8-9 months to prepare and coordinate projects. It was not possible to find out the opinion of the KS about the new initiative of the government - all the judges are on vacation, the representative of the court said.
The publication notes that the State Duma deputies do not adopt all the bills that follow from the KS decisions. So, out of 31 projects, only 10 included in the summons of the spring session of the lower house, and only five deputies accepted. The decision of the Constitutional Court to create a mechanism for compensation for harm caused by illegal actions of the judiciary has not been carried out since 2001, the newspaper notes.
