There is no sense of victory, however. There is a feeling of anxiety, because the current organic nature of the law enforcement regime established in Russia almost no longer leaves any hope for its normal functioning. Too closely converged, intertwined interests of the bandits and those who should catch them. The system—I dare not call it law enforcement—has acquired savage forms of hasty profit. It rejects people who are knowledgeable, intelligent, competent, simply honest. In order to preserve command posts in the face of a complete collapse of the business and moral decline, its leaders seek and find support in the same place where the leaders of organized crime find it - in the political and power circles of the country. All this is clearly seen in the example of my native Khabarovsk Territory, where the events described above took place. I will recall them later and briefly, because this story has been publicized by me many times both in the press and on television. Much more important, I think, is to give publicity to what, according to a long-standing professional habit, for the time being, kept in the stash in order to strengthen their own "defense capability".

Sturgeon passion

In the middle of last year's December, a completely uncharacteristic criminal plot happened in the lower reaches of the Amur. Investigators and detectives of the main department of the Ministry of Internal Affairs for the Far Eastern Federal District, on an operational tip from Nikolaevsk-on-Amur, seized a batch of poached sturgeon in special storage facilities. And the exclusivity of what happened was that the fish turned out to be over 37 tons (!).

For some reason, this undoubted achievement was modestly kept silent by the head of the Far Eastern MVD headquarters, Major General of Militia Felix Vasilkov, who published on one of the websites his report on the results of the “large-scale interdepartmental operational and preventive operation Barrier, aimed at decriminalizing the fishing industry complex.” About sturgeons, Vasilkov's report only says that during the 20-day raid of his employees as part of an interdepartmental group “... four facts of illegal sturgeon hunting were identified and suppressed. Directly at the time of their fishing in the Amur River, two residents of the Nikolaev region were detained. The men were just pulling out an okhan ( a large large-mesh net made of especially durable material. - B.R. ), in which there were about a dozen sturgeons. “All the fish released from the nets were seized and released into their natural habitat, and the fishermen were brought to criminal responsibility,” the general said.

A noble, one might say, idyllic picture. But what about 37 tons? Well, this is not a dozen delicacy fish, but many thousands! Vasilkov is silent about that. Maybe because this story is hefty muddy, like many of those that the Far Eastern Police Headquarters has been dealing with lately.

Briefly about the essence of events. The investigators handed over the seized fish for safekeeping to Poberezhnoye LLC, one of whose leaders A. Postnikov was brutally beaten a few days later. Information was received, later not confirmed, that the attack on him was directly related to the storage of fish. To deal with this case in Nikolaevsk-on-Amur sent a group of operatives and riot police, headed by the deputy head of the department for the investigation of organized criminal activity, Major of Justice Sergei Lebedev.

From S. Lebedev's address to me:

“On the day of arrival, we worked late. Already around midnight, together with detective Fedorov, they decided to have dinner at the only restaurant "Erebuni" open at that time. My friend stayed to pay the bill, and I went out into the lobby, where I was immediately surrounded by five guys. They said that they knew that I was from Khabarovsk, from the "head office". They started pushing me, swearing obscenely. One hit me hard in the back. I turned around and pushed him in the chest with my hands. He stood near the open door of the toilet, stumbled on the threshold and fell, or rather, sat on the toilet. At that moment, two uniformed police officers entered the cafe. They approached the guys, shook hands with each of them, and asked me to show my documents and get into their patrol car. I showed my ID, asked to reassure the guys and wanted to go into the hall for Fedorov. They said that they would not let me go anywhere, demanded that I immediately go outside. I insisted that Fedorov be called. Then one of the beefy guys grabbed me from behind by the neck so that I began to choke, and with the help of others dragged me out into the street. At the same time, they shouted: “Drag him around the corner! Now he will regret, not only that he came here, but that he was born into the world! Well, that's it, freak, damn you! At the same time they beat me on the body. The police sergeant and his partner in uniform, but without shoulder straps, walked behind, did not interfere in what was happening. I was dragged to a dark place. Then, really fearing for my life, I hit the guy who was holding me with my elbow in the stomach, escaped, ran 2-3 meters away, took out my service pistol PM from the back pocket of my trousers and shouted loudly: “I repeat, I am a police officer, do not approach - I will shoot!

