Vladimir Kara-Murza: The Pechersk Court of Kiev sentenced ex-Prime Minister Yulia Tymoshenko to seven years in prison, finding her guilty of abuse of authority when concluding gas contracts with Russia in 2009. For three years, she will be forbidden to occupy government posts. The court also ordered Tymoshenko to pay Naftogaz compensation in the amount of $ 187 million.
Soon after the announcement of the sentence Tymoshenko, Ukrainian Prime Minister Nikolai Azarov promised to reach a compromise with Russia to revise agreements within 10-15 days.
Russian Prime Minister Vladimir Putin does not really understand, for which Yulia Tymoshenko gave seven years in prison. He stated this at a meeting with reporters in Beijing.
In recent weeks, American and Western European diplomats have warned that Tymoshenko’s sentence to imprisonment would make Yanukovych Persona Non Grat in the western capitals and question the agreement on freedom of trade and the association between Ukraine and the EU.
The day before, at a meeting of the EU foreign ministers, a list of possible measures was developed in response to the verdict of Yulia Tymoshenko. The Supreme Representative of the EU for Foreign Affairs and Security Policy Katherine Ashton said that any verdict in the Tymoshenko case will affect the relationship of Ukraine and the EU
We discuss Yulia Tymoshenko’s conviction with Ukrainian parliamentarians and Russian politician Fedor Shelov-Kovedyaev, the former First Deputy Minister of Foreign Affairs of the Russian Federation. Do you think Yulia Tymoshenko’s verdict is political?
Fedor Shelov-Kovedyaev: I think that there can be no different opinions about this. It seems to me that the political moment in the decision is certainly present, given the tough opposition relations between the political force, which Julia Vladimirovna headed and leads, and the political force represented by the President of Ukraine. Their personal not very calm relationships, the whole atmosphere that was around this process and which preceded it. In any case, I think, to those who undertake the opposite will be quite difficult to justify their point of view. I would like to say that I think that this is a rather unsuccessful situation, since all this is due to the fact that the current government of the Ukrainian government claims to revise gas supplies and paradoxically, Prime Minister Azarov said that within 10-15 days, that is, during the period that is allocated to filter the appeal, he hopes to resolve this dilemma. That is, again, a political signal is again given, apparently, to both the European Union and the United States, and of course, towards Moscow, that in the event that someone presses us and we will make concessions to the Ukrainian side or, for our own considerations, will make concessions to the Ukrainian side, because we have already heard that Vladimir Putin is in some disbelief about the decision, then it may be in some way The decision that the Pechersk court made in the appeal may be revised in the Court of Appeal.
It seems extremely unsuccessful to me that in general, such political turbulence always existed around the figure of Yulia Tymoshenko and the gas problem. We remember that our Russian prosecutor’s office also opened against her, after certain decisions that took place in Kyiv, it suddenly turned out that the prosecutor's office had no complaints about it. Now, it seemed to me that if we, in a sense, considered Julia Vladimirovna a man who attach great importance in Ukrainian politics, we could also take a more clear position in this matter, however, we completely allowed the situation to develop the way it develops. That is, there is clearly some backstage, and I don’t want to say, I have no information, some scenes and not very glict smelling, I would say, the mood and actions of various sides.
Vladimir Kara-Murza: How did her like-minded people perceive Yulia Tymoshenko’s verdict?
Sergey Sobolev: You know, I think it was an expected sentence. Since it is clear that for Yanukovych revenge is the main thing. I was pleasantly surprised by another. I heard your comment, but you will not agree, probably with the fact that in fact Tymoshenko was able to unite all the leaders of the world, and different political beliefs. And Yanukovych left one ally - this is the full -time clown of the Kremlin Mr. Zhirinovsky, the only person in the world that Yanukovych supported. You look if today two leaders of the United States of America, representing the Republican and Democratic Party, both presidential candidates, Liberman from the Democrats, McCain from the Republicans. If the statements have made identical Europe and Russia. Who else could unite? If the same statements were made by the Russian opposition, similar to Putin's statements. Therefore, I think this is a unique phenomenon.
