In the Lyubertsy near Moscow, a scandalous criminal case has been stretching for a year and a half, on which the programmer and stuntman Mosfilm is taking place. A decision has already been made on a secondary consideration of the case, the newspaper Komsomolskaya Pravda writes. True, everything will be held to go through a new process in the same Lyubertsy court and under the leadership of the same servants of Themis, who condemned Boris Praud.

“I’ve been fighting for my son for a year and a half - I learned all these treasury papers by heart,” Elena says tiredly, clutching a bag with a chubby pile of letters from prosecutors, police and ships. “Borya was taken to the pre -trial detention center in November 2008. There he is to this day.”

The woman is supported by Borina Bride Olga Ursalova and his friends - Alexei Monakhov and Ekaterina Vishnyakova. In the summer of 2009, Alexei and Catherine planned to get married, and they offered their friends to be witnesses.

“We called them (Borya and Olya) to visit the wedding,” says Ekaterina Vishnyakova. However, the guests sat up late and decided to stay in the Lyubertsy. At almost two in the morning, both couples went to the store.

"Borya has not been drinking for a long time, but I thought to buy a bottle of beer," says Alexey.

10 hooligans with a bat and knife

At the "nightlight" with the name "Russian style" at this time, youth walked noisily. These were not teenagers, but ten adult young men. The company noted the departure of one of them into the army. When the alcohol ended, the young people went to the box office behind the "catch -up".

Inside the store, local and clung to strangers.

“One asked me what kind of football team I am rooting for,” recalls Alexei Monakhov. “I replied that I was not interested in football. Then he climbed my Katya with obscene jokes.”

Alexei stood in front of Crubian and asked him to apologize, but in response he received a blow in the face. A fight began, which the rest of the company instantly intervened. The hooligans pushed Alexei out into the street, dropped him to the ground, and then they began to kick the five.

One even took out a baseball bat, after which Alexei thought: "Now they will kill." The next moment, he raised his head a little and saw one of the young men hit Katya's foot in his stomach.

“It was Alexei Zakharov,” Catherine inserts. “I only knew him from the crowd - he studied with me at a school in Lyubertsy. And even then he got everyone: for example, he took his hat a couple of times and, excuse me, urinated him in it.”

Alexei tried to get to his feet, but immediately felt pain. “The sensation, as if the air began to come out of the back,” the victim continues. “The smallest of the“ fighters ”hit with a knife - Ilya Mazhirin, I then identified him at a full -time headquarters.” Immediately after that, Alexei Monakhov lost consciousness, and woke up from the fact that someone was lying on him.

It turns out that Katya tried to close the young man with her body. The girl rushed at him and covered her head with her hands so that they would not be killed. As a result, all the blows sprinkled onto the intercessor. Then, in the emergency room, she stated a concussion and a fracture of the bone of the leg.

At the same time, the rest of the company beat Boris, who ran out to the aid of friends. A few blows and Ole, who tried in vain to stop the fight.

By some miracle, Boris managed to knock the knife out of the hand of one of the attackers. Immediately after that, he picked up the blade from the ground and began to dismiss it from angry opponents. Only after that the hooligans retreated, although their enemy was wounded by a knife in the side.

Note that both beaten young people were in good sports. Alexey from school is engaged in heavy athletics, and Boris, despite the "non -portable" profession of a programmer, also a cascader "Mosfilm". Police sabotage

The victims called the ambulance only by reaching the house. By that time, Alexei had lost a lot of blood and completely weakened, so he was carried out on a stretcher. And at the entrance, the same company, longing for revenge, was already crowded.

Olya called the police during a fight. However, the outfit appeared near their house only now, that is, an hour later. And this despite the fact that the local ATS is on the next street and go to the guards for only a couple of minutes.

Boris later told his mother how the testimonies were “shaken out” from him: they say that he specially cuts through three attackers and his friends; They even lied that Alexei Monakhov died.

Boris did not stipulate himself, and in order to confirm his innocence, he wrote a statement demanding to remove the shooting from video surveillance cameras installed at the store. But this video was never attached to the matter - it just disappeared.

The programmer also asked for an examination for alcohol to prove that during the fight he was absolutely sober. But Boris was refused again.

“And this is not all violations in the investigation,” says the prisoner’s mother. “They still haven’t found a knife and bit.” And criminal cases of attack on Katya and Alexei were refused to open it in general! "

Now, when cases are initiated, investigators are in no hurry to look for the guilty. Although they do not need to be sought, since they are listed in the victims.

Gave 6, but the prosecutor asked for all 8

At the beginning of April 2009, Boris Praud under the escort was brought to the Lyubertsy court. They appeared at the first meeting and all the victims at the hands of a brave programmer: Ilya Mazhirin, Evgeny Krasnov and Ilya Martemyanov. All of them felt great, although, judging by the certificates, the injuries of two of them were heavy - the wounds of the chest and the abdominal cavity. The remaining participants in the company witnessed and assured that the tributary was to blame for everything: he attacked with a knife and wanted to kill.

Boris was accused under Article 111 of the Criminal Code of the Russian Federation (intentional infliction of serious harm to health that is dangerous to human life). The prosecutor asked the defendant for eight years of imprisonment. Moreover, self-defense was not even mentioned: according to investigators, Boris specially came to Lyubertsy at night with his beloved girl to cut a couple of local unemployed guys. However, the judge then still did not dare to pass the verdict and sent the case for an additional investigation, the newspaper writes.

At the next meetings, "victims" have already refused to come voluntarily. They also did not want to communicate with reporters.

And in September, the Lyubertsy city court sentenced Boris to six years in prison in a maximum security colony.

Only before the New Year did the Mosolates nevertheless canceled this scandalous and unjust sentence "in connection with the violations committed during the judicial investigation" and sent a fabricated case for a new consideration. The other day it took place: a collegium of three Lyubertsy judges remained with the previous opinion on the punishment of Boris Praudok, confirming the same verdict of the 6-year period in a maximum security colony.

However, Elena Preduk intends to continue to achieve the truth.

Circular guarantee

Independent lawyers make a definite conclusion: Boris’s act can only be qualified as self -defense. “This is confirmed by the wound of his friends and the fact that the attackers had weapons,” says Oleg Smirnov, an employee of the Avez Just lawyer lawyer. “Moreover, there were three times more.”

In addition, the attackers did not deny that they were drunk, and therefore could not adequately assess the situation. The fact of alcohol is recorded in the investigation documents.

Meanwhile, Elena Percules came the long -awaited response from the Prosecutor General’s Office to her complaints against Lyubertsy law enforcement agencies. She was informed that several violations were identified and corrected in the work of local investigators. So, for example, things will be initiated on theft of Boris’s theft of a jacket, a mobile phone (they were taken by hooligans during a fight) and on the fact of beating Ekaterina Vishnyakova.

The investigation in the Boris case is renewed again. However, nothing has changed for Boris yet. The programmer is still in jail, where he lost 30 kilograms in a year and a half. But he believes that he will soon be free. True, the same people as before, and the verdict will be carried out in the same Lyubertsy court.
