After the campaign at the Tver court, Matvey Krylov shines a two -year term, but he says that he does not regret
The prosecutor's office will not forget, he will not forgive. The activist of “Other Russia” Dmitry Putenikhin, more known under the pseudonym Matvey Krylov, was charged with a threat to the representative of the authorities on November 8. He faces up to two years in prison, for, according to the defenders, petty hooliganism. As an ordinary administrative violation, it was drawn to a criminal article - the New Times was versed
A drop for the prosecutor
When Matvey was charged, he was transferred from the IVS on Petrovka to the Butyrka pre -trial detention center. Here, if the Moscow City Court does not satisfy the appeal, it will stay at least until December 30 - this is the decision of the judge of the Tver court of Moscow, the sadly famous Elena Stashina. On October 28, all in the same Tver court sentenced the participants in the clashes on Manezhnaya Square. Three Krylov’s associates in “other Russia” Igor Berezyuk, Kirill UNCHUK and Ruslan Khubaev received from 3 to 5.5 years in prison. When the prosecutor Alexei Smirnov finished his comments on the porch of the court building to reporters, Matvey Krylov grabbed a bottle of mineral water standing next to him and splashed it in the face of the prosecutor, shouting the well -known National Sloga “We will not forget it, we won’t forgive!”. The Internet bypassed the video of this episode, but Alexei Smirnov, wiped, returned to the court building and wrote a statement: supposedly his life was threatened and the activist actually shouted “Death to the prosecutor!”.
After that, Matvey Krylov was detained, however, the first days friends and relatives hoped that the maximum that he was threatened with was 15 days of arrest under Article 20.1 of the Code of Administrative Offenses (“petty hooliganism”). The “administrative”, however, quickly turned into a “criminal” - Article 296 of Part 2 of the Criminal Code, “threats or violent actions in connection with the administration of justice or the production of a preliminary investigation”. At the trial, the activist told Elena Stashina: “You know how much they write and talk about you.” “We have such a profession,” Stashina answered. “You finally have a chance to do at least something good,” said Matvey, but the judge, who was famous after the case of Sergei Magnitsky and his entering the list of Senator Cardin ** ** List of Russian officials involved in the death of a lawyer of the Hermitage Foundation, who Benjamin Cardin proposed to close the entrance to the US Videos. The reason to send Krylov in the pre -trial detention center was his involvement in the prohibited NBP, as well as the fact that only a few days before the incident with the prosecutor Smirnov, he ended a two -year conditional term. “It is all the time, when it comes to politically motivated processes, activists for obviously administrative offenses are attracted to criminal articles,” says lawyer Dmitry Agranovsky, who has repeatedly had to be protected in the courts of the National Bolsheviks and Nationalists. “Always, when the National Bolsheviks concerned, and now the activists of another Russia, the persecution was as cruel as possible: they are arrested for the period of the investigation, they are judged by significantly more socially dangerous articles.” It resembles the processes of the participants in the capture of the reception of the Minister of Health Mikhail Zurabov and the presidential administration in 2004. In the first case, the seven National Bolshes received from 2.5 to 5 years. The second process received the symbolic name “Case 39”, it was still the same Elena Stashin, and the now famous Alexei Smirnov supported the accusation. For 31 activists, the court ended with conditional terms, eight received from 1.5 to 3.5 years in prison. “In fact, all of them were then condemned for mass riots in the territory of one room,” recalls Agranovsky. - Even earlier, on May 14, 2003, Stashin condemned the National Bolsheviks of Alexei Golubovich and Evgeny Nikolaev for three years of each. Allegedly, during the rally, they beat a police officer. As now, in the story with Matvey Krylov, I tried to prove the innocence of my clients on the basis of the video that journalists of the M endeonian program made: it clearly shows that the lieutenant really beat, but completely different people beat. For Judge Stashina, however, this is not an argument. ” According to Agranovsky, the first “feat” Stashina in his memory is the trial of activist Armen Beniaminov: he raised the red flag over the State Duma on November 7, while the tricolor even remained on the flagpole. But according to the 329th article-an abuse of the state flag-he was found guilty and gave conditionally a year.
Activist from the hinterland *
In January, Matvey Krylov will turn 23 years old, and so far it is not clear, he will celebrate this holiday in the wild or in a pre -trial detention center. Matvey was born in the small South Ural town of Gai (Orenburg region), the main attraction of which is a mining and processing plant. He studied nine classes at a local school, then went to college in a much larger Orsk, but at the first opportunity, without relying, he rushed to Moscow. “A few months ago, we went to his mother in Guy,” says Ira Tokai. -Some of his classmates have already died of an overdose, someone is sitting, the most “successful” are quietly drunk in anticipation of when they sit down. When we were just starting to meet and walked around Moscow, he often said that he wanted to enter the Gorky Literary Institute. As soon as it comes out, I will immediately send his education. I have already handed him a lot of books in a pre -trial detention center, I hope he will spend this time with benefit, otherwise the last year I read only Twitter tape on the phone. ” "
He was reflexively sorry: what was shining in the future of the current realities? The thought loomed that such did not live for a long time. For the system, he is a subject requiring breaking
“Krylov met with the National Boodles in Orsk and moved to Moscow, as they say, along the party line. Then the NBP, whose activists were already put in prisons with might and main, was still able to help their supporters move to the capital. On June 2, 2008, when hearing in the case of one of the party leaders, Vladimir Linderman (Abel), fifteen“ Limonovites ”, among the Limonovites, in the midst which was Krylov, the Ministry of Foreign Affairs broke out of the windows of the Med -Trainer, after a year and a half, on October 26, 2009, the same Elena Stashin sentenced him to one year with a trial period of two years, who had been convicted of Matvey for a year, who had been convicted now for the same two years. He did not accept participation, he came to the police department monthly, revived the Mayakovsky Readings - when activists on the last Sundays of each month gathered on the triumphant square and read their poems, released “Collections of Non -Long Poetry”, participated in the IV Biennale of Modern Art with work in support of the convict “Strategy 31” Sergei Mokhnatkin. As soon as Krylov’s trial period has expired, an incident with the prosecutor Smirnov occurred. Until his detention, Matvey worked as a producer in the program “Wait for me”. But when his wife came to his work to receive a certificate for his employment for the court, Matvey instantly turned out to be dismissed.
