At a meeting on Wednesday, the Moscow City Court rejected the cassation appeal of actress Chulpan Khamatova and the Kommersant publishing house, recognizing as legal the decision of the Tverskoy Court of the capital, which obliged the defendants to refute the published information and pay compensation to the Federation Foundation in the amount of 2 rubles (1 ruble from each of the defendants) .

The reason for the trial in October 2011 was an article in the Kommersant newspaper dated March 9, 2011. The material, in particular, quoted Khamatova, who stated that some of the trustees of the Federation Foundation are people of “dubious reputation.” A refutation of this particular phrase is to be published by Kommersant.

Initially, the plaintiff planned to recover 1 million rubles from his offenders, but during the trial he reduced the amount of demands to 1 ruble.

The actress did not agree with the court's decision. What needed to be refuted? The last three words: “I managed to find a list [of trustees of the fund], it contained either people about whom no one knows anything, or simply people with a dubious reputation” (Kommersant, March 9, 2011). But the conversation turned to commentary in general. Chulpan tried to explain that this is not a statement, but an opinion, for which there was definitely a reason: a complete lack of information on the part of the “Federation” about what the fund is - what founders, trustees, charter, etc. it has. This fact is not could not have embarrassed Khamatova, as a person who has been working in the field of charity for a long time. She did not endorse the comment and meant something slightly different. There was no list as such, just all that she could find out about the “Federation” were a few names mentioned in online publications. But this does not change the essence of the matter: “I wanted to convey: dear Federation Foundation, let us exist according to the generally accepted ethical charter - openness, transparency, accessibility of information.”

In December 2010, the Federation Foundation held a charity concert in St. Petersburg with the participation of world stars and Russian Prime Minister Vladimir Putin. A few months after the event, a scandal erupted: the mother of one of the children with cancer stated that the money promised by the foundation was never transferred to medical institutions. In response, representatives of the Federation explained that the foundation was not raising funds, but was only organizing the event. Later, several hospitals still received help from the philanthropists attracted at the concert.

After today's meeting, the court's decision is considered to have entered into legal force.