At this time, Fedorov ran out into the street. He began to hold back the crowd of angry men, who had already gathered 10-12 people, and I went up to the police UAZ, sat in the back seat, and asked the patrolmen to urgently drive up to the house where the riot police stopped. I asked why they were inactive when they pulled me out of the restaurant? They replied that they knew for what purpose we had come to the city, that the population was very angry with us, the police feds, for the seizure of a huge batch of sturgeon, that they should live in this city, but they could not stand up for me - they did not have weapons…”

When, together with the riot police, we drove back to the restaurant, Fedorov told me by phone that everything was in order with him. We went to the closet to pick up things. There, a drunken woman approached me, as it turned out later, the wife of the owner of the restaurant A. Aleksanyan T. Polkovnikova, who works as some kind of boss in the administration of the Nikolaevsky district. She said that I would be very sorry that I had come here, that the employees of the Main Directorate of the Ministry of Internal Affairs would generally forget the way to this city ... "

This is Major Lebedev's version. But there are others. They are set out in the memos of the head of the administration of the Nikolaevsky district S. Lysakov, the director of the Erebuni restaurant A. Aleksanyan, the head of the administration of the Ozerpakh rural settlement L. Dementyev. I quote the latter, even retaining the punctuation marks he placed, which in this case are very eloquent. “... employees of the main department of the Ministry of Internal Affairs for the Far Eastern Federal District carried out work on the territory of the Ozerpakhsky rural settlement to identify citizens who are engaged in poaching and storage of sturgeon fish. But by what means...? Searches are carried out without a sanction and no charges are brought, local residents are taken to the city of Nikolaevsk-on-Amur, where they are interrogated in their rooms...? hotel "North". Please bring this information to the Governor of the Khabarovsk Territory.”

Why was L. Dementyev so excited? Not in torture chambers, but in quite comfortable rooms of the best hotel in the area, his fellow villagers were interrogated ... By the way, of the seized 37 tons of poached sturgeon, more than half of his settlement Ozerpakh falls to the share.

The owner of the Erebuni restaurant, A. Aleksanyan, writes to the city authorities: “Representatives of the power structures of the Far Eastern Federal District started a fight in the restaurant, while threatening with firearms, putting it to the heads of the visitors ... they broke the toilet bowl in the men's toilet, which caused material damage to the restaurant. These actions were recorded on a video camera ”( emphasized by me . - B.R. ).

Here it is - the saving, impartial, completely objective truth - a film from the video surveillance system. Fortunately, I found out that there are eleven TV cameras in Erebuni. They look through everything - from the entrance to the last nook.

The film ... disappeared (?!) at the very moment when the investigators wanted to see it. True, L. Zarya, an interrogating officer of the OVD for the Nikolaevsky district, opened a criminal case “on the fact of a threat to kill by an unidentified person” and she herself accepted it into proceedings. Exactly a month later, her decision was canceled as illegal by the deputy prosecutor of the region L. Dyakonova. A week after the cancellation of this decision, the interrogating officer Zarya herself confidently wrote another rejected material. At the same time, she established an extremely important thing - she came to the restaurant and made sure that the damage to Aleksanyan's establishment was the most miserable: the ill-fated toilet bowl was intact. Only the lid is slightly damaged. “The unidentified person did not have the intent to damage the lid,” the investigator states. Then she writes about the main thing: “There was no real threat of murder to the people in the restaurant, since the events took place in a crowded place and any of them could have prevented the unlawful actions of an unidentified person.”

This is true, because the restaurant that night was packed with ... policemen in civilian clothes, including a certain V. Sudarikov, who later became one of the main victims in the criminal case of Major Lebedev, although he, among other hooligans, dragged the major out of the restaurant .

