Who will pay for Yukos

- The constant chamber of the arbitration court in the Hague considered that the Government of the Russian Federation, according to the energy charter, could become the defendant in the lawsuit of the shareholders of the Yukos. How does this threaten Russia?

- It seems that this is one of the first steps to recognize the requirements of the Yukos minorityites legal. Now imagine what will happen if the final decision of the court will be in favor of Yukos. Russia will be raised by hundreds of billions of dollars.

- So what? I remember that the Swiss company Noga somehow tried to recover money from Russia, the bailiffs even tried to arrest the Sedov aircraft and sailboat owned by it. The result was zero.

- So zero! And the fact that the requirements of bank banks in this case were satisfied? How do you order to understand?

- Let's get back to Yukos. So, who can suffer if the court recognizes the requirements of the minorityites legal?

- All business entities, in the capital of which there are traces of state investments. Including the so -called state corporations and monopolists - Rostekhnology, Rusnano, Gazprom, MPS and others. Plus companies with state participation. For example, Rosneft. And even completely private, but received certain state resources to the management - loans, grants and the like. It is necessary to prepare for the fact that all foreign assets of these companies can be arrested. But that's not all. Foreign companies will also be under the blow, in the capital of which there are any traces of the Russian state or its officials, including their relatives "up to the seventh knee." Well, for example, those foreign companies that participated in operations with Russian public excuses or in the purchase of American securities in the interests of the Russian state.

- That is, in fact, we, conscientious taxpayers, pay for the illegal actions of the authorities in the relations of Yukos? Unless, of course, they are recognized as illegal.

- No, the funds in the national currency received from the collection of taxes from the population are outside the jurisdiction of foreign courts. I repeat, those who have movable and immovable foreign assets will pay directly. This decision can hurt, first of all, all the acting and former members of the government, employees of law enforcement agencies, all sorts of deputies-semi, members of their families and their relatives. All their foreign assets (not only accounts in banks, but also, for example, villas on the Cote d'Azur and Lake Tahoe in California) can be recovered to repay the losses of Yukos shareholders.

But I need to read the text of the court decision very carefully. Then it will become clear, for example, whether, for example, the accounts of the Central Bank or the largest domestic banks with "state participation", including the previous "Councils", or personal accounts of Russian deputies, will arrest. We will wait until January next year, it turns out there.

- It's good that you warned officials. They have time to protect their money and real estate until the decision has been made.

- Only let them not expect that they can be saved in Asian banks, which allegedly do not go to cooperation with the West, when it comes to confiscation on the decisions of Western ships. I would remind two circumstances in this regard. First. After the murder in the Emirates of Yandarbiev, it is not necessary to count on loyalty to Russia from the same Arab countries. The second circumstance concerns China. Let me remind you that the Banco Delta Asia, prescribed in Macau, was accused by the American Ministry of Finance of caring corruption operations and for more than 20 years provided services to North Korean companies and state bodies. So, the Americans managed to get these dirty money!

- Nevertheless, today the Russian authorities still have time and chances of protecting their positions even with the most unfavorable court decision. Do you think they will not miss this chance?

- The decision was made by the Hague Court, therefore, while it is advisory in nature. This means that the Russian government will have time both to challenge it directly, and in order to continue the dispute within other trials. I repeat, the authorities have time to think. The question is what they will decide. From the point of view of domestic super-yuerists (from the Kremlin), for some reason all similar court decisions are considered only as evil attacks of the arches of the enemies of "sovereign democracy." And it is impossible to convince them of the opposite. But in this case, this signal, like a number of previous ones, will not be perceived, the time to prepare civilized legal protection will be lost. So, the January court decisions of the Strasbourg court can become even more crushing - I recall that the lawsuit of the Yukosovites will be considered there. It is possible that Strasbourg will not be the last instance.
