The Ministry of Finance against the "direct power of the people"

The Russian Ministry of Finance appealed to law enforcement agencies with a request to take measures against the organizers of the campaign "Direct power of the people of the Russian Federation", calling for citizens to demand from President Dmitry Medvedev transferred part of budget funds to personal accounts , reports the press service of the Ministry of Finance.

According to the ministry, in recent years, the “group of persons” has launched a campaign to appeal to the President of Russia and Deputy Prime Minister, Minister of Finance Alexei Kudrin with the requirements to transfer 40% of the amount “intended to ensure the quality of life of every citizen in the current financial year”.

At the same time, the department noted, this campaign is advertised at regional seminars, in the media and the Internet on sites and blogs. In particular, the forms of appeals are offered for the sale, the form of the name of the citizen with his initials and herbal symbols, the certificate of a citizen “exercising direct power”.

It should be noted that the site "Direct power of the people of the Russian Federation" claims: "Russia is a richest country with various resources - natural, material, human, spiritual and energy. And the Constitution of the Russian Federation guarantees all citizens the right to use each of these resources here and now, as a host citizen. The right to manage material resources for each citizen is secured in the Constitution of the Russian Federation."

In support of this thesis, the authors quote a number of articles of the Constitution and the Criminal Code of the Russian Federation. In particular, Article 3 of the Basic Law, where, in particular, it is said:

1. The bearer of sovereignty and the only source of power in the Russian Federation is its multinational people.

2. The people exercise their power directly, as well as through state authorities and local governments.

3. The highest direct expression of the power of the people is a referendum and free elections.

“First of all, it is necessary to understand that everything depends on us. Either we form power in our house, microdistrict, area, or officials form it - bandits. And you need to blame for everything,” the authors of the site concluded.

In 2010, the Ministry of Finance received more than 5,000 such appeals from the Presidential Administration.

"The organizers of the named cynical campaign, illegally referring to certain provisions of the Constitution of the Russian Federation, thereby mislead the population, (...) forming a position not based on legislation on the possibility of citizens from receiving funds from the federal budget," the ministry said.

In addition, the Ministry of Finance believes, the organizers of the campaign "provoke citizens to violate the provisions of the legislation on the use of seals and forms with the reproduction of the state emblem." This may entail a fine of a citizen for the illegal use of state symbols in the amount of 2 to 3 thousand rubles.

The Ministry of Finance also indicates that the implementation of “direct power” by a separate citizen of the Russian Federation and the distribution of budget allocations proposed in appeals is not provided for by the Constitution of the Russian Federation and other legislative acts and does not comply with the principles of the budget system of the Russian Federation.

The Ministry of Finance notes that in accordance with the Constitution of the Russian Federation "not a separate citizen, but the people exercise their power directly, as well as through state authorities and local governments." The highest direct expression of the power of the people is a referendum and free elections.

At the same time, budget funds are allocated for election to election commissions.

The organizers of the campaign "Direct power of the people" propose to allocate budgetary funds to citizens to independently satisfy social, housing, communal, sports, spiritual-educational and other needs of the citizen, with the submission of quarterly and annual reporting on the use of funds.

The Ministry of Finance indicates that these issues relate to the powers of state authorities and local authorities, and issues related to the formation and spending of budget funds intended for the financial support of these tasks are regulated by the Budget Code of the Russian Federation.

The state authorities and local self -government have expenditure powers for the provision of public services to citizens financed by budget revenues of the corresponding levels.

The Ministry of Finance "convincingly asks citizens not to take part in a campaign organized by a group of persons whose true goal is to enrich the funds from citizens from the sale of forms of appeals and certificates."