General practice?
The peculiarity of the case of Krylov: the attack was not a public politician, which the National Economic Council often practiced before, but the official in execution. “In any country in the world, if an attack on a representative of the state is performed in execution, this will be punished in a particular version,” says lawyer Anna Stavitskaya. - Another thing is that it is necessary to understand the actions of each particular person, and if he really did not shout “Death to the prosecutor!” Of which he is accused of, then this is rather an administrative offense. The task of protection is to prove this to the court, especially if there is such irrefutable proof in hand as a video. ”

Pavel Chikov, Chairman of the Interregional Human Rights Association of Agora, believes that the practice of pulling administrative misconduct on criminal articles in the country has not yet become a typical country. “But in political affairs, although such vocabulary is alien to the legal language, this happens all the time,” says the human rights activist. - Matvey Krylov, in our opinion, committed petty hooliganism and, possibly, earned 15 days of arrest. His business is on a par with business against activists of the War of the Art group for the “Palace Country” campaign *** In October 2010, activists turned several police cars over the night in the Mikhailovsky Castle, Embankment Moika and Fontanka in St. Petersburg .. Yes, there was a petty offense, but the decision to institute criminal proceedings should be compensated for the 2133rd The article of the Criminal Code (“Hooliganism”) was a clear bust, the case eventually collapsed. The same applies to processes in unrest in Manezhnaya Square. ” According to Chikov, after the initiation of a criminal case, law enforcement officers also faced a huge fork: they have to decide how difficult the offense is and under what article to incriminate it. If the investigator desired from hooliganism, one step to terrorism, and from terrorism to the threat of state security. “For example, after the explosion at the FSB Academy in March 2011, the case was opened under the article“ Hooliganism ”, and when in February 2010 someone blew up some kind of trolley near St. Petersburg-under the article“ Terrorism, ”Chikov recalls. - Another example of such a fork: some detainees on shares are drawn up under the article of the Code of Code of Code of Charioid Code 19.3 “Disobedience to the legal requirement of a police officer” - and this is up to 15 days; They can write about others that he hit an employee-and this is the 318th article of the Criminal Code “Application of violence against a representative of the authorities”, according to which Sergey Mokhnatkin received 2.5 years. And now the case of an anarchist is being investigated, allegedly involved in the undermining of the DPS post on the Moscow Ring Road. When detaining, she poked a policeman with a knife - and this is in theory up to 10 years. But when checking, it turns out that two in civilian clothes approached her on the street, did not introduce themselves and, without saying anything, dragged them to the ambulance parked right there. What should a person have a reaction? Yes, she took out some kind of knife and poked the attacker to them. "

Close Krylov fears that closer to the trial they will try to “glue” some more accusation. The last news from the pre -trial detention center: investigators are actively developing a version of the young man’s involvement in the events on Manezhnaya Square. “But Natsik simply cannot be. He has always seen a man of broad views and enemies not in people of another nationality, but in various scoundrels and villains, ”said the young writer from Chechnya Arslan Khasavov, who wrote after the arrest the article“ Save Matvey Krylov ”. Khasavov met an activist of “another Russia” a year and a half ago: “First in LiveJournal, then I came to Mayakovsky Readings, listened and began to read my poems myself,” said the New Times. - Even the definition of National Bolsheviks is not suitable for Dima. Just for young people who want to radically change something in the country, there is no other organization, except for the former NBP, now “another Russia”. In any case, this is not a fundamental question: it went beyond the scope of a separate party and the political struggle in general. He considered the sentence to his comrades unfair and expressed a protest, and he was imprisoned unjustly and presented an article, whose composition is not in his actions. We, his peers - poets, writers, artists, journalists, just sympathetic - must pull him out of there: he is just too honest for today's conditions ”...
In the spring of 2011, the documentary film “Is it easy to be young” was released at the screens in a narrow rental. 18 heroes, 18 frank interviews. One of them is with Matvey Krylov. “We were looking for bright people, met, looked at each other,” the director David Roitberg recalls in a conversation with The New Times. “He is a guy with a position that he may not be afraid to express.” Very desperate, monolithic, uncompromising. It became a pity for me reflexively: what promises him in the future of the current realities? The thought loomed that such did not live for a long time. For the system, he is a subject requiring breaking. Others will grow in fat with age, settled down, but this one. Speak, he got into the alteration? Well, you definitely won’t break it for two years. ”
