The Russian Ministry of Health and Social Development proposes to amend the law on the protection of consumer rights in order to improve the protection of the rights of consumers of financial services, including issuing loans and issuing insurance.

The bill clarifies such concepts as “goods”, “work”, “service”, and also contains a definition of a financial service: this is “a service provided by a credit organization (bank), an insurance organization (insurer), as well as a service in which money act not only as a means of payment.”

The draft law also requires that information about goods (works, services) must contain an indication not only of the contractor, but also of the agent and the paying agent.

Information about financial services should be provided to the consumer only in documented form. In this case, the provision of documented information must be confirmed by the consumer’s handwritten signature.

It is also clarified that the consumer’s demands for payment of a penalty (fine) provided for by law or contract are voluntarily satisfied by the manufacturer in a pre-trial manner (the previous wording is “voluntarily”).

In addition, a clarification has been made to the wording of the article, according to which, if the manufacturer has not satisfied the consumer’s demands in pre-trial order, then the court, upon satisfying these demands, will collect from the manufacturer in favor of the consumer a fine in the amount of 50% of the amount awarded by the court in favor of the consumer.

The bill also states that the seller does not have the right to additionally perform work and provide services for a fee without the consent of the consumer.

The consumer has the right to refuse to pay for such work and services, and if they are paid, may demand the seller to return the amount.

The provision of financial services, including each financial service within the framework of a mixed contract, must be carried out only with the consent of the consumer in writing, the bill says.
