Gazprom can get half of the Ukrainian GTS

Ukraine and Russia plan to create two joint ventures on the basis of the Ukrainian GTS. The first of them is supposed to transfer the main (transit) gas pipelines and underground storages of gas of Ukraine, writes the Ukrainian edition of the Mirror of the Week . According to the publication, Ukrainian negotiators were against the inclusion of Ukrainian PPGs at this stage in the gas transmission joint venture.

This SP will also be endowed with an exceptional, monopoly right to carry out gas transit throughout Ukraine to Europe, which makes it impossible to participate in the transit of imported gas of any other party or company, with the exception of the "daughters" of the gas transportation joint venture itself.

To this, the joint venture also pass the functions of the dispatch control of the main gas pipelines and the GPG of Ukraine.

The second joint venture (conditionally - gas distribution) is planned to be created with Gazprom on the basis of internal gas distribution networks of Ukraine.

The draft document, writes the publication, clearly does not say exactly where the first and second joint venture should be registered. It is possible that this may not be Ukraine or Russia.

Among the points of a possible transaction, the complete legal integrity of the created joint venture is assumed. They will not apply to the possible changes in the tax legislation of Ukraine, or antimonopoly legislation, or any tariff changes, or legislation on public procurement, says the publication.

It writes about the requirement for the Ukrainian side not to intervene in determining the size of the profit (profitability) of both joint ventures. Gazprom and its affiliated structures receive full legal protection in Ukraine, including the inviolability of their property and the impossibility of its forced seizure.

Recall that Gazprom used the similar script in Belarus: Russia promised to provide Belarus with a discount on the supplied gas in exchange for 50% in the Beltransgaz gas operator. Minsk, who found himself in a difficult financial situation, went to this deal.

The “Belarusian version” was also proposed to Ukraine, but there they sharply negatively perceived the proposal for the merger of Naftogaz of Ukraine and the Russian Gazprom, even threatening to disband the company in order to annul the agreements signed by former Prime Minister Yulia Tymoshenko.
