The Federation Council adopted amendments to the Law on the Protection of Rights Rights

The Council of the Federation of the Russian Federation introduced at the meeting on Wednesday the amendments to the law "On state registration of rights to real estate and transactions with it" and a number of legislative acts of the Russian Federation aimed at protecting the rights of participants in shared construction, RIA Novosti reports.

According to the new version of the law, citizens can attract funds for the purchase of housing in apartment buildings not commissioned, only on the basis of a contract for participation in shared construction.

In addition, a legal entity that has a land plot in the ownership or submarine and a permit for the construction of an apartment building has the right to produce a special type - housing certificates.

Housing and housing accumulative cooperatives in accordance with the laws that regulate their activities will also be able to accept the funds of citizens.

The document also establishes administrative responsibility for the collection of money from citizens for the construction of apartment buildings with persons who do not have the right to do so. For officials, a fine is proposed to be set in the amount of 20 thousand to 50 thousand rubles, for legal - from 500 thousand to a million rubles.

The services of the developer will be exempted from the VAT within the framework of the contract for participation in shared construction, with the exception of the services of the developer during the construction of industrial facilities. The introduction of this norm, according to the authors, will create favorable conditions for the development of the primary housing market, motivating developers to work in the established form of the shared participation agreement, and eliminate the reasons for the use of alternative agreements that do not fall under VA.
