The bill on amendments to the Criminal Code of the Russian Federation provides for the possibility of exemption from punishment for drug crimes based on the results of treatment of a drug addict. This is stated in a certificate prepared by the office of the President of the Russian Federation for the bill on amendments to the Criminal Code introduced by Dmitry Medvedev to the State Duma.

In particular, the bill proposes a mechanism for providing a deferment of execution to persons who have committed crimes of minor and medium gravity for the first time in the field of drug trafficking and who suffer from drug addiction.

It is proposed to supplement the Criminal Code of the Russian Federation with Article 82, according to which for such persons who have expressed a desire to voluntarily undergo treatment for drug addiction, the court may defer serving a sentence of imprisonment until the end of the course of treatment, but for no more than 8 years.

“Depending on the results of treatment, at the discretion of the court, a person may be released from serving the sentence or the remaining part of the sentence,” the certificate notes. If a convicted person evades treatment, the court, on the proposal of a supervisory authority, may cancel the deferment of serving the sentence.

“In this way, an additional incentive is created for the conscientious completion of treatment by drug addicts and those convicted for the first time and their subsequent social adaptation,” the certificate says.

The amendments proposed by the president also provide that illegal trafficking in precious metals, natural precious stones or pearls in an amount of less than 1.5 million rubles. will be considered an administrative offense.

It is also proposed to transfer insult and slander (including against a judge) from the category of criminal offenses to administrative offenses.

The same applies to crimes for which liability is provided for in Part 1 of Article 136 of the Criminal Code of the Russian Federation (violation of equality of rights and freedoms of man and citizen), Part 1 of Article 165 of the Criminal Code of the Russian Federation (causing property damage by deception or abuse of trust in the absence of signs of theft ).

In addition, according to the presidential amendments, courts will be able to independently change the category of the crime committed by the defendant to a less serious one. As the Kremlin press service said in a statement, this is being done “in order to individualize punishment and impose fair sentences.”

Currently, the division of crimes into categories does not depend on judicial discretion and the assigned period and is associated with the maximum punishment provided for a particular crime in the Criminal Code.

“Courts in many cases, for crimes of average gravity, taking into account the circumstances of the case and the personality of the convicted person, impose a sentence of imprisonment not exceeding two years. At the same time, such a convict is considered to have committed a crime of average gravity, and appropriate legal consequences arise for him.” , - noted in the Kremlin.

The bill also proposes to classify intentional and careless acts as crimes of minor gravity, for the commission of which the maximum penalty in the form of imprisonment does not exceed 3 years, and not 2 years, as is currently provided for in Part 2 of Article 15 of the Criminal Code of the Russian Federation. “This will limit the effect of the punitive instruments provided for by the Criminal Code of the Russian Federation, which cannot be applied to persons who have committed minor crimes,” the Kremlin said in a statement.

Let us recall that Russian President Dmitry Medvedev signed and submitted to the State Duma new amendments to the Criminal Code of the Russian Federation aimed at further liberalizing the Criminal Code.
