The court overturned the decision of the Moscow Arbitration Court, which provided for the recovery of more than 325 million rubles from Gazprombank in favor of the hospital, whose patient vouchers were used to purchase the lost shares. Let us recall that back in 1994, the then head physician of the psychiatric hospital, Valery Babanov, bought Gazprom shares with the vouchers of 555 patients and put these shares in one account, which he opened with Corona Plus in his name. In 1997, a total of about 7.5 million Gazprom securities were stolen from the depository, including Babanov’s stake, which was the largest.

In 2001, Babanov resigned (according to other sources, he was fired) from the hospital. Three years later, a Tver court found two employees of Korona Plus guilty of theft of shares, but also blamed Gazprombank for the incident. According to the court, Gazprombank, which is the depositary of Gazprom and which entered into an agreement with the depository, did not ensure proper control of its activities.

In 2007, the hospital, to which Babanov transferred the rights to the shares, filed a lawsuit against Gazprombank. The financial organization, in turn, tried to challenge the agreement under which Babanov transferred the rights to shares to a medical institution, where by that time he no longer worked. In March 2009, the Moscow Arbitration Court upheld the claim of Gazprombank, invalidating the agreement on the transfer of rights to the hospital. However, the court indicated that the hospital could claim damages without any agreement with the former chief physician, since all rights to the shares still belong to the patients, and the hospital is considered their guardian and legal representative. Meanwhile, a representative of Gazprombank noted in court that of those patients whose vouchers were used to buy shares that subsequently disappeared, only 14 remained treated in the hospital.