The head of the administration of the Nikolaevsky district, S. Lysakov, considered the events in the restaurant and in Ozerpakh so significant that he forwarded the reports of the restaurateur Aleksanyan and the head of Ozerpakh to the leadership of the region with his personal indignation at the "infringement of the legitimate rights and interests of citizens."

Sergey Lebedev was put under most ugly pressure by his superiors, who, according to them, were "tired" of complaints against him from Nikolaevsk. They demanded that he leave “in a good way”, otherwise they would be fired “in a bad way”. A young man who, for 10 years of service in the authorities, had no penalties - only encouragement - was forced to write a statement "of his own free will." It was in April, at the end of May, the investigator for especially important cases of the Investigative Department of the Investigative Committee at the Prosecutor's Office for the Khabarovsk Territory, S. Sergeev, once again refuses to initiate a criminal case against Lebedev due to the lack of corpus delicti. In August, he suddenly finds this composition and initiates a case. It is hard to imagine that, quite by chance, this coincided in time with Sergey Lebedev's appeal to me.

Who benefits?

Whose interests, besides gangster ones, did the young investigator touch, for which they seem to break his life and career?

Recall that the Amur sturgeon is listed in the Red Book and for more than half a century its catch has been strictly prohibited. Meanwhile, ichthyologists, meanwhile, dejectedly testify that the population of the Amur sturgeon is practically exterminated by poachers. If a few years ago, according to their data, only in the Nikolaevsky region, robbers of bioresources harvested from 400 to 500 tons of sturgeon, now they catch only 200-250 tons, which is also quite a lot.

But let's look at the police reports. Poachers are caught individually and in small groups, which the police, for their own self-respect, call "organized criminals." With a large number of them, a mere minuscule amount of sturgeon is seized, even less caviar. As a rule, they detain not seasoned poachers, but those who, living on the Amur, catch "for themselves."

Meanwhile, it is not a secret for many that for a long time, at least ten years, criminal syndicates have been operating confidently, arrogantly and with complete impunity in the region, which catch, buy, store in powerful refrigerators, and send them on special flights to the western regions of the country. , as well as abroad sturgeons and black caviar.

Everyone understands that it is completely unrealistic to do this without the participation and protection of power structures, law enforcement officers. In any more or less large-scale case, the “ends” are immediately professionally cut off, small fry are made scapegoats, who are then rescued, and those operas or investigators who show excessive zeal in such cases are unhappy.

Among the only five people under investigation in the same case of 37 tons of sturgeons are former police officers and the highest-ranking one is Kastrykin, now a former deputy of the Ozerpakh rural settlement. As they now explain to me, because of this “special subject”, the criminal case, like a ping-pong ball, was passed from department to department for a whole year. It was practically not investigated, just a few days ago it was received by the investigative department of the Regional Department of Internal Affairs. All suspects are at large. Until recently, Alexey Tyshov, senior investigator of the investigative unit at the Far Eastern police headquarters, conducted the case. He, ironically, personally supervised the execution of hard work - the destruction of 37 tons of sturgeons.

Burn with a blue flame...

Sturgeons were seized in a severe winter, the fish was frozen. There were no problems with either its quality or storage. It would be logical to transfer the delicacy, as expected, through the Federal Agency for Property Management to orphanages, nursing homes, to army units, where such fish have never been tasted. But, apparently, it has been clearly noted that stupidity is not the absence of intelligence, it is such intelligence. In the police headquarters, the chiefs decided to destroy 37 tons of sturgeon "by burning at the place of withdrawal."

... Judging by the protocol for the destruction of physical evidence drawn up by investigator Tyshov, the action began on February 13 of this year. at 15.30 and ended at 00.30 on the night of February 17th. Present: two attesting witnesses - I. Korolev and E. Portnyagin, senior assistant of the press service of the Main Directorate of the Ministry of Internal Affairs A. Chak, senior state inspector of fish protection of the Amur Territorial Directorate of the Federal Agency for Fishery O. Chekushkin, representative of Poberezhnoye LLC A. Postnikov.

