Ex-investigator from the "Magnitsky List" extended the arrest for three months

The Presnensky court of Moscow extended for three months - until February 24, 2012 - the term of detention of the former investigator of the main investigative department of the capital's Main Directorate of the Ministry of Internal Affairs Nelly Dmitrieva , accused of a bribe in the amount of three million dollars. Thus, the court granted the application of the investigation.

The day before, the Moscow City Court refused to satisfy the cassation appeal of the defendant’s defense. The upper court decided that the decision of the Presnensky district court should be left unchanged.

Meanwhile, during the hearings on the complaint of Dmitriev through the video, she announced the psychological pressure provided to her in the pre -trial detention center, and her lawyer Alexei Akimov announced the deterioration of her health. His client confirmed: "I felt bad with my heart in a pre -trial detention center, and the doctors arrived only two hours later, for all this time I was offered only two aspirin tablets."

She asked to choose any other measure in her respect, not related to deprivation of liberty, in particular the deposit, house arrest or a non -departure subscription. Dmitrieva also added that in a serious physical condition there is her elderly mother, who in the very near future needs an operation.

However, all this did not help, and the Judicial Collegium of the Moscow Court left Dmitriev in custody.

Nelly Dmitrieva was charged under part 6 of Article 290 of the Criminal Code of the Russian Federation (receiving a bribe). The investigation claims that the accused tried to get a bribe on an especially large scale from businessman Boris Yudin, a criminal case against which she investigated.

According to investigators, Dmitrieva, fearing that she could be delayed with the red -handed, instructed to organize a transfer of bribes to her friend, former employee of the Ministry of Internal Affairs of the Russian Federation, Maxim Kagansky, in respect of whom the court issued a sanction for absentee arrest.

On October 5, the Presnensky court of Moscow authorized the arrest of Dmitrieva, the term of its detention was set until November 24. The judge agreed with the investigator’s arguments that, being at large, the accused could hide from law enforcement agencies, put pressure on witnesses and otherwise prevent the advance of the preliminary investigation, including because "Dmitrieva has legal knowledge."

The defense of the former investigator insists on the unreasonableness of Dmitrieva’s conclusion in custody and will ask her to change the preventive measure for bail or house arrest. Lawyers emphasize that the investigation has no data on Dmitrieva’s intention to hide or destroy evidence.

The case against Nelly Dmitrieva attracted public attention not only because of the large amount of the bribe, but also due to the fact that earlier a number of media reported that she participated in the investigation of the case of the auditor of a large investment fund of Sergey Magnitsky, whose death in jail caused a large public resonance. However, the press service of the Investigative Department of the Ministry of Internal Affairs of Russia refuted these statements.

However, Dmitrieva appeared in the Magnitsky list - a list of Russian officials involved, according to American politicians, in the death of a lawyer in a pre -trial detention center.
