The failure of the observer

Honestly, neither Russian politicians (demonstrated on TV), nor I am categorically admitted to the party’s elections. But the truth of the political moment is even more unpleasant - under the threat turned out to be the (democratic) institution of elections by itself. It was precisely such thoughts that prompted me to participate in the public non -party project “Citizen Observer”.

Here it is necessary to make an explanation on terminology. In addition to the members of the PECs (precinct election commissions) with the right of a decisive vote in polling stations, members of the PSG (an advisory vote), represented by one of the parties, are simply observers (one of the parties) and correspondents from the media. They have a little different rights, but the idea is one - all these are types of public observers.

The main goal of the presence of public observers in polling stations is to prevent violations, to prevent them. Looking ahead, I will say that I could not do this ...

Actually, the idea of ​​a “observer citizen” was to collect caring people, to legally prepare us (I attended three classes) and, having agreed with different parties, collect the mandates of observers and distribute them to us. People gathered an impressive amount, but not too much - there was enough for about 160 sites in Moscow (the idea was to cover 5%that made up the sample).

I was a member of the PEC No. 2124 (Moscow, Yuzao, Zyuzino) with the right of an advisory vote from Yabloko. Milena Borisovna Milevskaya, the head of the passport office department in the Zyuzino district, was the chairman of my PEC. And the observer from United Russia was a representative of the housing and communal services administration from the same council. He was already sitting on the site on the eve of the voting day, when I came to get acquainted with the commission. On most questions, the Chairman of the PEC consulted with him. In addition to me, there were PSG from Fair Russia and from the Communist Party, an observer from the Communist Party and several other correspondents and observers within the “observer citizen”.

Two fatal errors were perfect by observers before the start of the vote: stationary urns for voting were set quite far from the observers' visibility zone, once, and we (observers) did not look at the books with voter lists, two.

Since there were quite a lot of observers, we managed to calculate the number of voters with good accuracy (it was precisely the ballots omitted to the urn): 1115. Plus 9 - exit voting. Total 1124.

After opening stationary urns, 1757 ballots were discovered there, i.e. About 640 ballots were thrown. At the opening of the urn No. 2 (distant), we recorded several folded packs of ballots (there were marks for “United Russia”). I managed to photograph one of the packs. Correspondent N.S. Ulyanova removed the process of spreading the thrown packs to the camera to the camera.

Official results in our site: EP - 820, Communist Party - 286, Yabloko - 230, SR - 222, LDPR - 147, PR - 17, PD - 16, spoiled (invalid) - 28. Especially rude electoral legislation was violated during the vote count.

1. Observers were not allowed to familiarize themselves with the books of voting voters and sealed them.

2. When opening the urn No. 2, the thrown packs of ballots were recorded - the members of the PEC immediately began to pull the ballots on the table and lay them out in packs formed from the urn No. 1. In response to my request to cancel the results of the voting on the urn No. 2, the members of the PEC (right in the process of laying out the ballots) voted against.

3. Even before 8 a.m. 12/04/2011, the PEC decided to prohibit photography differently from the tripod (which contradicts the Federal Law 67 and the CEC resolution of 17.08.2011 No. 26/254-6). On the basis of this filkin letter, the weekend removed the correspondent from the section of the correspondent, who photographed the process of sorting the ballots (unfortunately, the police officers followed the Chairman of the PEC, and they did not listen to my arguments, although they were confused by what I did not know the norms of the law).

4. The Chairman of the PEC refused to consider all the complaints written by me and the PSG members from the SR and the Communist Party of the Communist Party (i.e. just refused to even see the texts of complaints.)

5. There was no final meeting of the PEC: the members of the commission silently signed the protocol and gave the observers a certified copy. About half an hour passed between the counting of votes and issuing copies of the protocol; At this time, the Chairman of the PEC, together with the observer from the EP, left the voting room.

6. In response to my repeated appeals to the Chairman of the PEC demanding to observe the letter of the law (when counting the votes), members of the PEC (all are women) shouted the following: “Legislation, Bl*d, young man, you, damn it, with your norm 31”, etc.

Just in case, I note that all observers came together in the legal assessment of what was happening: members of the PEC with PSG from the Communist Party, SR and Yabloko (this I) compiled a joint act of violations and a complaint to a higher tick.

Now lawyers - volunteers of the Observer project are working on an appeal to the court.

In conclusion, I want to note several characteristic (for the current state of our society) details.

1. For a role -playing game in democracy, we are poorly ready - after three lectures and studying the time of the texts of laws, I knew details of the election procedure and the norms of laws are significantly better than all members of the election commission and what police officers on duty at the site.

2. Not a single precedent is known so that the prosecutors themselves would themselves (on the basis of numerous blog entries, for example) to investigate violations of the elected (and criminal!) Law - this turned out to be more important to volunteers of the Observer.

3. The appearance of a sufficient number of observers (in the future) will divide polling stations into two types: those on which there will be no violations, and those, the results of

Which, due to violations, will not need to be taken into account. So we can calculate the results of any vote, completely ignoring the illusionists from the CEC.
