
The Strasbourg Court in 2010 made 216 decisions on cases of Russia. 205 of them not in favor of the authorities of our country. By the number of decisions made, our state is in second place after Turkey (278 cases). Next, Ukraine and Poland are located. Only in 5% of complaints from Russia did the court have not seen violations of human rights. The total price of the arbitrariness of officials who committed gross violations of rights (including the right to life and health) of their own citizens - 8 million 866 thousand 400 euros, or 355.72 million rubles a year, that is, almost one million rubles a day. 87.57% in this amount is compensation for non -pecuniary damage, the rest is compensation for damage and expenses.
The only of the 47 countries of the Council of Europe, Russia stubbornly refused to ratify the 14th protocol to the European Convention on the Protection of Human Rights and Fundamental Freedoms, thanks to which the process of considering cases in the European Court could be noticeably accelerated. In 2010, this obstacle was passed, on February 8, the ratification law entered into force, and the Russians who have again filed complaints can expect that they will not have to wait years from Strasbourg for years.
Most of the cases examined by the European Court last year against Russia can conditionally be divided into 5 volumetric groups. From 750 to 3000 euros, the court was awarded to the Russians who complained about the red tape and failure to comply with the courts of courts in civil matters as compensation for non -pecuniary damage. It is difficult to single out any one indicative case here, for each-the legal “ping”, when a person has been led from one official to another for years, forcing himself to do their work. The remaining groups of cases look as follows.
Pensioners
2000 euros of non -pecuniary damage and from 495 to 20,479 euros of material damage, Strasbourg ordered to pay in August each of the 87 military pensioners of Novocherkassk who applied to the European Court. The total amount of Russia's punishment exceeded 600 thousand euros. The applicants demanded a recount of pensions. Two pensioners did not survive before the victorious decision. 4663 euros will receive the widow of Nikolai Melnikov and 11,097 euros - the son of Nikolai Zakharov, who died in November 2009. In 2006, the Rostov garrison military court convicted the ex-military region of the Major General Valery Shpak, sentencing him to 80 thousand rubles of a fine for negligence when accruing pensions.
Chechnya
On average, 55-65 thousand euros for the family of every stolen or killed resident of Chechnya obliged Russia to pay the European court last year. Sometimes the amounts of compensation reached 150 thousand euros - in cases where, before the abduction or death of a person, they were very tortured, which managed to find reliable evidence.
The largest defeat of Russia in the European court can be recognized as the December decision on the payment of unprecedented 1.72 million euros to 29 residents of Chechnya for bombing by the federal troops of the village of Katyr-Yurt. In February 2000, the village, in which about 25 thousand people lived, was captured by militants, and the Russian military decided to apply air jacket. 24 people died. The court awarded from 30 thousand to 70 thousand euros to be injured of varying severity. The court ordered the lost relatives to pay from 60 thousand to 120 thousand euros. So, 120 thousand should receive 33-year-old Bela Orsamikova, who, during a bombardment, lost her mother and three brothers. In total, the court examined dozens of complaints about the abduction, torture and disappearance of citizens during the second Chechen campaign. Of the Russian military, no one was held accountable for the death of civilians of Chechnya.
Prisoners
A crowded chambers, lack of fresh air, insects, terrible stuffiness in summer and cold in winter, disgusting nutrition, the boorish attitude of the administration and the absence of acceptable medicine became the subject of consideration of more complaints about unbearable conditions in investigative insulators and colonies of Russia.
In early March 2010, the Committee of the Ministers of the Council of Europe conducted an analysis of the execution of our country of decisions of the European Court in the 31st case on the torture conditions of detention in investigative insulators. Then a black vision of 24 pre -trial detention centers was presented, which, in particular, included Moscow Sailor Silence, Butyrka and Presnya, as well as St. Petersburg Crosses.
Former FSB officer Mikhail Trepashkin, convicted of disclosure of state secrets, in December sued 10.5 thousand euros in Strasbourg. This is a compensation for an unfair trial and the torture conditions of the conclusion in the Sailor Silence in the pre -trial detention center, where, according to Trepashkin, in a complete lice, a dirty and smoky chamber 1.5 per 1.8 meters without windows and ventilation, he had to sleep in turn, since there were 14 prisoners with 8 seats. The head of the Federal Penitentiary Service of Russia in Moscow Vladimir Davydov and the head of the "sailor of silence" Fikret Tagiev in December 2009 were dismissed after the death of lawyer Sergei Magnitsky.
The head of the Federal Penitentiary Service for St. Petersburg and the Leningrad Region Vladimir Malenchuk and the chief of Krestov Sergey Khudorozhov also parted with their posts. Police torture
The amounts of compensation to the victims of police violence are commensurate, and sometimes higher than the victims of the second Chechen campaign. For example, a resident of the same Chechnya Alaudin Sadykov will receive 79,800 euros for inhuman bullying. Police officers and the military beat a pensioner, burned his hands and cut off his ear. According to the Interregional Committee against torture, accused of beating Sadykov at that time, the deputy head of the interior of the internal affairs department (VOVD) of the Oktyabrsky district of the Terrible Rashit Yagafarov, the deputy chief of the special fire group of the same department, Sergei Degtyarev and the air defense system of the temporary detention of VOVD Sergey Zakharov, are still on the wanted list. The criminal prosecution against the former chief of the temporary detention of this department Igor Banin was discontinued according to the amnesty .
The aircraft engineer of the Baltimore airfield George Bykov, who suffered from torture, will receive 15 thousand euros, who, after a police conversation with addiction in the Soviet District Department of Internal Affairs of Voronezh, wrote a sincere confession in the murder of two warrant officers. Violation of civil rights and freedoms
Speaking about other cases that the European Court of Human Rights considered in 2010, we can note the victory of gay activists led by Nikolai Alekseev, who will receive 29,510 euros for damage from the dispersal of three gay parades in 2006-2008. In case of violation of the right to unite, the Strasbourg court made only one decision - in favor of Jehovah's Witnesses. For the illegal closure of the organization, they have 20 thousand euros compensation for non -pecuniary damage and 50 thousand euros for the costs incurred.
In cases of freedom of speech last year, 5 decisions were made, everything is not in favor of Russia, including the Novaya Gazeta in Voronezh. In December, the European Court recognized the violation of the 10th article of the European Convention, guaranteeing freedom of expression, and ordered the editorial office to pay 866 euros. The then mayor of Novovoronezh Vladimir Sinitsyn, who pursued journalists in court for criticism in his address, is now a member of the Bureau of the Communist Party regional committee .
Some anti -heroes, who somehow concern the decision of the European Court and the actions of which brought serious damage to the Russian budget - the same Shpak, Malenchuk and others, already outside the authorities, but the majority continues to work in the same positions or even went to increase. However, according to our observations, the trend is still changing: international justice is leisurely, but fair, and those who violate human rights, sooner or later are still overboard.
