There is less and less passive waiting for the end of the work of teacher Ryabov in musical circles. The trial that began forced the eyes of even those who had hoped that they would “get away with it” to open their eyes. There was relative silence for a year. Having achieved Ryabov's release on bail , many calmed down. Like, now he will safely live to see the court, which will certainly sort everything out. After all, the lie, because of which a case was opened against Ryabov, is so blatant and cynical that, it would seem, it would be difficult not to see the truth, even just a little bit.
After all, only if you don’t delve into it at all, you can pretend that you believe that the leading teacher in the industry, who has been teaching for forty years and has not been noticed in anything like this, suddenly turned into a pervert, and that he went astray solely under the impression of Tanya Yuryeva, whom he refused to take into his class in 2009, and from Ira Korniychuk, whom he also officially abandoned before her mother accused him of harassing her daughter in December 2010. And that the former director of the Central Music School, Yakupov, quite accidentally provided the investigation with several false copies of unknown documents, as well as a couple of real copies from false originals. All accusations are based on paraphrases and no one has ever actually seen or heard anything. There is not a single piece of evidence, material evidence or seedy analysis in the case. There is nothing at all. Just the words in the retelling of a gang of conspiring criminals. In order not to notice all this, you have to try very hard.
And now everyone can see the efforts of Judge Tkachuk.
People far from judicial topics did not even suspect that what they expected from this process - justice and complete acquittal of Ryabov - was a real fantasy. Because the chance of being acquitted by a Russian court for any person against whom a criminal case has been opened (no matter how) is almost zero.
It is now obvious to many that the trial is in fact tantamount to murder and that Ryabov, even if he lives to see the verdict, may not survive the verdict itself. Because there is no trace of a search for truth in the ongoing trial, but only a cruel and cynical adjustment of the material to the indictment. You can forget that the crime is still just a hypothesis, that the accused has a presumption of innocence. With the tenfold repetition of “what was the victim wearing that day,” a chain of reasoning is persistently driven into the jury’s brains: since she was wearing something and since there was a certain day when she was wearing something, it means there was a crime . How, on that very day when Irochka was in such and such a dress - do you want to say that nothing happened?! What are you talking about? The dress is installed! By whom? Yes Irochka! Together with the mother-lawyer, who is also the legal representative of her child.
Attitudes towards “innocent babies” are also changing day by day. For a year, there was an invisible vacuum around the “unsuccessfully pranked” girls, an aura of expectation, which they, of course, did not notice, flaunting the riot police. Riot police, intimidated by the terrible Ryabov (which is funny and scary at the same time to hear about for anyone who knows him), were allocated by the state at the expense of taxpayers. It looks funny because of its absurdity, but this performance is terrible and tragic. The always glamorous girl Irochka, wearing rags, gives evidence in court, wiping herself with a handkerchief kept in her fist. But the second girl leaves the courtroom and, closing the door behind her, sighs with relief and smiles, waiting at the door for the “witness” - a professional psychologist who taught Tanya how to cry on order and who herself sobbed in the courtroom so much that the glass of water allocated by the kind judge, For a long time I could not calm this cynical aunt.
The entire large team of the school, consisting, of course, of a wide variety of people, is involved in this process in one way or another. And many people care too. Among Ryabov’s colleagues at the Central Music School there was one—only one—a certain Makarova, who testified against him. Makarova did not appear in court, but her testimony was read to the jury. She, naturally, could not say absolutely anything on the merits of the matter, but she stirred up a lot of dirt, from her imagining Ryabov’s alcoholism to his living in the same apartment with a student instead of a hotel during the competition. But it turned out that the apartment of Ryabov’s friends in another city was three-room, and, most importantly, her mother lived there with the girl. And they preferred the apartment to the hotel because there was a piano there. But this information was not disclosed to the jury, since the investigation decided that “no operational data was obtained from it,” and only Makarova’s testimony was read to them.
What was behind the horror with which Makarova called her colleagues at the beginning of the process, howling: “Yakupov will fire me if Ryabov doesn’t quit!” Was it really just the fear of losing the gravy train in the form of a job at a prestigious school?
Fortunately, there was no one else who wanted to slander Ryabov - neither a teacher, nor a student, nor a parent. A huge number of letters, petitions and guarantees for him - that’s what makes up a good two volumes in the case!
But for investigators to bring charges, the testimony given by two girls with whom the honored teacher refused to work was enough. The more you delve into this matter, the more details you find out, the more terrible the picture is drawn: how the most severe criminal prosecution was painted on the words alone, transmitted through third parties.
The trial, in the opinion of everyone who attends it, is truly the triumph of evil. The judge first listens to the witnesses and decides which of them are allowed to appear on the jury and which are not; he rejects everyone who can say something that really exposes the “victims” to lies. They leave the hall in a state of moral shock, with shaking hands and distorted faces, many are crying. Prosecution lawyer Korniychuk - she is also the mother of one of the “victims” - openly influences the court; she decides who is allowed to sit on the jury and who is not.
