
The European Court of Human Rights recognized that Russia violated the third article of the European Human Rights Convention prohibiting inhuman appeal, since relatives of the executed under Katynya remained in the ignorance of their fate, Interfax reports on Monday.
According to the decision of the ECHR, the rights of the widow of the Polish officer and nine applicants, who were born until 1940, were violated - only they had "a sustainable emotional connection with her husband or father." It is noted that these ten people were injured twice - they not only lost their loved ones in the war, but also could not find out the truth about their fate for more than 40 years, "while it was conceived and distorted by the authorities of the USSR and communist Poland."
The remaining five applicants, who were distant relatives of the dead or were born later than the specified period, as it turned out, suffered less from the lack of victims of the execution.
Meanwhile, according to RIA Novosti , the judges did not make a decision to violate Article 2 - the right to life. The lawyer of relatives of Kaminsky, who were shot under Katynya, said that this article was most important for his customers and he intends to appeal the decision in the Grand Chamber of the ECHR.
The ECHR recognized the complaints of Polish citizens against Russia, related to the closure of 12 relatives in 1990. The plaintiffs argue that 12 people, including police officers and the army, a military doctor and director of the school, were taken to Soviet camps and killed without a trial from April to May 1940 near Katyny, in Kharkov, as well as in Tver.
The investigation of the circumstances of the death of Polish citizens began in Russia in 1990. Nevertheless, subsequently it ceased due to the fact that the bodies of the Poles were allegedly not identified. According to the plaintiffs, the names of their relatives were included in the lists of prisoners of camps, and the bodies of some of them were identified during the exhumation in 1943. The plaintiffs appealed to the decision of the Russian authorities, but to no avail.
Note that the deputy chairman of the Central Committee of the Communist Party, deputy Vladimir Kashin on the eve of the vote in the State Duma stated that the adoption of the statement under discussion would entail huge financial claims to Russia. According to him, Poland has already stated that the price of this statement is 2 trillion euros.