Only one day - February 14, when A. Chak, an employee of the press center of the head office, filmed a story about the destruction of fish for television, this was done during the day. Then only in the evening and at night. The protocol says: all participants in the investigative actions were inseparably at the scene from the beginning to the end, which they certified with their personal signatures in the document.

This is a shameless deception. An employee of the press center, A. Chak, filmed a story for television and flew to Khabarovsk early in the morning on February 15. She says that she was not tasked with documenting the process of destroying all the fish on video. The witness Korolev also participated in investigative actions only for the first couple of days, then left Nikolaevsk. For the same amount of time, the fish inspector Chekushkin had enough patience.

However, on the third day - February 15, judging by the report of Major Tyshov to the department of personal security of the ORB 16 of the Ministry of Internal Affairs, employees of the Department of Economic Crimes of the Internal Affairs Directorate for the Khabarovsk Territory prevented him from burning fish. Colleagues, apparently, smelled cheating in the "investigative actions" of envoys from a higher police organization, tried to count all the fish and seize it. Obepovtsy, apparently, was put "in their place", because on February 16 in the evening they began to burn sturgeons again.

Fish inspector O. Chekushkin told me: “The fish did not burn. Frosts were below thirty degrees. They lit old tires, cardboard boxes - a lot of smoke, stench and very little use ... "

I learned the story of the issue from one of the law enforcement officers:

“The offended petty poachers decided to take revenge on the policemen for their detention and launched information, which would later be called “operational”, to various authorities, including Moscow, about 37 tons of sturgeon and several tons of black caviar stored at bases in the Nikolaevsky district. They could not fail to react to this, and the departments began to compete who would quickly write down a high-profile case as an asset. Naturally, everyone was defeated by the Main Command of the Ministry of Internal Affairs for the Far Eastern Federal District. When they cooled down, they understood: why destroy goodness? Burning was imitated, but in fact most of the sturgeons left along well-trodden paths. At the same time, note: no one was looking for caviar. Do you know how much of 37 tons is obtained?

I did not know and inquired about it at the Khabarovsk branch of the Pacific Research Fisheries Center. Director G. Novomodny said: "...Out of 37 tons of raw fish, the yield of caviar could be about 5.9 tons when catching Amur sturgeon..."

Investigator Tyshov, we will believe, burned, judging by the protocol, 12 half-kilogram cans of black caviar. Where are the tons? At the Khabarovsk food market, one hundred grams of the delicacy costs from five thousand rubles. Approach any seller who legally sells fish and red caviar, and if your appearance inspires him with confidence, he will take out of the stash what cannot be traded. This caviar, as a rule, is homemade, of poor quality. The best is smuggled abroad. The Japanese, for example, according to knowledgeable people, buy a kilogram of black caviar, depending on the quality, at a price of five to seven thousand dollars. It is not difficult to calculate that "caviar" poachers only in the mouth part of the Amur and its tributaries annually generate criminal proceeds equal to two annual budgets of the Nikolaevsky region - up to three billion rubles!
Naturally, questions arose:

- For what purpose did investigator A. Tyshov deliberately distort the information in the protocol on the destruction of physical evidence?

- Who and for what purpose forged the signatures of witnesses and participants in the "investigative actions" who did not participate in them?

- Why didn't the heads of the Main Directorate of the Ministry of Internal Affairs send a cameraman to the place of extermination of fish in order to document the whole process on video?

- Why did they destroy the fish mainly in the late evening or at night, in the severe February frosts, when no one could check anything?

- Why didn't investigator Tyshov and his superiors take any measures to discover the places of storage of sturgeon caviar and seize it?