Many people: Central Music School students and their parents, students of music universities, fellow teachers - come to the Moscow City Court in the hope of helping the court understand what happened on each specific day of the 52 days described by the investigation as “episodes”. But the court, and this is already clear to everyone, does not intend to sort it out. These episodes appeared in such numbers in the case when it was returned for revision last summer. The investigators got their hands on the approximate class schedule, and they simply stupidly assigned an episode to each lesson for the “victims.”
The story of the rector of the State Academy of Culture named after M. has been circulating on the Internet for a month now. Maimonides V.R. Irina about how this happened: “The case is fabricated, falsified quite brazenly and openly, and by the will of fate I am one of the accomplices of this act. Having noticed that not a single witness for the defense was questioned by the investigation, I personally went for a conversation with the Investigative Committee of Moscow and the district prosecutor's office. Since Ryabov at that time was an associate professor of the piano department of the State Academy of Arts and we were also conducting our own internal investigation, I asked him to write me a schedule of work with students from memory (I still have the original). I brought this schedule to the Investigative Committee and the prosecutor’s office and asked to question the students whose work time overlapped with the applicant’s lessons. Instead, an additional episode of harassment was introduced for each lesson??!!! Instead of one there were 51 of them...” Correction: not 51 episodes, but 52.
About 40 of them belong to the “star of the trial” Irina Korniychuk. Considering that Irina Korniychuk came to Ryabov’s class in January 2010, and in her testimony she says that the teacher began harassing her in April and ended in November, since, according to her mother, lawyer Korniychuk, she learned from her daughter “the whole truth ”at the end of October, but decided to wait another month, since there was a music competition ahead, it turns out that there were fewer lessons during this period than episodes of “violent acts of a sexual nature.”
The rest of the episodes went to Yuryeva, who came to class No. 402 with teacher Ryabov for paid lessons as a tutor (this was in 2009). Her mother, who, according to witnesses (those who sat in the classroom during Yuryeva's lessons or entered the classroom during classes), was almost always present in the classroom, now states in court that she “went to the movies” while Ryabov “seduced” his daughter.
Yurieva’s statement is based on a long chain of “eyewitnesses”, none of whom personally saw anything: the girl allegedly told her mother’s friend, who is the director of the psychological center “Dialogue” in the city of Ramenskoye, about the harassment, and the psychologist told the mother, and the mother told the investigators, and the investigators gave For Tanya Yuryeva, the remnants of “episodes” from Ira Korniychuk’s master’s shoulder. Both the mother and her friend claim that they found out “everything” in August 2009. But the court is clearly not interested in raising the issue of the responsibility of these “indirect witnesses” (including an official working with children) for concealing for two years a serious crime, which they now sobbed about to Judge Tkachuk and the jury.
These indirect witnesses for the prosecution, who did not see or hear anything, but enthusiastically convey each other's stories, interested the court. But the court is not interested in defense witnesses who want to say what they saw and heard personally (just as they were not interested in the investigation before), because they “were not present when the crime was committed.” Well, the judge was right about this in his own way: it was impossible to be present at something that did not happen.
But why is the court not interested in witness testimony that could expose Korniychuk and Yuryeva as lying about what really happened in specific lessons? Why is the court not interested in the opinion of the teachers of the Central Music School about the personal qualities of the victims - “poor babies”, as the Internet affectionately dubbed them? After all, the jury could have looked more carefully into the honest eyes of the “victims”, having learned that Ira Korniychuk, even before the events described, loved to tell her friends fantastic stories about herself, even to the point that her mother was dying, and she herself had moved to another school school. And that Tanya Yuryeva is not averse to using blackmail to get what she wants, even the attention of the boy she likes. Why is the court not interested in witnesses who, within the walls of the school and even within the walls of specific class No. 402, saw and heard a lot of things that contradict the testimony of the “poor little ones”?
I think the answer is known: because the court is not interested in establishing the truth. It is possible that the text of the guilty verdict already lives somewhere in the files of the judge’s laptop, and Judge Tkachuk is not interested in making changes to it. And the defendant Anatoly Ryabov was taken to the hospital by ambulance on the night of March 20. The day before, the judge advised him to “take a pill and get ready.” One of those present at this trial told me: “I have never seen such a complexion on a person. Ryabov came out of the hall simply not looking, and he looked terrible. Some kind of sallow-brown face, a mixture of pallor and swelling at the same time.”
Ryabov is 66 years old, he has a heart condition and is hypertensive. On March 15, the teacher became ill on the way to court, but he was categorically against hospitalization. He was getting worse, on medication all the time, high blood pressure. As a result, at night the ambulance, having performed four cardiograms (since he again did not want to go to the hospital), took away Anatoly Yakovlevich with a diagnosis of “hypertensive crisis”. Whether Anatoly Ryabov will live to see the verdict is pronounced is another question. But everyone who knows this man is confident of his innocence, regardless of what a biased and controlled court, whose bias is no longer in doubt, says about this. And in any case, every detail of this shameful process will be made public.
Within the walls of the Central Music School, where this “pedo affair” was composed, indignation at what is happening is growing. Information has emerged that the school staff has prepared a letter to higher authorities demanding that they rid the school of disgracing students who are following their bones to glory.
