Ex-participant "House-2" was condemned conditionally for drug storage

The Nikulinsky court of Moscow sentenced to three years a conditionally former participant in the TV show "Dom-2" Elena Berkov for drug storage. According to RAPSI, earlier the press secretary of the court Arsen Poghosyan specified that Berkova asked the court to consider the criminal case in a special order, that is, without a judicial investigation - to study evidence and interrogation of witnesses.

A special procedure, according to the norms of the Code of Criminal Procedure, can only be chosen with the full admission of guilt and repentance in the deed. The choice of special order is a mitigating circumstance, when considering the case in a special manner, the court may impose a punishment of no more than two thirds from the maximum of the sanction of the Criminal Code of the Russian Federation.

Berkova was accused in Part 2 of Article 228 (illegal storage of narcotic substances without the purpose of sales), which provides for the maximum punishment in the form of ten years in prison. In relation to Berkova, a preventive measure in the form of a non -departure subscription was chosen.

When sentencing, the court took into account the recognition of Berkova’s guilt, its assistance to the investigation in the disclosure of the crime, active repentance, as well as the presence of a minor child. According to the verdict, the trial period for Berkova will be four years. The judge explained Berkova that in the case of new crimes for four years, the conditional sentence will be replaced by the real one.
