Last week, the court reviewed the sentence of the anti-fascist from Vladivostok Yuri Mishutkin.

Two years ago, he was attacked by ultra-rightists, as a result of which two of the attackers were injured. One is fatal. On October 12, 2009, Yuri was found guilty under Art. 108 part 1 (murder in excess of self-defense) and sentenced to a year of probation with a two-year probationary period. But in March of this year, the court's decision was reviewed.

The anti-fascist was attacked by Aleksey Plyasov and Ilya Muzychenko. Both are known in right-wing circles. Mishutkin is a member of the anarchist movement Autonomous Action. This was the third attack on him. The first time "ideological rivals" attacked him and his comrades in 2006, then Mishutkin received a concussion. The attackers were allegedly detained, but the case was closed due to lack of evidence.

In 2007, Yuri Mishutkin went to an environmental camp near Angarsk. Neo-Nazis attacked the camp at night. They beat me with iron rods and clubs. Anarchist from Nakhodka Ilya Borodaenko died in the hospital. Mishutkin spent a month in the hospital - his spleen was removed.

Since then, Mishutkin carried a knife with him everywhere - just in case. The case did not keep itself waiting November 22, 2008 Yuri was returning from work. Several football fans were on the same bus with him. They recognized the anti-fascist - two people got off at the bus stop. It was about ten in the evening - Mishutkin tried to go to the illuminated part of the road, but it did not help. Muzychenko was the first to attack - Mishutkin wounded him. The second attacker, Aleksey Plyasov, was hit in the heart and died on the spot. Muzychenko rushed to run - he jumped off the parapet and broke both legs.

Everything that happened was captured on a surveillance camera. It was these shootings that became the main evidence of the investigation: at first the case was initiated under the article "Premeditated murder", but then it was reclassified as "Exceeding the limits of necessary defense." The video shows: two people alternately attack Mishutkin. He fights back. The collision lasts 7 seconds. After that, Yuri - in the case file there is a printout from a mobile phone - dialed the number of the ambulance, then the police.

However, according to the defense of the victims, Mishutkin was the first to start the conflict, while still on the bus. True, it remains unclear if Mishutkin is a criminal, why he called and waited for the police (they were gone for 40 minutes), why he didn’t hide or “throw off” the knife?

In the process of reviewing the verdict, the version of the victims changed again. Now they have stated that Ilya Muzychenko was a participant in the first attack on Mishutkin, in 2006. On the bus, Mishutkin noticed the offender and decided to take revenge. And Alexey Plyasov allegedly became an accidental victim.

On March 4, the court considered Mishutkin's intentions to attack Muzychenko proved, and an article was "added" to the sentence - "Attempt to commit a crime", article 30 part 3. The sentence under both articles was one and a half years of probation with a two-year probationary period. In addition, the court ordered Mishutkin to compensate the moral damage to the family of the deceased Plyasov in the amount of almost 1.5 million rubles.
Lawyers for the victims have already announced that they will appeal the court's decision and demand more severe punishment for the anti-fascist.
