И, естественно, с заемным трудом численность вот этих ФНПРовских профсоюзов стала резко сокращаться.
А.П.: Вынужден объяснить один нюанс, почему в Трудовом кодексе нет такого прямого запрета, но есть такого типа ограничения: по простой причине. Представьте себе, на АвтоВАЗе создается профсоюз вахтеров по открытию ворот, он объявляет забастовку и никого не впускает и не выпускает, и диктует условия стотысячному коллективу. Извините, в мировой практике такие случаи были. Защиту предусмотрели – согласен, что не очень хорошую.

Р.К.: Я хотел сказать, что
В некоторых странах они строятся по отраслевому принципу, в некоторых по профессиональному, в некоторых – и по тому, и по другому. Но так сложилось в России, что традиционно в ней профсоюзы строились по отраслевому принципу. Попытки создать профсоюзы по профессиональному принципу в начале 90-х годов, в общем, захлебнулись.
Б.Д.: Следующий вопрос. О том, на чье трудовое законодательство нам хорошо бы ориентироваться? Где, на ваш взгляд, трудовое законодательство достаточно оптимально?
Г.Е.: Мое исследование и моих коллег трудового законодательства европейских стран показывает, что оно во многих институтах, таких как сверхурочная работа, срочные трудовые договоры, размер выплат при сокращении, практически совпадает с нашим Трудовым кодексом.
А.П.: На самом деле, мы очень законопослушная страна, мы реально выполняем положения европейской социальной хартии, на самом деле, положения нашего законодательства не хуже среднеевропейского, но ужас в том, что чтобы иметь очень мощное жесткое трудовое законодательство, нужно быть очень хорошо развитой страной. Б.К.: Прошу прощения, я тоже считаю, что Германия могла бы быть такой страной. А по поводу того, что “немцы хотят – Германия стремится…” Понимаете, нет вообще немцев, нет вообще Германии. Одни силы в Германии хотят либерализовать, другие силы хотят помешать либерализовать, третьи хотят, наоборот, ужесточить.
Б.Д.: Видимо, корректнее было бы произнести это так: тренд на изменение в сторону либерализации имеет достаточно много сторонников.
Р.К.: Нет, он просто имеет шансы реализоваться.
об этом только что говорили, вспоминая, что эта страна второй экспортер в мире, кстати. С другой стороны, высокая зарплата, достойные условия труда и, кстати, трудовые конфликты не такие сильные.

Б.Д.: Есть еще один острый вопрос. Нет ли смысла демонополизировать профсоюзы? Как можно построить антимонопольное законодательство профсоюзов?
Б.К.: На самом деле, тут есть в законодательстве закавыка: миноритарные, мажоритарные профсоюзы, на самом деле. Господин Починок помнит, как ФНПР продавливал свои интересы.

И второе – далеко не во всех развитых странах есть понятие минимальной оплаты труда, которая устанавливается на уровне закона. Часто там, где есть сильное рабочее движение, это предмет отраслевых договоренностей. Пожалуйста, если есть сильный профсоюз металлистов, или авиадиспетчеров, они договариваются с работодателем.
Р.К.: Я бы сказал, что помимо стран, где этого нет, есть страны, где есть минимальная зарплата, но она, как и в России, месячная. Таких стран, я думаю, что даже больше, чем где она почасовая, либо они примерно одинаковы по количеству.
Е.Г.: В Германии, фактически, минимальная оплата труда устанавливается отраслевыми соглашениями между профсоюзами и работодателями.
Б.Д.: Коллеги, еще один вопрос. Есть ли смысл стимулировать работодателей на то, чтобы они обеспечивали дополнительный соцпакет?
А.П.: Возможность этого должна быть. На самом деле, это не дополнительный соцпакет, вы поймите это. А должен быть модифицирован сам трудовой договор работника и работодателя. Нормы те же самые социальные и т.д. должны быть. Сколько, как – это уже, извините, результаты переговоров.
Е.Г.: Я против соцпакетов, на самом деле. Конечно, если работодатель является таким хорошим, добрым и т.д., пожалуйста, это проблема договоренности.
А.П.: Да не хорошим и добрым, эта возможность должна быть у работодателя, потому что работодатель нанимает работника, во многих случаях ему интереснее дать зарплату, а в других случаях ему интереснее дать какие-то другие вещи.
Е.Г.: Моя позиция такова: плати заработную плату, экономически обоснованную, а работник должен иметь сам возможности приобрести страховку и т.д.На самом деле,
А.П.: Работодатель всегда будет делать выгоднее страховку, чем работник. Для работника очень часто выгодно и интересно получить что-то, связанное с образованием. Я имею в виду: соцгарантии – это не килограмм мяса свиного, естественно, это сейчас никому не надо.

Б.Д.: Нет, нет, это международная вещь.
Е.Г.: А почему у рабочего нет соцпакета?
А.П.: Нет?!
Е.Г.: Где он есть? Which? Такой же, как у менеджера?
А.П.: Стоп! Так это как раз тоже должно быть прописано.
Б.Д.: Здесь прозвучала мысль о том, что может быть по-разному отрегулировано трудовое законодательство в разных регионах страны. А как оно может быть отрегулировано в рамках восстановления федерализма у нас, адаптировано к этому федерализму, и как оно, в свою очередь, может быть адаптировано к специфике разных отраслей, разных типов предприятий?
А.П.: Вопрос понятен. Есть набор жестких единых форм, который должен быть единым на всей территории, – это запреты, ограничения, чего не должно быть. Есть нормы, зависящие от уровня экономического развития того или иного субъекта. Как бы мы ни хотели, прожиточный минимум в Иваново еще долгие годы будет ниже, чем в городе Москва. Что хотите, то и делайте, это надо принимать во внимание. А остальное – это уже проблемы творчества работника и работодателя.
Б.Д.: И последний вопрос: насколько целесообразно развивать формы не судебного регулирования, а медиации?
А.П.: Изумительно, очень полезно, очень хорошо.
Е.Г.: Это полезно, очень хорошо.
Б.Д.: Неужели все на этом сошлись?
Г.Е.: Можно, я еще скажу пару слов про медиацию?
А что касается законодательства, то когда приняли закон о медиации, в Гражданский кодекс внесли изменения, что передача дел на медиацию приостанавливает течение срока исковой давности, а в трудовые споры не внесли. И мы вынуждены бегать по судам и ходатайствовать, что если идут переговоры, то выклянчивать это отложение дела.
А.П.: У РСПП нет никаких проблем. Почему ее не внести сейчас?
