Waldes-Khasia is found guilty

The Basmanny Court found the ex-head of the Yukos daughter of Fargoil, the Spanish citizen Antonio Valdes-Kharsia, accused of legalizing funds, RIA Novosti reports. On July 6, the prosecutor demanded in absentia to say Waldes-Kharsia to 13 years in prison. “During the debate of the parties, the state prosecutor demanded in absentia to sentenced Waldes-Kharsia to 13 years in prison with a sentence in a maximum security colony,” the court spokesman said. She added that the announcement of the sentence in the criminal case was scheduled for July 18.

Valdes-Kharsia in 2007, being under the recognizance not to leave, disappeared from law enforcement agencies. He was a person involved in the case against former leaders of the company controlled by "Yukos" on charges of embezzlement of $ 13 billion. Then the Basmanny Court of Moscow recognized the ex-director of the Ratibor company Vladimir Malakhovsky and the former deputy director of the Yukos external debt directorate by Vladimir Pereverzin and sentenced them to 12 and 11 years in prison, respectively.

Currently, Waldes-Kharsia has been charged under part 3 of article 174.1 of the Criminal Code (legalization of funds or other property acquired by a person as a result of the crime by an organized group) and under part 4 of Article 160 (assignment or embezzlement). Sanctions of these articles provide for up to ten years in prison. The correspondence process against Waldes-Kharsia began in November 2008, but in February 2009 a break was announced in it. The Prosecutor General’s Office initiated an announcement of the accused on the wanted list. Hearing in his case continued at the end of 2010.

During the trial, the defense witnesses were the ex-head of the Yukos Mikhail Khodorkovsky and the former head of Menatep Platon Lebedev, who declared the innocence of Waldes-Kharsia and the absurdity of the charges against him. According to Khodorkovsky, Waldes-Kharsia was not a member of the criminal group, otherwise the leadership of Yukos would independently put him on trial. “Mr. Waldes-Khagsia was not included in any criminal group, if only because I knew that such a group did not exist,” Khodorkovsky said, answering the question of whether he knew about Valdes-Garsia’s entry into a certain criminal group created in the Yukos.

He explained that Waldes -Kharsia, as the head of Fargagula, "had very limited powers - he was obliged to fulfill the decisions that were made by management companies in terms of oil operations, this was tightly controlled." “If Waldes-Khagsia or some other from the general director violated some instructions, I would have known about this a maximum of a week. Because the failure to comply with the leadership’s decisions was a very great sin inside the Yukos. If something was, they would have reported to me and, if there were reasons for this, we would try to send it to court under article 201 of the Criminal Code of the Russian Federation (abuse of authority),” Khodorkovsky said.
