Former head of Yukos Oil Company Mikhail Khodorkovsky returned his application for parole to the Preobrazhensky District Court of Moscow.

As his lawyer Vadim Klyuvgant said, M. Khodorkovsky believes that the court did not fulfill the duties assigned to it by law. In particular, according to the lawyer, by law the court itself is obliged to request the necessary accompanying documents to resolve the issue of parole, and not entrust this to the convicted person.

The day before, June 6, 2011, the Preobrazhensky Court of Moscow returned the petition for parole of M. Khodorkovsky and the former head of the MFO "MENATEP" Platon Lebedev, since it did not receive the full set of necessary documents, including the verdict in the second case. However, the lawyers of the convicted at that time did not yet have this verdict themselves.

M. Khodorkovsky and P. Lebedev submitted applications for parole to the Preobrazhensky District Court of Moscow on May 27 and 30, 2011. respectively.

“I ask you to consider the issue of my parole. The articles imputed to me provide for this possibility after serving half of the sentence. Of the assigned 13 years, I served more than 7.5. I do not admit my guilt, since I continue to challenge the court decision in the ECHR and the Supreme Court of the Russian Federation “The damage, the validity of which I also dispute, I repay to the extent of the opportunities to earn money provided to me at the place where I am serving my sentence,” M. Khodorkovsky noted in his statement.

In turn, P. Lebedev, who was sentenced by the last court verdict to 13 years in prison, indicated that he had served almost eight years of them to date. “In accordance with paragraph “b” of Part 3 of Article 79 of the Criminal Code of the Russian Federation, parole can be applied after the convicted person has actually served at least half of the sentence for a serious crime, while I have served one and a half years more than half of the sentence I have time," his statement said.