Everyone understands that if the whole world pays at market prices for gas, why does Ukraine not pay at market prices, why should it have any preferences? Therefore, I think, everyone miraculously understands that the decisions that were made in January 2009 were actually decisions that were absolutely economically defined. They were decisions when we must pay for oil products at the same time, we must pay for gas at a global price, there can be no exceptions. Therefore, I think that this process will put its dots over I, I think it will not be in Ukraine - it will be in the European Court in Strasbourg. Although today Yanukovych was scared and backward, he immediately made an unfavorable statement, which will most likely change the Code of Criminal Procedure, and the appeal will change the decision. Although, I think that Yanukovych will not help. It falls into complete prostration, his policy is not supported by anyone in the world. And this, unfortunately, leads Ukraine to the analogue of the Belarusian policy of the Belarusian President Lukashenko. Therefore, Yanukovych has already known the fate.
Vladimir Kara-Murza: On our direct telephone communication, Valery Konovalyuk, the deputy head of the Party of Regions in the Verkhovna Rada of Ukraine. As in your opinion, can Yulia Tymoshenko’s sentence be considered final, given the unanimous indignation of the world community?
Valery Konovalyuk: You know, it is certainly possible to consider him finally, like all the processes in Ukraine, such an absolutely non -cycle political struggle, which for 20 years has been holding a country at such a level of development, without reforms, without serious changes, transformations of democratic in society. In my opinion, if we discard the pathos, which was literally my colleague Sergei on the air, then, of course, we can talk about a large -scale information war against Ukraine today, about absolutely incorrect actions of law enforcement agencies. Because I would be the first to welcome if the court took place in relation to criminal offenses, abuse of power, corruption, fraud that took place. Because I have been in the last five years in opposition and repeatedly demonstrated documents that speak of serious violations by the current government, headed by Tymoshenko. And therefore, all this looks like a political reprisal.
But at the same time, I wanted to note that our opponents had five years to really reform the judicial system and law enforcement agencies, and fulfill the conditions that concerned European integration of Ukraine. Therefore, time was mediocre on constant clarification of relations. You remember very well what happened in the relationship of Yushchenko and Tymoshenko. Against the background of all these relations, which was the level of corruption in Ukraine. And here, it seems to me, this farce will end only one thing - the country will lose in terms of prospects, from the point of view of the ability to consolidate Ukrainian society around reforms and transformations today. Therefore, I think that this is not the last point in this story. I am sure that the whole situation that is associated with the trial in the Pechersk Court, it will certainly be more to carry for us, for Ukraine, negativity.
Vladimir Kara-Murza: Let's listen to how Russian Prime Minister Vladimir Putin reacted to the news of Yulia Tymoshenko.
Vladimir Putin: Tymoshenko did not sign anything, contracts are signed at the level of business entities - Gazprom and the counter -partner of Ukraine. The most important thing is that these commercial contracts are signed in full accordance with the laws of Russia and the laws of Ukraine and international norms.
Vladimir Kara-Murza: Oles Donia, the head of the Center for Research of Political Values, the People’s Deputy of Ukraine from the Bloc "Our Ukraine-People’s Self-Defense", joined our conversation. How did your political like -minded people perceive the verdict, today issued by the Pechersk court of Kyiv?
Oles Donia: politicians, most politicians, most political experts regarding this trial have no doubt. This trial has nothing to do with justice, with the justice of the judicial system. This is pure political repression. We can say about three aspects why this happened. Two psychological moments and one political. The first psychological moment is, of course, revenge. Viktor Yanukovych's revenge for insults, for confrontation, including the personal nature of the insult, was called "Pahan", "Zekom", "Ham", that is, he has a personal resentment against Yulia Tymoshenko, Yuri Lutsenko. The first point is psychological - this is revenge. The second psychological moment is Viktor Yanukovych is very complex because of his criminal records, he believes that his opponents of a higher rank and, of course, would be more comfortable if they had also had a criminal record. The second point is psychological - this is the complex of Yanukovych.
The third moment is political, it is more serious, associated with fear, with fear. The regionals and Viktor Yanukovych headed for perpetuating power, for eternal power, they are not going to what they took, to give in any parliamentary and political elections. Therefore, political opponents are terrible for them as political competitors. Yulia Tymoshenko, as a stronger rival in the next parliamentary or presidential election, is terrible for Viktor Yanukovych and even more terrible than the Western reaction, which has recently shown quite clearly that he was standing for the cessation of political repressions and, in particular, against this trial. If we analyze these aspects, we will see that Viktor Yanukovych did not have any other option, how to wrap Yulia Tymoshenko, he did not represent real democracy and real political competition for himself.
