Candidate of Medical Sciences Emmanuel Lvovich Gushansky - a psychiatrist with more than half a century of experience. In addition to the actual medical work of the psychiatrist, he was a forensic medical expert and chairman of the forensic psychiatric commission in the Moscow Psychiatric Hospital for many years. Kashchenko (now - named after N.A. Alekseev). From 1976 to 2002, Dr. Gushansky held a responsible administrative post, being deputy chief physician of the Moscow neuropsychiatric dispensary N 21.

He continues his work as an expert and now in the Bureau of Independent Examination “Version”. There was no parents at home, and the grandmother saw everything, began to scream, matuing, threatened to tell her parents, call the police; Then, opening, she went to the kitchen to drink morning coffee. In court, she consistently defended her interests, said that she did not consider herself a mentally ill, talked about the “intrigues” of her granddaughter, who did not take care of her, and “pushed” to the apartment.

Six months after the preparation of the gift and scandal with a granddaughter, who could not come to terms with the inability to become the owner of the apartment after the death of her grandmother, NN ambulance was hospitalized in the psychosomatic department of the hospital, where she was diagnosed with “vascular confusion”, and then “vascular psychosis” and “dementia”. I stayed in the NN hospital for a week. Forensic psychiatric examination underwent the diagnosis of dementia established in the hospital six months after the transaction for the period of conclusion of the gift agreement and considered that NN could not understand the meaning of its actions and lead them. The judicial conflict is a clash of individualized social attitudes of its participants:

The children of the soul did not tea in him - he loved to play with them, it was fun and easy with him. If the children were sick or experienced difficulties in studying, he preferred to leave home.

In recent years, he has been at home only occasionally-not because of the mistresses, but because he spent almost all his time in the casino and the gym of slot machines, where he won and lost large amounts, and then either spent time with friends and prostitutes in expensive restaurants, or looked for the opportunity to find money to pay debts-you won’t pay-they will kill. Mom found him a wife who showed a servility towards his parents, was immensely glad that they bought and equipped an apartment for them, but did not understand him, and in bed involuntarily showed some annoying activity that caused him irritation. He wanted him to love him not for something, but simply for the fact of existence, demanded absolute devotion, understood that it was not feasible and secretly from everyone wrote poems that

It turned out that family affairs prevented his brother on this day to meet with one of his “friends” and he asked LL to meet her and offer to spend the night in a rented apartment in order to spend time with her the next day. At the meeting, her brother’s mistress looked curiously at LL, willingly agreed to go with him to a rented apartment and asked to stay overnight.

In the morning, during a joint breakfast with LL, perceived a glass of cognac, she inquired whether he was always so bad in bed and asked why he "climbs if he could not." It was intolerable. They fought, he was thrown into a corner, blood flowed from his nose.

Then they reconciled, he removed the dishes from the table, she began to whimmer in front of a manual mirror. His mother did not let him into school, because She believed that teachers are also influenced by her father. He talked with the guys in the courtyard, was distinguished by evil, resentment, and dummy. Будучи на индивидуальном обучении, он закончил 6 классов и больше не учился, общался с «антисоциальными подростками», совершал кражи, поджоги; в 19-летнем возрасте был привлечен к уголовной ответственности за изготовление взрывного устройства из 2-х мин и подрыв его в подвале магазина.

Во время следствия он заявлял, что совершил преступление потому, что его сглазил и заколдовал отец. На основании судебно-психиатрической экспертизы суд признал его невменяемым и направил на принудительное лечении, длившееся 2 года в специализированную психиатрическую больницу.

В больнице он о колдовстве, «сглазе» и динозаврах не говорил, при расспросах относил эти высказывания к фантазиям, присущим ему с детства, проявлял жестокость, агрессивность, пытался убежать, затевал «возню» и драки с больными, воровал продукты, пытался задушить беспомощного больного, вину за свои поступки пытался переложить на других больных.

После лечения он стал более спокойным, соблюдал установленный режим, после снятия принудлечения работал грузчиком, сдавал цветной металл.

Через 7 лет после первого правонарушения К. был привлечен к уголовной ответственности за попытку вступить в извращенные сексуальные отношения с подростками, вновь был признан невменяемым, во время экспертизы и в первые несколько дней пребывания в больнице на принудительном лечении связывал правонарушение с колдовством отца, который «насылал на него «порчу», и пугающих его «динозавров». В последующем, свыкнувшись с больничной обстановкой, он перестал говорить о колдовстве, динозаврах и драконах, говорил, что эти идеи ему с детства «внушала мать», выдвигал свою защитную версию, принимал лекарства и соблюдал больничный режим.

После выписки из ПБ он признавался инвалидом 2 группы, эпизодически выполнял неквалифицированную работу. Психоневрологический диспансер он посещал неохотно, уклонялся от контакта с врачом, ожидая приема, сидел в углу, согнувшись, что-то бормоча и оживляясь лишь при встрече со знакомыми, отбывавшими вместе с ним принудлечение.

После смерти матери он стал единоличным владельцем двухкомнатной квартиры, в которую изредка приводил собутыльников и женщин, по сведениям участковой медсестры ПНД «всегда разных». Врачи ПНД в течение многих лет не описывали у него каких-либо бредовых идей и фантазий, связанных с «колдовством» и воздействием на его мысли и желания отца.

После оформления права собственности, он принял решение продать свою 2-х комнатную квартиру, купить однокомнатную и оставшиеся деньги вложить в строительство домов. Перспектива выйти из унизительной нищеты и разбогатеть сделала его активным, собранным, целенаправленным. Участвовавшие в сделке лица не сомневались в его дееспособности, отмечали его сметливость, активность, сообразительность, и даже полагали, что К. имеет юридическое образование. Через 2 года после продажи квартиры наступил кризис, вкладывать деньги в недостроенные дома оказалось невыгодным, а цена на квартиры возросла.

В связи с этим он написал заявление о признании недействительной сделки по купле-продаже его 2-х комнатной квартиры, ссылаясь на то, что действовал под колдовским влиянием отца и насылаемых им драконов и динозавров. Судебно-психиатрические эксперты признали его душевнобольным, не понимавшим значение своих действий во время совершения сделки, т.е. приняли его версию о бредовых мотивах сделки. Версия об использовании детских фантазий для достижения своих целей экспертами не рассматривалась.

Во время экспертизы он был «вялым», сидел, опустив голову, говорил невнятно, утверждал, что продал квартиру лишь для того, чтобы избавиться от колдовства отца и становился озлобленным и собранным лишь тогда, когда высказывались сомнения в правдивости его высказываний. На суде он сидел, согнувшись и что-то беззвучно бормотал, но при расспросах о происшедшем говорил последовательно и убежденно, отстаивая свою версию о «сглазе» и «воздействии» на него посланных отцом динозавриков. Каких-либо объективных сведений об отце он сообщить суду не мог.
