The Tverskoy District Court of Moscow on Monday remanded Natalya Gulevich, a businesswoman suffering from serious illness, in custody until December 2. reports this RAPSI .

The total term of arrest for Gulevich, accused of fraud on an especially large scale, will be 12 months, her lawyer Andrei Shtanko said.

Despite the critical state of the businesswoman’s health, the court considered the investigator’s arguments that, if free, Gulevich is capable of absconding from justice and putting pressure on witnesses, sufficient to extend the harsh preventive measure. According to prosecutors, there is no negative trend in the accused’s well-being, so another month of arrest will not lead to tragic consequences.

The Tver court, therefore, ignored the position of a higher authority: last week, the Moscow City Court upheld the lawyers' complaint about the illegality of holding Gulevich under arrest, while requesting a record bail of 100 million rubles. The defense on Monday petitioned to reduce this amount to 7 million rubles. The defendant’s husband, Valery Gulevich, explained that famous bloggers helped him raise money.

The businesswoman herself stated that she was paying “with her health for the raider takeover of Nomos Bank.” “I have lost two organs, my kidneys are failing,” Gulevich reminded the court, assuring that she is not going to hide and plans to “justify herself.” According to her, release is necessary to begin a full course of treatment.

Lawyer Anna Stavitskaya petitioned to interrogate Gulevich's husband as a witness. That, according to the defense lawyer, could testify to the financial situation of the family, which would give the court an idea of the impossibility of posting a bail of 100 million rubles. Stavitskaya also asked that documents about Gulevich’s health condition be included in the case materials - a urologist’s conclusion, according to which the catheter can remain in a person’s body for no more than three weeks, while for the defendant this period has already stretched for eight months.

The court granted the second request, but refused to question the accused’s husband.

Gulevich has been walking with a catheter for eight months due to bladder failure. The cause of the illness has not yet been determined, the diagnosis has not been made, and treatment has not been prescribed.

The businesswoman insists on her own innocence of the crimes accused of her. Her arrest caused widespread resonance. Human rights activists have repeatedly expressed fears for the life of the defendant and did not rule out a repetition of the tragic story of Sergei Magnitsky.

Gulevich in 2005, being the general director and shareholder of ZAO SE Status, took out a loan from Nomos Bank. In 2008, she agreed on a refinancing. As collateral, in addition to the building, the bank demanded that 100% of the group’s shares be transferred to an affiliated organization, Tren LLC. It followed from the agreement that upon payment of the $10 million loan, Gulevich would return 100% of the shares of Status. Despite the fact that the debt was mostly repaid, in 2009 the creditor revoked the businesswoman’s power of attorney to manage the company. In August of the same year, the bank brought an armed private security company into the territory of the Status complex.

A criminal case against Gulevich was initiated in July 2010 under Part 4 of Art. 159 of the Criminal Code of the Russian Federation (fraud). The accused has been in jail since December 2, 2010. Her defense has already filed a complaint with the European Court of Human Rights.