Vladimir Kara-Murza: In your opinion, is it typical that Vladimir Putin is not mentioned in the sentence and the Russian side, which was a partner in this gas transaction, is not mentioned in a word?
Fedor Shelov-Kovedyaev: Firstly, I must once again say that this decision, adopted at the beginning of 2009, was responsible. Therefore, if really, as everyone is now dumping, Yulia Tymoshenko pushed him, then she is well done. Because if this decision had not been made, gas would not only be in Ukraine or Ukraine, gas would not be in Western Europe and Central and Eastern Europe, and this would be a huge completely conflict that could go beyond the exclusively economic conflict. Because we all remember that it was a period, a very acute period of the first wave of global crisis. Just imagine all the consequences of the lack of agreements, I think, is difficult. Therefore, to judge a person in general for the correct courageous decision seems absurd to me. And in this situation, to mention Putin or mention someone else, as Putin mentioned that the agreement was signed between two companies, and that was really so. It is clear that the government takes part in all this, the government always takes part in this kind and such a scale of transactions.
But then, in general, there is a difficult precedent, associated with the fact that it may still want to find in another country the president or the prime minister or anyone else may want to find the same kind of claims to their political opponents. In the end, we recently saw how Sarkozy was dealing with his possible competitor in the Strauss-Kan elections using a completely opereta story, which, like operetta, looked from the first moment of false charges against the head of the International Monetary Fund. That is, in general, this is all the dubious moral background, which is preserved in big politics, it is very dangerous.
And in this sense, I would like to mention that it is great, that world leaders, first of all, European and North American, so closely monitored this process and so zealously, warmly and sincerely oppose political repression in Ukraine. However, there is another country where political repression is more than enough, where there are political prisoners recognized even by the State Department of the United States, I mean Georgia. In particular, there is my personal friend who has been serving for the situation for four years, when he was dragged out of the car on Rustaveli Avenue, his hands broke, injected methadone and then accused him that he was using drugs. Moreover, the investigators who conducted his case are already sitting, who supported the state prosecution, is also sitting. That is, this situation is absolutely clear to everyone, nevertheless, even now there, he was appointed 8 years, he had already left for half the term. There are other political prisoners, just dozens in Georgia, with whom Saakashvili straightens in exactly the same way as with my friend, who simply entered the confrontation in this case with economic interests, the corruption interests of Saakashvili and, nevertheless, no one. Therefore, here we must still be morally consistent.
Vladimir Kara-Murza: Do you agree that you can explain the verdict of Yulia Tymoshenko partly by the motives of personal revenge of President Yanukovych?
Sergei Sobolev: I'm just sure of this, because there is no logic. If the logic was in preserving his political face, Yanukovych would never have gone to such a step. You know that he catastrophically loses his rating in connection with things, when he actually lobbles the interests of the largest corporations to the detriment of both Chernobyls and Afghans, and other categories of socially unprotected citizens. On the other hand, you imagine: elections: in Russia on the eve of parliamentary, then presidential, so that Putin was dealt with with Kasyanov or Nemtsov, Kasyanov, too, would be the prime minister, and plant them, abandon them using his pressure on the courts and straightened with the opposition. Yes, no one could afford. Only Lukashenko allowed himself. That's why I say that in this situation we were unique.
Vladimir Kara-Murza: As you think, will the Ukrainian society split today?
Valery Konovalyuk: The question is quite difficult. I think that today is just more an external reaction to this event than inside the country. This was evident by the number of supporters who were in the center of Kyiv today during the sentence in the Pechersk court. My opinion is a little different, not quite coinciding with the main position, including our fraction of the Party of Regions. Because I am a long -standing opponent of Yulia Tymoshenko, a political opponent with many years of experience and, believe me, has repeatedly demonstrated documents on serious financial fraud, theft, when it came to recapitalization, refinancing Ukrainian commercial banks or financial crisis, how many money was laid out and how many thousands of deceived deposits remained, their problems were not resolved until today. When budget funds were spent on exorbitant prices for the purchase of medical equipment, when the pandemic raged in Ukraine, people were dying. And all this passed through structures close to the ex-Prime Minister Tymoshenko. And a lot of other examples. Therefore, the fact that it looked like a political process, in this, obviously, there is a direct fault of the current government, the current law enforcement agencies. Because it was necessary to exclusively concentrate the investigation, the more we attracted serious American legal companies. One of them actually investigated, and Ukraine sued, received about 19 million dollars.