It can be seen that the head of the department of own security for the Far Eastern Federal District of ORB No. 16 of the Ministry of Internal Affairs of Russia, I. Novak, also attended to similar issues. In his report to the investigative department of the Investigative Committee under the Prosecutor's Office of the Khabarovsk Territory, he said that “... during an internal audit, he discovered signs of a crime under Part 2 of Art. 303 of the Criminal Code of the Russian Federation (falsification of evidence in a criminal case), in the actions of the senior investigator Major of Justice Tyshov.

Annoyance takes when you see how diligently the investigator of the investigative department at the regional prosecutor's office A. Voyskovich glosses over and overwrites the obvious facts in the decision to refuse to initiate criminal proceedings against his colleague Tyshov. Behind the tie of words, he hides deceit, boorish arrogance - they will swallow everything. What if people were just nothing at the so-called investigative actions, that their signatures in the protocol were forged? Voiskovich writes: “... given that the destruction of physical evidence is a procedural action, the protocol of which does not carry evidentiary value ( emphasized by me. - B. R. ), as a result of which it cannot be material evidence ... The investigation concludes that at this stage the procedural verification there is no sufficient data indicating the signs of a crime under Part 2 of Art. 303 of the Criminal Code of the Russian Federation, in the actions of Tyshov A.M. ... At the same time, signs of a disciplinary offense in violation of the procedure for filling out procedural documents are seen in his actions.

Pay attention to the phrase: “... at this stage of the procedural check there is not enough data ...” Not at this stage, but at the next one they may well appear, as they appeared six months later in the dirty concocted criminal case of Major Sergei Lebedev. It seems like a trifle - but the person is already on the hook. And they forgive him the falsified protocol, and they are not even interested in what and who is behind this falsification and where 37 tons of sturgeon actually went, just a mere trifle of which was set on fire in order to film and show naive townsfolk the cop prowess multiplied by their own fool.

Trickster, however, this investigator Voiskovich! Easily and elegantly turned obvious abuses, forgery of documents into an innocent bureaucratic omission.

This, alas, is not the case - the system. Its components are simple: not to surrender your own, to extract personal benefit from everything from which it can be extracted, to ruthlessly crack down on those who fall out of the system.

Compromise as insurance

I wondered why the majority of our law enforcement officers are so imprudent, procedurally careless, impudent, finally, even in their official papers? Then I realized: they are “going crazy” from their own impunity, they are bound by mutual responsibility, how they multiply insurance and keep dirt on each other.

Let's take the structure, recently "strengthened" personally by the Minister of the Interior Nurgaliyev - his head office for the Far Eastern Federal District. Major General Felix Vasilkov was sent to lead him from Moscow to the colonel-general position. From the very beginning, his methods of work seemed more than strange to me. In Moscow, in rather bizarre ways, through a long-time half-forgotten acquaintance, a certain gentleman by the name of Demin came to me, introduced himself as an employee and the closest most confidential connection of General Vasilkov. He said that their Moscow team was going to the Far East with the only and extremely important goal - to put an end to crime there. They will start by putting things in order in their own head office. They know that I wrote in the newspapers about the abuses of his employees, they would like to check the facts and take action.

Who can refuse help in such noble aspirations? At the same time, I laid out to Demin something that still haunts me.

For example, in the Khabarovsk department of the FSB several years ago, a long and detailed operational development of one of the employees of the police headquarters on his connections with drug dealers was carried out. From completely reliable sources, I know that they have accumulated several volumes of such materials, after which this person should at least not be allowed to work in the law enforcement system. It still works.

Two years ago, employees of the central office detained a completely criminal type. As the prosecutor's office established and later recognized "such evidence as inadmissible", the operatives planted weapons and explosives in his car and apartment. Questions arose, to which no one gave answers: where did they get these weapons? What is its origin? How many guns and explosives do they have that they can plant on anyone?

Demin promised to sort it out, but, apparently, he and Vasilkov never got around to it, because the general’s Moscow team themselves willingly and professionally plunged into crime.

