The prosecutor's office filed claims against the Rostov McDonald's

The prosecutor's office of the Kirovsky district of Rostov-on-Don appealed to the Tverskoy Court of Moscow with a demand to temporarily suspend the work of one of the city restaurants of the McDonald's fast food chain. The reason for the appeal was the results of an inspection by the department of fast food operations, during which violations of sanitary and fire safety standards were discovered. Six administrative cases have been initiated against the company. McDonald's itself does not comment on the situation. According to experts, such cases are rare: Americans usually diligently comply with sanitary and epidemiological standards.

“Numerous violations of fire safety legislation and legislation on sanitary and epidemiological welfare of the population were revealed in the activities of the McDonald’s restaurant on Pushkinskaya Street,” reported the press service of the regional prosecutor’s office. The reason for the inspection was a report from police officers who carried out operational search activities in the restaurant (we are talking about theft. - Kommersant). “The police saw the violations and contacted us,” a representative of the prosecutor’s office told Kommersant.

During the inspection, which lasted from April 19 to April 27, prosecutors discovered that combustible materials were stored in the electrical panel and ventilation rooms, technical rooms were not separated from the main room by fire doors, light signs indicating exit were turned off, goods were stored in the corridor in front of the emergency exit, a basement not separated from the main part of the restaurant by a staircase and not equipped with a smoke ventilation system. In addition, the dining tables and salad preparation areas were in an unsatisfactory sanitary and hygienic condition, and, as it turned out, 16 employees were allowed to work without a full medical examination. As a result, six administrative cases were initiated against McDonald's LLC under Art. 6.6. Code of Administrative Offenses (violation of sanitary and epidemiological requirements for catering for the population in specially equipped places), Part 1 of Art. 20.4 Code of Administrative Offenses (Violation of fire safety requirements) and Part 4 of Art. 20.4 Code of Administrative Offenses (Violation of fire safety requirements for escape routes, emergency exits or automatic fire extinguishing systems and fire alarm systems). The department also demands that McDonald's be obligated to eliminate all violations of the law and insists on suspending the restaurant's activities for this period. The network's press service did not answer the phone yesterday. The restaurant on Pushkinskaya only reported that the establishment was operating as usual.

McDonald's Corporation is an American chain of fast food restaurants, founded in 1940, operating in more than 100 countries. The headquarters is located in Oak Brook, a suburb of Chicago, USA. The company's first Russian restaurant opened in Moscow on Pushkinskaya Square in January 1990. Russian subsidiaries are Moscow-McDonald's CJSC and McDonald's LLC. McDonald's on Pushkinskaya is one of the first restaurants of the American fast food chain to open in Rostov. Now the company has six fast food outlets in the city, restaurants are also open in Novocherkassk and Aksai, and two restaurants are under construction - in Rostov and Shakhty. According to the prosecutor's office, the department had not previously inspected the work of the chain's restaurants.

“As far as I can remember, fast food establishments, especially foreign ones, are fined and closed extremely rarely. This is due, first of all, to the fact that such networks try to pursue the most transparent policy and comply with all sanitary standards. The chain usually operates on semi-finished products, which are delivered to restaurants in finished form. This distinguishes them from full-service restaurants, where there is a sufficient amount of waste,” says Andrey Petrakov from the consulting company Restkon.

“Our employees who previously worked at McDonald’s say that such violations sometimes happen, but its employees usually have no problems with documents - they all work with medical records and undergo a full examination,” notes a representative of one of the competing chains .

According to Mr. Petrakov, the damage from the closure of the restaurant could amount to 120 thousand rubles. per day with an average bill of 120 rubles. Another Kommersant interlocutor puts the figure at 500 thousand rubles. “Only Art. 6.6 of the Code of Administrative Offenses (violation of sanitary rules) allows the court to suspend the activities of a legal entity for up to 90 days. Cases are often brought against cafes and restaurants under this article, but in most cases a fine is imposed for these violations. Suspension of activities is used extremely rarely,” says Sergei Radchenko, senior lawyer at the law firm YUG.
