Yanukovych himself longs for Tymoshenko’s freedom, but will not go to the "crime"

President of Ukraine Viktor Yanukovych said that he himself was interested in the ex-prime minister of the country Yulia Tymoshenko to be released from custody as soon as possible. But he himself will not intervene in this process.

“I am not against Tymoshenko to be released under certain conditions provided for in Ukrainian laws. Moreover, I would like this matter to be completed as soon as possible. I am interested (more) than someone else,” Yanukovych said at a final press conference in Kyiv on Wednesday.

At the same time, the president noted that if he personally intervenes in the issue of the release of Tymoshenko, then this will be a crime, Interfax reports. “It will also be a crime if I begin to abuse my position,” Yanukovych explained.

"The country has the rule of law. And I, as the President,, according to the Constitution, have no right to interfere with the judiciary," he said. At the same time, Yanukovych did not answer the question whether he considers Tymoshenko guilty. “The court decides everything. I will always reckon with the court decision,” Yanukovych said.

“I never want you to replace investigators or judges. I know what it is, and never did it and I will not do it,” he continued. “I cannot take responsibility in matters for which I have no authority.”

“If the law on the decriminalization of the article by Tymoshenko is adopted and the consensus will be in parliament and there will be a question to me whether to sign this law or not, then I will give you a concrete answer. But when the court makes a decision, I always reckon with the court decision, whatever it may be. I want this issue from the political plane to go to legal,” the ITAR -TASS of the Ukrainian leader quotes.

Soon after these statements by the President, the collegium of judges of the Kiev Court of Appeal rejected Tymoshenko’s appeal to her re -arrest in the EES case, issued by the Shevchenkovsky district court.

When the presiding judge Olga Efimova still in the motivating part of the decision said that when making a decision, the court of first instance took into account every reason, the defender of the ex-Prime Minister Sergei Vlasenko began to shout: "Just animals! Take off the badges! Clean creatures!" After that, about 10 deputies of the Bet-Babyvshchychy faction, which were present in the meeting room, began to loudly chant the word "fascists", trying to prevent the announcement of the decision, Interfax reports. But this did not help.

The appeal was considered without the participation of the defendant at the hearing. Judge Efimova said at a meeting on Wednesday that on December 20, Tymoshenko received a statement that she was asking for an appeal in her absence, reports Newsru.ua with reference to the press service of the Batkivshchina party, the leader of which is Tymoshenko.

Her lawyer agreed with the position of client, and the court considered it possible to consider the appeal in the absence of the ex-Prime Minister. Vlasenko did not declare any petitions on Wednesday. At the same time, the lawyer expressed indignation at the actions of the presiding judge who read not the entire text of Tymoshenko’s statement, and he himself quoted the part of the statement that Judge Efimov refused to read out.

“Since the decision will not be made by this court and not based on the results of the trial, but in the Yanukovych’s office, I ask you to hold the so -called meeting in his absence,” he read Tymoshenko’s statement.

Before the meeting, Vlasenko explained to reporters the absence of Tymoshenko in court. According to him, the ex-Prime Minister understands that "everything that happens here is a complete farce and the decision is not made in the courtroom." “Therefore, it makes no sense for her to attend, at least when considering this issue (about re -arrest),” the defender added.

Recall that on the eve, the next meeting of the Court of Appeal in Kiev on Tymoshenko’s complaint about the “gas case” , according to which she received seven years of prison, turned out to be quite scandalous.

Tymoshenko at first wrote a petition to the leadership of the Lukyanovsky pre -trial detention center, where she was contained, with a request to deliver her to court. However, on Tuesday, when the car carrier with her almost drove up to the court building, she asked to take her back , citing severe back pain.

Jailers say that Tymoshenko does not complain about health

At the same time, the State Penitentiary Service of Ukraine states that on December 21, the Medical Commission of the DPTS of Ukraine examined Tymoshenko. "There were no complaints from the prisoner; there were no contraindications for her participation in the court sessions by doctors," the agency said in a statement.

At the same time, the document notes that "Tymoshenko in writing refused to participate in the planned meeting of the Kyiv appeal court today, which the indicated court was informed about the personnel of the Kyiv pre -trial detention center."

Currently, Tymoshenko continues to be in the medical unit of Lukyanovsky pre-trial detention center. The state of her health is controlled by the medical staff of the institution.

Earlier it was reported that the ex-Prime Minister refused to get out of bed and go to the court of appeal. In turn, the Deputy Prosecutor General of Ukraine Renat Kuzmin believes that Tymoshenko can simulate his illness in a pre -trial detention center, reports Newsru.ua .

Recall that the Pechersky district court of Kyiv on October 11 sentenced ex-Prime Minister Yulia Tymoshenko to 7 years in prison with a ban on holding certain state debts for another 3 years for exceeding official powers when signing gas contracts with Russia.

On December 7 and 8, the Shevchenkovsky District Court held on-site sessions in the Lukyanovsky pre-trial detention center of Kyiv, where Tymoshenko was in custody, and elected a preventive measure in the form of arrest for two months in the case of the United Energy Systems of Ukraine (EES) for the ex-Prime Minister, although it is already in custody. Tymoshenko also appealed to this decision.

During meetings in Tymoshenko, she lay, referring to a serious condition. Earlier, her defense claimed that during his stay in the Lukyanovsky pre -trial detention center Tymoshenko’s health was worsened and she no longer got out of bed.

Tymoshenko has already been examined outside the pre -trial detention center. She identified problems with the spine and bruising on the body, but the exact diagnosis was not disclosed, since Tymoshenko herself is necessary for this.

Tymoshenko has been examining the complaint of Tymoshenko about the verdict in the "gas case" from the beginning of December. She herself has never been at meetings for health reasons. The accusation believes that Tymoshenko simulates the disease .

Earlier due to public resonance, President of Ukraine Yanukovych was forced to promise that Tymoshenko would be provided with the necessary medical care. During a visit to Ukraine, President of Poland Bronislav Komorovsky Yanukovych said that he instructed the relevant institutions to ensure the examination, treatment and maintenance of Tymoshenko at the European level.

On November 29, ex-Prime Minister Tymoshenko was taken from the investigative insulator to a physical examination, and then returned to Lukyanovsky pre-trial detention center and transferred to the medical part of the institution. At the same time, about a dozen more things were brought against Tymoshenko.