A fresh example of this: A. Serebryakov, senior officer of the 6th department of the ORB of the police chief, extorted a bribe of three million rubles from a certain citizen, the wife of a businessman, against whom their department initiated a criminal case. If he does not pay, he promised to “hang” additional articles on his spouse. The woman turned to the FSB. There they made a “doll” imitating a million rubles, and upon receiving it, Serebryakov was caught red-handed. At the very first interrogation, the operas handed over the one with whom he was in share and for whom he tried, - the deputy head of the department for the investigation of crimes on corruption and in the sphere of the economy (emphasized by me. - B.R.) of the investigation unit at the Main Directorate of the Ministry of Internal Affairs of the Russian Federation for the Far Eastern Federal District A . Georgian. By the way, one of those “incorruptibles” whom General Vasilkov brought with him from Moscow to “put things in order”.

After what happened, Vasilkov urgently lets his friend-bribery go on ... vacation. He flies to the capital and has been walking for almost three months, although a criminal case has been initiated against him. And the investigative department, as we will see later, itself mired in bribes, is in no hurry to pull the police “fighter against corruption” for interrogations.

Yes, and General Vasilkov himself has split personalities and disagreements with the Criminal Code.

I have a certificate in front of me: “It was given to Felix Pavlovich Vasilkov that he has been working in Aeromor Limited Liability Company as Deputy Director for General Issues since January 11, 2010. The average salary per month is 50,000 rubles.” Seal. Signatures of the director, chief accountant. Immediately - a copy of a fake work book and ... a visa. South Korean.

What is the police general looking for, who has reincarnated as a businessman, in a distant country? What did you lose in your native land? Does Minister Nurgaliyev know about his unauthorized flights abroad? After all, the general is the bearer of secrets. And what, what "production" necessity will justify the forgery of documents - which in itself is a criminal article? However, if the general can do it, why shouldn't investigator Tyshov engage in falsification?

I am waiting for an answer to these questions from Minister Nurgaliyev.

...Recently, I had a chance to talk with acting. Head of the Investigative Committee under the Prosecutor's Office of Russia A.I. Bastrykin. I asked Alexander Ivanovich why it took so long - almost three years - to convince him and his department, in my opinion, of the obvious - that the head of the Investigative Committee of the Investigative Committee under the Prosecutor's Office of the Khabarovsk Territory, General Gennady Fateev, his deputy Konstantin Lysenko, are in the service of local leaders criminal gangs? There is a huge amount of evidence for this. Bastrykin replied:

- You are opposed to giving the Investigative Committee the right to conduct operational-search activities. Therefore, we ourselves could not check the facts stated in your articles. And I am a procedural person, I can’t make decisions based on the materials of journalistic investigations. That's when I officially asked the director of the FSB Bortnikov to conduct an inspection, and we received the relevant materials - radical decisions were made ...

Let me remind you that General SKP Fateev, his deputy Lysenko, deputy head of the department for the investigation of especially important cases Chulkov and the investigator of this department Babak were fired for violating the prosecutor's oath. The last two were caught red-handed - they extorted a bribe from a businessman and a half million dollars and, upon receiving part of this amount, were detained. The Investigative Committee of the country is not yet in a hurry to initiate criminal cases against Fateev and Lysenko, although the leadership of the Prosecutor General's Office after the inspections insists on this.

As you can see, everything revolves in a vicious, one might say, criminal circle. I look at the list of the investigative “team” tasked with handling the case of police bribe-takers Serebryakov and Gruzinsky and see the names of those who diligently tried, on the instructions of the thieves in law, to ruin their criminal case, pursued prosecution witnesses along with some employees of the head office of the Ministry of Internal Affairs. The same will have to provide "operational support" of the criminal case of bribe-takers-investigators. So they serve each other...

Pay attention to the detail: both in the police headquarters and in the Investigation Department, the bribe-takers "worked" in pairs: the boss - the subordinate. This suggests a completely logical idea about the collective nature of such crimes. It would be naive not to assume that there are no thirds, fourths, fifths in criminal gangs...

And from them we expect the fight against crime? ...
