The Tuvinsky traffic cop shot the schoolboy will sit for three years and three months

In Tuva, a former traffic police inspector Borbak-ool Bair, who shot at schoolchildren in the fall of 2009 and killed one of them, was sentenced to 3 years 3 months in prison with a sentence in a general regime colony.

The policeman was taken into custody right in the courtroom, he is also deprived of the right to occupy certified positions in law enforcement for three years. Such a decision was made by the Barun-Khemchiksky District Court of the Republic, which on Monday announced the verdict in the case that received a loud resonance.

The verdict has not yet entered into legal force, the parties that disagree with it can appeal it in the Supreme Court of Tuva, ITAR-TASS said in the press service of the republic’s prosecutor's office.

The former traffic police inspector was found guilty of committing crimes under Part 2 of Article 109 and Part 2 of Art. 118 of the Criminal Code of the Russian Federation ("causing death and serious harm to health by negligence due to improper performance by a person of his professional duties").

The incident, during which the schoolboy was killed, occurred in October 2009. Inspector of the traffic police of the VIBDD ATS of the Barun-Khemchik district of Borbak-ool Bair, carrying out a raid in a service car, stopped the VAZ-2106, which was driven by a 17-year-old student of the 11th grade of a local school. The car did not stop immediately, but drove about 20 meters before.

The traffic cop, taking out a person’s gun, ran after the car, and going up to it, shot at the driver. The bullet, having gone through the young man's neck, hit the 17-year-old girl sitting in the front passenger seat. The teenager died from a gunshot wound at the hospital on October 28. The wounded girl was discharged from the hospital after a long treatment.

During the investigation, Bair said that the teenager sitting behind the wheel was drunk and tried to get an object similar to a gun from his jacket pocket. However, the examination showed that there was no alcohol in the student’s blood. Later, the traffic police inspector changed his testimony and said that he shot the schoolboy accidentally, and then threw a toy pistol into the car.

In February 2010, the court found the former policeman guilty for two articles of the Criminal Code of the Russian Federation: Part 2 of Art. 109 of the Criminal Code of the Russian Federation "causing death by negligence due to improper performance by a person of his professional duties" and part 2 of article 118 "Causing grievous bodily harm by negligence, committed as a result of improper performance by a person of his professional duties."

The prosecutor's office considered the punishment of imprisonment for a period of 15 months too soft for this kind of crime and protested this court decision, the case was sent for a new consideration.
