According to the conclusions of the fourth examination, "the shortcomings in the provision of magnetic medical care are in a direct causal relationship with the onset of death." Therefore, on July 18, 2011, the investigator of the GSU of the RF RF Marina Lomonosova opened a criminal case against the doctors of the Butyrka pre -trial detention center Litvinova (part 2, Article 109 of the Criminal Code of the Russian Federation: “Causing death by negligence, due to improper performance by a person of his professional duties”) and Kratov (part 2, Article 293 of the Criminal Code: “negligence, which entailed the death of a person”).

Translated into Russian: Magnitsky was already so sick by the time of death that the doctors could still not be saved. Therefore, they did not save. And not to blame.
On July 22, 2011, investigator Lomonosov issues a decision on the appointment of an additional medical forensic examination: “The violations listed in the previous conclusion of experts were committed by various medical workers in various pre -trial detention centers of Moscow. Simply put, the investigation wants the experts to confirm Shmarov’s opinion: the non-provision of medical care in the “sailor silence” is not “in a causal relationship” with the death of a lawyer Hermitage Capital.

Arriving at the prefabricated department, I examined the patient in the paramedic’s office. I took a receipt about his consent to hospitalization ... The patient began to behave inappropriately, speak in elevated tones. I went to the next office, because Magnitsky’s speech prevented me from concentrating. From there I heard the noise and words of the patient ... Magnitsky said: "They will kill me here now, I am innocent in this matter, why they brought me here." I looked into the office, saw that he was running around the cage, covering his face and head with a plastic bag, as if fencing off some people, then he took his hands with a wooden couch and begins to beat her on the grill. Having suspected that the patient had acute psychosis, I ran to the headquarters, the duty officer caused an enhanced convoy. At 19.30, I called the ambulance service, then went to the patient, there were already handcuffs on it, after which I went up to my workplace in the surgical department. At about 21.20, I received a call and reported that the patient was ill ... I ran along the corridor of the prefabricated department where the cameras were located ... Magnitsky lay on the floor, the paramedic on duty made artificial ventilation of the lungs with a bag of an outpatient room ... I ordered that the patient urgently carried it to the surgical department to the fifth floor ... The effect was not given the effect, and at 21.50 was at 21.50. Clinical death has been stated. ”
“There are great doubts that there were some resuscitation measures,” says an anesthetist Timur Huseynov. “An indirect heart massage in an adult man of hypersthenic physique leads to damage to the ribs, the pathological examination did not find them.”

From the protocol of the interrogation of Vitaly Kornilov, a psychiatrist of the on-site brigade of ambulance psychiatric care (he arrived at the pre-trial detention center at 20.00, but he was allowed to the territory at 21.00): “A medical worker left for the patient, but a few minutes later returned and explained that the patient died. Biological death occurred 15 minutes before our examination ... "
And the psychiatrist Kornilov, and the paramedic of the ambulance of frosts, and the employee of the "sailor" silence of the plowmen, they say that Magnitsky died at 20.50–21.00. And only one Gaus claims that he stated his death at 21.50.
Dangerous questions
Why did the surgeon Gauus not be interested in whether the psychiatrists came, whom she called at 19.30? Why didn’t she go down to the patient at 20.00, when, according to the testimony of Dmitry Markov’s pre -trial detention center, the handcuffs from Magnitsky were removed, since he had already calmed down? Experts of the international organization “Doctors for Human Rights”, having familiarized themselves with medical documents, came to the conclusion that Magnitsky’s behavior “more like the consequences of toxic shock” than psychosis. They did not exclude that his death could occur "as a result of poisoning by any substances besides controlled (opiates, barbiturates)."
According to the notes of the GAUS in the medical history, during resuscitation measures to Magnitsky, an injection of adrenaline and atropine under the tongue was made. Professor of the Department of Anesthesiology and Resuscitation N.E. Burov, in the conclusion of May 6, 2010, notes that “the introduction of drugs into a sub -language area is an acceptable but forced extreme measure ... This technique was used in the distant past and is now perceived as an anachronism ...”
According to experts from the organization “Doctors for Human Rights”, a chopped wound in the language should have been submitted to a toxicological study. According to the protocol of the corpse of Magnitsky, this was not done.