The question is not just in claims, we are talking about serious responsibility not only of political, but, obviously, criminal, since there were serious violations and financial frauds with budget money, abuse, which concerned the serious consequences that our country survived. Therefore, here I want to sincerely say that I would not envy anyone, I would not want to be in the place of Yulia Tymoshenko, but every person, each official has a choice, either strictly comply with the requirements of laws and constitutions and not try to live at the expense of the state, at the expense of the state budget and fulfill its own duties.
Therefore, here, I think, the question, of course, is not easy for us, this will entail serious consequences, I believe that the political consequences including. As we can convince from this state, to prove that this is nevertheless connected with professional activities, not so much with political as directly heading the governments. In my opinion, of course, these will be some certain trends that concern the upcoming parliamentary elections next year. Whatever the law we adopt and no matter how the Venice Commission appreciates it, if the leader of the opposition does not participate in the elections, this will certainly cause certain issues today to the state of our democracy and the ability to fully form state institutions, including the opposition. I am one of those who introduced the bill, he was in the form of a regulation in parliament, to legislatively determine the rights and status of an opposition in the country. I think that we must return to this, and yet in this situation, without any political speculation, one thing is to say one thing, that it really is not entirely correct, that it was everything that was transferred to the plane of the prime minister’s position in signing gas contracts. Of course, there would be fewer questions in the world community if there really were criminal prosecution under specific criminal articles, I mean corruption and theft, abuse. I think that in this regard, of course, we have to rethink a lot, but including the opportunity to appeal to the highest court today, an appeal will be filed today, Yulia Tymoshenko and its defenders have.
Vladimir Kara-Murza: Sergey Markov, member of the Duma Committee on CIS Affairs and Relations with Compatriots, sees the selectivity of the law in the case of Yulia Tymoshenko.
Sergey Markov: This is both a judicial and a political decision. In this sense, the process of Khodorkovsky is reminiscent. She, of course, is guilty of numerous violations, not only in those that she will be incriminated, but in others and in the same guilty, no doubt, a huge number of officials in Ukraine acting and former, there is anyone to plant for. Why did Julia Tymoshenko choose? The political reason lies in the desire to strike at gas agreements with Russia, and that the authorities, it seems to me, is afraid of Yulia Tymoshenko. After all, she twice by force illegally pulled power from Viktor Yanukovych, in fact she made a coup in the form of an “orange revolution”. I believe that then Yanukovych, of course, won the election and, of course, not Tufyak Yushchenko pulled out this power from him, but the tough Yulia Tymoshenko, who led this mattress Yushchenko. Of course, they remember this. I think that they consider her a witch who can conjure and witchcraft to take power from them, and possibly property.
Vladimir Kara-Murza: As you think, does today's sentence consolidate the Ukrainian opposition?
Oles Donia: Today, all the main opposition political parties in Ukraine have made almost identical statements, where they condemn not only this decision of the judiciary, but believe that these are political repressions that are not from the court, but from Viktor Yanukovych. And which is very important, the Resistance Committee for the dictatorship, which was created before August 24, that is, before the Independence Day of Ukraine, and which includes 12 Ukrainian political opposition forces, made an approximately the same nature with a joint statement. Let me remind you that the three opposition political forces that have electoral chances, the chances of sociology overcome 3% of the electoral barrier, are included in this dictatorship resistance committee.
Vladimir Kara-Murza: As you think, Russian diplomacy should respond to this judicial reprisal, as the Ukrainian opposition is expressed over Yulia Tymoshenko?
Fedor Shelov-Khovedyaev: It’s good that you ask a question in such a rationalistic manner after we suddenly Sergey Markov painted the picture more likely in the style of such a Gogol fairy tale, although in fact it was right, but these situations with witches and with everything else, of course, seem to me, are some overexposure. I would have believed that with regard to the gas issue, we must show firmness, we have no reason to make other decisions for economic reasons than those that we had adopted. And I am not very clear that we will get in return if we make a concession to the current Ukrainian government. As for the political assessment, I think that it has already been given, and this concern, which was expressed by representatives of our political class, including the most high-ranking representatives of this class, it can be developed in some diplomatic actions in a concert with our friends, with our allies in the West.
