
The Supreme Court of the Russian Federation recognized the asleep of the Moscow City Court to civilian spouses Nikita Tikhonov and Evgenia Hasis, convicted of the murder of lawyer Stanislav Markelov and journalist Anastasia Baburova.
The cassation appeal of the defense of Tikhonov and Hasis, which contained a request to cancel and send the case for a new consideration, was dismissed, Interfax reports. Thus, the sentence against Tikhonov and Hasis entered into force, and in the near future they will be transferred to various colonies, where Tikhonov, according to the sentence, will spend the rest of his life, and Hasis - 18 years.
The defendants took the decision of the RF Armed Forces calmly. They participated in a meeting on the video.
Currently, the court announced only the resolution of the decision, therefore, nothing is known about the motives with which he was guided by. The representative of the victims Vladimir Zherebenkov said that he was satisfied with the decision.
In turn, the defense of convicts announced the intention to appeal the verdict in the supervisory instance of the RF Armed Forces and the European Court of Human Rights. In their cassation appeal, lawyers listed, in their opinion, in their opinion, in the proceedings in the Moscow City Court of numerous procedural violations.
In particular, they accused one of the jury of illegally collecting information on the defendants. At the same time, the requirement to remove him from the process was left without satisfaction. Tikhonov also considers another violation in the Moscow City Court the transfer of the case from one judge to another, who, moreover, allegedly arranged the defendants after his personal data appeared on the Internet. In addition, the judge refused the lawyer to represent Tikhonov's interests.
The defendants did not admit the guilt of the murder. Tikhonov pleads guilty only in the illegal storage and trade of weapons, as well as in the use of fake documents.
The defendants also stated that they consider the sentence to a disproportionate crime. In particular, Hasis noted that, having recognized her by the accomplice of the murder, the court gave her a year more than a prison term than the Killer of the “Orekhov” group, found guilty of more than 30 murders.
The lawyer Markelov and the correspondent of Novaya Gazeta Baburov were killed on January 19, 2009 in Moscow at the Kropotkinskaya metro station. In connection with the murder, members of the nationalist organization "Russian Image" Tikhonov and Hasis, which are in a civil marriage, were detained. Tikhonov was recognized as the direct killer of Markelov and Baburova, and Hasis - an accomplice in the murder. On May 6, the Moscow City Court, on the basis of the indictment of the jury, sentenced Tikhonov to a life imprisonment, and Hasis to the 18 years of the colony. In addition, according to the court’s decision, two million rubles were recovered from the accused in favor of the Baburova family, which the parents of the murdered journalist intend to spend on the organization of the daughter of a charity foundation.
