
The world of mixed martial arts Rasul Mirzaev, after which student Ivan Agafonov died, was again charged with a heavier article, RIA Novosti reports. The relatives of the deceased asked for this, speaking in court. Now Mirzaev is again accused of intentionally causing serious harm to health. Under this article, he was brought in the first charge. However, before transferring the case to the court, the investigators softened the prosecution and issued the case under the article “Murder by negligence”. This article provides for a punishment in the form of two years in prison. The article, which is now again offered to judge the athlete, threatens 15 years in a colony.
On the eve of the Zamoskvoretsky court of Moscow refused to consider the Mirzaev case, returning it to the prosecutor’s office for an additional investigation. Earlier on Wednesday, the court extended the arrest of Mirzaev for two months.
On Monday, the Zamoskvoretsky court released the athlete on bail of 100 thousand rubles, but this decision was canceled by the Moscow City Court. After the extension of the arrest, the lawyer of the victims Oksana Mikhalkina asked the prosecutor to return the case to eliminate contradictions. The prosecutor supported this petition. As it turned out in court, the party to the victims received notifications of the appointment of the examination on the same day when the results of these examinations came. The court considered it a "gross violation of the law."
The victims hope that when repeatedly studying the case in the prosecutor's office, the case can again retrape and accuse the athlete under the more stringent article "Intentional harm to health that caused death." Before transferring the case to the court, investigators softened the charge, applying the article "Murder by negligence." Earlier, Mirzaev threatened up to 15 years in prison, now the maximum punishment is two years of imprisonment.
After the court decision on the release of the athlete on bail, the nationalists announced their intention to hold a rally in the center of Moscow. The action will be held on February 18 on pure ponds. "We will exit without leaders, without flags and symbols. We will be released by justice. Now we have no other choice," the campaign page in VKontakte says.
Sud refused to consider the Mirzaev case in a special manner providing for the mitigation of punishment. Mirzaev asked for the consideration of the case in a special order, pleading guilty and expressing remorse in the murder by negligence. The mother of the deceased objected to the consideration of the case in a special order, and her opinion was taken into account by the court. When considering the case in a special order, the meetings are held without studying evidence and interrogation of witnesses, and the defendant is sentenced to two -thirds from the maximum sanction of the articles incriminated to him.
According to the investigation, on August 13, Mirzaev hit Agafonov at the Garage nightclub in Moscow, who after that was hospitalized and died a few days later, without regaining consciousness. The security forces detained Mirzaev on August 19 after interrogation on suspicion of committing a crime under part 4 of Article 111 of the Criminal Code.
In October, the parents of Ivan Agafonov called the information that the cause of the death of their son was a fall from a hospital gurney. “At present, the investigation has complete and objective data about what happened, but neither the investigator nor the relatives of Ivan have information that he was falling from the gurney,” said the representative of the victims Oksana Mikhalkina.
She considers the information published in a number of the media "a provocation that is beneficial exclusively to the lawyers of Mirzaev." According to Mikhalkina, currently the mother of Agafonova is recognized as a victim in the case, like his father and sister. “She gave exhaustive testimonies, including what happened in the hospital, where Ivan was brought after a blow,” Mikhalkina added.
