The fire that they were waiting

On May 18, Russian Prime Minister Vladimir Putin spoke at the General Assembly of the Russian Academy of Sciences. The head of government touched on the topics of the topic topical for the Academy of Sciences - financing of the Russian Academy of Sciences, the construction of housing on its lands, and the effectiveness of research. While the academic elite and VIPs resolved these fateful issues, less than a kilometer from the building of the Presidium of the Russian Academy of Sciences was another academic life-they extinguished the fire in the Laboratory Corps “Module”, which was on the balance of the Institute of Chemical Physics (their). N.N. Semenova RAS. Several fire brigades, special equipment and ambulance carriages arrived in the fight against fire. Such a large -scale exit was not accidental. Around - residential buildings, and under the "module" there is a warehouse with chemicals.

Even if the fire occurred by negligence, the very fact of its occurrence is logical. The “module” and the warehouse premises are prevented from starting the construction of an elite housing complex. And at the same time are federal property. Experience shows that fires often arise precisely in buildings, in the place of which they want to build something. If they cannot be demolished in a legal way, the fire greatly facilitates and accelerates the process of getting rid of interfering real estate. This happened, for example, with the dacha Muromtsev in Tsaritsyno, who burned in January 2010. Her final demolition two months later was presented as the removal of construction waste remaining after a fire.

The demolition of the "module" also arose problems. Construction here has long been wanted to start the HIS RAS and Su-155 CJSC (about this and other construction sites on the lands of the Russian Academy of Sciences were described in detail in the article “Academic Vacation of the Earth” (TRV No. 6 (50) of March 30, 2010). True only the lack of necessary documents. True, few would have paid attention to this if it weren’t for local residents who have been complaining about any illegal work and do not want to put up with violations.

Then they tried to get a demolition of demolition through the court. Obtaining a court decision is a long -developed technology that facilitates the transfer of property from hand to hand and gives “good” to certain actions. In the fall of 2009, Su-155 CJSC filed a lawsuit against the NAS RAS on the obligation of the latter to transfer the land plot with all the buildings on it (among them not only the “module”, but also two more buildings) in order to demolish them and further construction at this place of a residential building. The lawsuit was satisfied, but partially. The court ordered the construction site in the form of a land plot, but the requirement to demolish buildings was rejected.

The position of RAS, which acted in it as a third party, looked very strange in this trial. It would seem that RAS, along with the Federal Property Management Agency, was supposed to defend the institution subordinate to it, protecting academic real estate from demolition. But, as follows from the text of the decision, the RAS at the hearing did not object to the stated requirements, i.e. In fact, she supported Su-155 CJSC in her intention to demolish federal property.

The refusal of the court did not embarrass CJSC Su-155. In February, internal partitions were dismantled in the Module, it came to the roof. Seeing the bare building, the inhabitants complained about work without permits. Demolition was suspended, and the territorial department of the Federal Property Management Agency in Moscow organized a verification of the actual use of the object.

It turned out that in February 2008, “in order to increase the efficiency of the use of federal property”, “Module” was transferred from the balance of the Institute of Biochemical Physics (IBHF) named after N.M. Emmanuel RAS on the balance of the HIS RAS [1]. Institutes were supposed to transfer documents to make appropriate changes to the register of federal property, but for some reason they did not do this. The laboratory building is still listed in the register for the IBHF RAS.

Here it is impossible not to recall that in October 2008 the order of the Presidium of the Russian Academy of Sciences was published [2], in which the Office of the Russian Academy of Sciences K.A. Solntsev was instructed to take measures to control the investment agreements of institutions and RAS organizations, and to the attention of the heads of institutions and organizations of the Russian Academy of Sciences, it was held that they were personally responsible for the timely and full submission of information about federal real estate for the introduction of federal property assigned to the I wounds of the Russian Academy of Sciences. About whether the director of the HISF RAS A.A. Berlin is unknown to any responsibility for failure to submit information about the “module”. But back to the story of the fire. It was long predicted by local residents, the question was only in terms. After builders appeared on the site in October 2008, two fires occurred there. Once the change house completely burned out, another time the fire happened in the warehouse during the builders of welding. A gross violation of fire safety rules could lead to more serious consequences. For example, in December 2008, builders illegally installed the gate, blocking the firefighter to the buildings of several institutes of the Russian Academy of Sciences at once. These gates were dismantled at the request of the inhabitants only a few months later. And in March 2009, just on the day when the second fire occurred, the entrance to the “Module”, in which the scientists were still working, was completely blocked by concrete blocks. Neither ambulance nor firefighters would drive there.

Let's try to summarize. In the "module", the wear of which is only 20%, last year scientific laboratories were located, and scientific activity was conducted. But it turned out to be neither the Sun Railways, whose main goal is to organize and conduct scientific research, nor the NIF RAS, which positions itself as one of the widely known scientific centers in the world. By the way, one of the areas of the work of the institute is the processes of combustion and explosion.

Act of verification. Conclusions

As a result of an audit of real estate located at: Moscow, Leninsky prospect, 38, bldg. 11, the following was established:

The verified object is federal property, is on the balance of the institution of the Russian Academy of Sciences "Institute of Chemical Physics named after N.N. Semenova ”(ICF) (institution 2) and is assigned to him on the basis of operational management.

Changes to the register of federal property, in connection with the transfer of the object to institution 2, have not been made.

State registration of operational management right to the facility was not carried out. The ownership of the Russian Federation to the object is registered.

By the decision of December 25, 2009 in the case of A40-106409/09-113-835, the Moscow Arbitration Court ordered the institution 2 to fulfill the obligations under the investment contract, namely, to transfer the construction site in the form of a land plot with the real estate, and namely, non-residential buildings at the address: Moscow, Moscow, Moscow, Moscow, Moscow. Leninsky prospect, 38, p. 9, p. 10, p. 11, in order to carry out the construction of a residential building for the construction period and until its completion.

At the same time, the court believes that the requirements in the wording, as set out by the plaintiff, namely, “in order to carry out the demolition of buildings” are not subject to satisfaction.

At the time of verification, the object was not used, CJSC Su No. 155 carried out a partial disassembly of the roof and internal partitions of the building.

The refusal of the court in the demolition of the “module” to all the actors-CJSC “SU-155”, the HIS RAS, the leadership of the Russian Academy of Sciences, the Federal Property Management Agency-was obviously known. There are no permits for its demolition, but the work was carried out. Therefore, we can assume that the burned “module” will cause much less unpleasant questions than now. The fire on May 18 managed to put out. But in the summer, the cause of the fire can easily become even a cigarette butt thrown by someone. It will probably be to blame for what is happening with the property of the Russian Academy of Sciences. Or, on the contrary, will increase the effectiveness of scientific research and accelerate the construction of housing for young scientists ...
